(SECTION – A) (04X15)
1. A large section of scholars has opined that labour market regulations add to production
cost, restricts flexibility and efficiency, stifle the competition and hinder economic
growth. In view of the above statement, discuss the potential effects of job security
regulations on the demand for employees.
2. The controversy in the industrial relations revolve around the conflicts between two
contrasting legal regimes; legal regime promoting a rigid labour law structure and priority
is given to labour rights over the demands of the market economy. The other one
promotes a flexible and liberalized labour law regime, operating through contract labour.
It is now vehemently argued that the constitutional guarantees that protect workers’
interest for a long time are threatened with the onset of liberalization of economy.
Examine the existing scenario and discuss whether the court’s approach which is guided
by the economic policy of the government does necessarily mean compromising labour
interests?
3. The discretionary power of an administrative authority can be challenged on the ground
that the authority is deemed not to have exercised its discretion at all or the authority has
exercised its discretion improperly.
Applying the aforesaid principle, discuss the amenability of judicial scrutiny when the
appropriate government makes a reference of an industrial dispute for adjudication.
4. The Bombay Municipal Corporation runs a public utility transport service in Greater
Bombay and the said transport service is managed by a Committee known as the Bombay
Electricity Supply and Transport (B.E.S.T.) Committee. The Undertaking owns a number
of buses and the Corporation employs staff, including bus drivers, for conducting the said
service. One P. Nanu Raman was one of such bus drivers employed by the corporation. A
bus driver has to drive a bus allotted to him from morning till evening with necessary
intervals, and for that purpose he has to reach the depot concerned early in the morning
and go back to his home after his work is finished and the bus is lodged in the depot. Rule
19 of the Standing Rules of the B.E.S.T. permits a specified number of the traffic outdoor
staff in uniform to travel standing in a bus without payment of fares. Having regard to the
long distances to be covered in a city like Bombay, the statutory right conferred under the
rule is conducive to the efficiency of the service. On March 20, 2019, the said Nanu
Raman after finishing his duty left the bus at the depot and boarded another bus in order
to go to his residence at Santacruz. The said bus collided with a stationary lorry parked at
the roadside near Erla Bridge, Andheri. As a result of the said collision, Nanu Raman was
thrown out on the road and succumbed to the fatal injuries. His widow filed an
application in the Court of the Commissioner for Workmen's compensation, Bombay,
claiming a sum of Rs. 6,50,000/- as compensation by reason of the death of her husband.
Argue the case from both the claimant and the corporation and decide the liability of the
employer to pay compensation under the Employees Compensation Act 1923.
5. Discuss the sustainability of the lay off / retrenchment compensation claims in the
following cases:
(i) An employee was appointed for a fixed period and the services of the employee
got terminated before the expiry of the period of contract in pursuance of a
stipulation contained in the contract that the services could be terminated even
before the expiry of the contract. The sole reason for the termination was the
incompetence of the employee to perform the job assigned. The employee is
claiming retrenchment compensation under the relevant provision of the Industrial
Disputes Act 1947.
(ii) The Associated Cement Companies were the owners of the Chaibasa Cement
Works and Rajanka Limestone quarry, both situated in the same place, about a
mile and half apart. Limestone is the chief raw material needed for the
manufacture of cement. The union of workers went for a strike and all the
conciliation efforts failed. Consequently, the management closed some parts of the
cement works because of the shortage of limestone and laid off certain workers.
The workers union demanded for lay off compensation for the laid off workers.
(iii) The workman sustains an eye injury and due to the sub-normal eyesight or loss of
required vision to work, his service gets terminated.
6. The definition of the State in Article 12 is for the purposes of both part III and part IV of
the constitution. Therefore, any state actions including actions of the instrumentalities and
agencies of the state must not only be in conformity with the Fundamental Rights
guaranteed by Part III but must also be in accordance with the Directive Principles of the
State Policy prescribed by Part IV. In the light of the above statement discuss the
constitutional obligation of the state as the apex court being hailed as perceptively
receptive in espousing the cause of the labour has identified on various occasions.
