ABOUT THE INSTITUTION
Dr. D.Y. Patil Unitech Society was established in the year 1990 with
the aim of providing education of all fields. Thus spreading education
to the deserving students and thereby helping them to realize their
dreams of career with the help of professional courses. The
educational complex of Unitech Society at Pune covers total 75 acres
of land at Pimpri & Tathwade. The educational complex at Pune
consists 63 institutions. At its Pimpri educational complex the Unitech
society has created excellent facilities for education in various fields
such as Architecture, Engineering, Medical, Dental, Ayurveda,
Homeopathy, Nursing, Physiotherapy, Law, Management, Pharmacy
and Agricultural and Agriculture Marketing Business Management,
etc. It provides world – class education to more than 15,000 National
and International students. The location of the campus is in pollution–
free, lush green and picturesque environment conducive to learning.
Excellent hostel facilities and other student’s amenities like well-
equipped Central Library, Internet Facility, Auditoriums, Seminar
Halls,, ATM Centre, Clinics, and Market for essential commodities,
Banks, etc. are provided at campus.

Dr. D. Y. Patil Law College was established in the year 2001 and it is
distinguished Law College affiliated with the University of Pune.
Sheltered in huge well architecture premises along with multiple
institutes, The college has a unique academic atmosphere chiefly
characterized by interdisciplinary scholarly interaction and healthy
competitive spirit and enthusiasm to excel in various curricular
activities. Dr. D. Y. Patil Law College offers imparting knowledge and
learning in legal disciplines to meet global challenges of 21st century.
Within a very short span of time the college has gained recognition for
preparing and grooming the students at under–graduate level into
academically meritorious students and professionally efficient

National Moot Court Competition 2024

- Moot Proposition -
1. The Union of Indiana is a diverse nation located on the Continent of Asiana. With a
population of over 1.4 billion, it is the largest democratic country in the world and has a
federal form of government. It claimed its independence in 1947 and is governed by the
Constitution of Indiana, 1950. Like every democratic country Indiana also faces some
unprecedented Socio and Political challenges. These challenges often raise unsought or
unanswered legal questions. These questions require fresh interpretation of statues of law.
One such instance has been seen in the state of Mahapradesh.
2. The “Shakti Sangha Party” has been recognized as a state political party by the Election
Commission of Indiana in 1966 with its strong ideology on freedom of speech, rational
secularism, socialism, national integrity and many more. On 23rd January 2018, Mr.
Jitendra Jagga was elected as the Party President or the „Paksh Pramukh‟. In October
2019, the 14th Legislative Assembly of Mahapradesh was held for a total of two hundred
and eight-eight seats. In this election the seats secured by different political parties have
been as follows:-,

3. The SSP formed a post-poll alliance with RJP and the IJP which came to be known as
Gramin Uday Aghadi (Hereafter GUA). The GUA successfully secured the claim to form
government and Mr. Jitendra Jagga was sworn in as the Chief Minister of Mahapradesh.
Furthermore, on 25th November 2019, Mr. Jagganath Salvi was appointed Group Leader
of SSP, a post so far held by Mr. Jitendra Jagga. and Mr. Samay Prakash was appointed
as the Chief Whip of SSP on the same day this information was communicated to the
Speaker of the Mahapradesh Legislative Assembly.
4. In June 2022, it was reported that some MLAs of SSP were meeting the senior leaders of
the ILP, the opposition party. The reason was claimed to be the difference of ideology
among the members of the SSP. The core ideologies of SSP have always been more like
that of ILP than that of RP and IJP. At this time, due to the vacant seat of Speaker, its
duties were being discharged by the Deputy Speaker, Mr. Nazim Zohari.

5. Later, SSP got fractured into two factions: One led by then Chief Minister Mr. Jitendra
Jagga, and the other led by Group Leader of the SSP, Mr. Jagganath Salvi. Each faction
passed numerous resolutions pertaining to matters of the SSP claiming to be the “real”
political party. Mr. Jagganath Salvi faction‟s decision signified a key change in its
position within the SSP. Earlier, the faction appointed Mr. Jagganath Salvi as the Chief
Leader of SSP, while it continuously maintained Mr. Jitendra Jagga as their Party Chief.
6. On 21st June 2022, the Chief Whip of SSP, Mr. Samay Prakash, issued a whip for a
meeting for all the MLAs of SSP. Many MLAs including the group leader Mr.
Jagganath Salvi, did not attend the meeting. A resolution was passed in the same
meeting replacing Mr. Jagganath Salvi with one Mr. Amar Chaurasia as the Group
Leader of SSP and the same was communicated to the Deputy Speaker on the very same
day. The Deputy Speaker communicated his acceptance of the change in the Group
Leader of the SSP.
7. On the same day, thirty-four MLAs of SSP organized a separate meeting and passed a
resolution in the city of Wowhati, Sama reaffirming that Mr. Jagganath Salvi
“Continues to be” the group leader of the SSP. Mr. Jagganath Salvi faction's national
executive had passed a one-line resolution by appointing Mr. Jagganath Salvi as Party
Chief and National leader of the SSP. A resolution was also passed that Mr. Samay
Prakash was discharged from his duties as Chief Whip and Mr. Indu Gogoi was
appointed in his place. The resolution is dated 21st June 2022.
8. Mr. Jagganath Salvi communicated the resolution passed by the thirty-four MLAs of the
SSP to the Deputy Speaker due to which his appointment as Group Leader of SSP was
reaffirmed. He also requested the Deputy Speaker not to recognize Mr. Atul Chaurasia
as the Group Leader of SSP as the resolution reaffirming his appointment was passed.
Further the party headed by Chief Whip Mr. Samay Prakash claimed that the Deputy
Speaker received its communication on 22nd June 2022 while the other faction of SSP
led by Mr. Jagganath Salvi claimed it to be on 21st June 2022.
9. Deputy Speaker, Mr. Nazim Zohari was also notified that a motion for his removal from
office has been called by the same thirty-four MLAs. The notice was issued under
Article 179(c) of the Constitution read with Rule 11 of the Mahapradesh Legislative
Assembly Rules 2019.
10. Later, On 22nd June 2022, Mr. Samay Prakash called all the MLAs of SSP through a
medium of individual communications to attend a meeting that evening. The
communication also mentioned that failure to attend the meeting will result in action
against the individual(s) as per the provisions of the Constitution. The action was said to
be taken under Schedule 10 of the Constitution. This meeting too was not attended by
Mr. Jagganath Salvi and many other MLAs of SSP.

11. Mr. Jagganath Salvi accused Mr. Samay Prakash of misusing the letterhead of SSP. He
also claimed that a meeting of forty-five MLAs of the SSP was held under his
chairmanship. He also claimed that Mr. Samay Prakash has been removed from the
position of Chief Whip of the SSP. In place of Mr. Samay Prakash, Mr. Indu Gogoi was
appointed as Chief Whip of the SSP, so Mr. Samay Prakash did not have the authority
to sign the communication dated 22nd June 2022. It was therefore not binding upon Mr.
Jagganath Salvi to attend the meeting scheduled by Mr. Samay Prakash
12. Mr. Samay Prakash filed a petition dated 23rd June 2022, under Paragraph 2(1)(a) of the
Tenth Schedule of the Constitution for the disqualification of Mr. Jagganath Salvi and
fifteen other MLAs of the SSP. On 25th June 2022, The Deputy Speaker issued a notice
instructing written submissions be made to him as per the procedure laid in the
Members of Mahapradesh Legislative Assembly (Disqualification on Ground of
Defection) Rules 1986 by Monday, 27th June 2022 by 5.30 p.m.
13. On 27th June 2022, the hon‟ble Supreme Court of Indiana was approached under Article
32 of the Constitution by the faction of Mr. Jagganath Salvi. The Apex Court passed an
interim order extending the time to respond to the disqualification petition from 27th
June 2022 to 12th July 2022. In the meantime, Mr. Samay Prakash filed a petition for the
disqualification of two independent MLAs on 25th June 2022 and against twenty-two
MLAs of the SSP on 27th June 2022.
14. On 28th June 2022, Mr. Christopher the opposition leader called upon the Governor to
direct Mr. Jitendra Jagga to prove his majority on the floor of the House. The then Chief
Minister Mr. Jitendra Jagga was called upon by the Governor to face a floor test on 30th
June 2022.
15. On 29th June 2022, under a writ petition Mr. Samay Prakash approached the Supreme
Court of Indiana to stay the trust vote as the disqualification petition against forty-two
MLAs of the SSP was still pending for consideration before the Deputy Speaker. The
Court rejected the writ petition and declined to stay the trust vote scheduled for 30th
June 2022. Following this development, Mr. Jitendra Jagga resigned the same day.
16. The very next day, on 30th June 2022, Mr. Christopher informed the Governor stating
that one hundred and six MLAs from ILP and eight independent and other MLAs were
extending support to Mr. Jagganath Salvi. In another letter to the Governor Mr.
Jagganath Salvi claimed that with the support of thirty-nine MLAs of SSP along with
one hundred and six ILP MLAs and seventeen independent and other MLAs he had the
support of the majority and requested the Governor to invite him to take oath as Chief
Minister. On the same day, the Governor invited Mr. Jagganath Salvi to prove the
confidence of the assembly within seven days.

17. After proving the confidence of assembly, on 30th June 2022, Mr. Jagganath Salvi and
Mr. Christopher took oath as Chief Minister and Deputy Chief Minister of
Mahapradesh, respectively. On the same day, Mr. Jitendra Jagga issued a letter to Mr.
Jagganath Salvi informing him of his removal from the post of „SSP Leader‟. Mr.
Jitendra Jagga also removed other MLAs of SSP from their roles as office-bearers of the
party.
18. On 4th July 2022, the election for the Speaker was conducted within the Mahapradesh
Legislative Assembly. An MLA belonging to the ILP nominated Mr. Ramlal Norway of
the ILP for this position while an MLA of SSP (Mr. Jitendra Jagga‟s faction) nominated
Mr. Rahul Sengi for the post.
19. Mr. Samay Prakash issued two whips on 2nd July 2022, first directing all the MLAs of
SSP to attend the session on 4th July 2022 and vote against the motion of confidence for
the Council of Ministers headed by the Chief Minister Mr. Jagganath Salvi and the
second whip was directed to all MLAs of SSP to vote for the SSP candidate on the post
of Speaker. The election for the post was conducted and Mr. Ramlal Norway of the ILP
emerged victorious. Consequently, Mr. Samay Prakash instituted a fresh
disqualification proceeding against the thirty-nine MLAs of SSP who voted in favor of
Mr. Ramlal Norway under Paragraph 2(1)(b) of the Tenth Schedule to the Constitution
for violating the whip issued by him.
20. After resuming the office as the Speaker of the house, Mr. Ramlal Norway approved the
appointment of Mr. Jagganath Salvi as the Leader of SSP and cancelled the approval
granted to Mr. Atul Chourasia earlier. Further he recognized Mr. Indu Gogoi as the
Chief Whip of SSP. Further Mr. Indu Gogoi issued a new whip on 3rd July 2022
directing all the MLAs of SLLP to the Assembly Session and voted in favor of the
motion of confidence for the Council of Ministers headed by Mr. Jagganath Salvi.
21. In the Assembly each faction continued to claim that the appointments made by them
and communicated to the Speaker, or the Deputy Speaker were legal and valid, and that
the appointments made by the opposite faction were illegal and invalid. Repeatedly, the
question, which faction is the “real” SSP arose.
22. Soon thereafter the SSP (faction led by Mr. Jitendra Jagga) issued notices of its
intention to remove the Speaker Mr. Ramlal Norway under Article 179(c) of the
Constitution read with Rule 11 of the Mahapradesh Legislative Assembly Rules 2019.
23. On 4th July 2022, Mr. Samay Prakash filed a fresh petition for the disqualification of
thirty-nine MLAs (led by Mr. Jagganath Salvi) under Paragraph 2(1)(b) of the tenth
Schedule for violating the whip issued by him on 2nd July 2022.

24. Mr. Indu Gogoi also filed a petition for disqualification of fourteen MLAs of the SSP
(led by Mr. Jitendra Jagga) under Paragraph 2(1)(a) and 2(1)(b) of the Tenth Schedule
for Violating the whip issued by him on 3rd July 2022.
25. In these turn of events, both the factions of SSP claimed the symbol of „Dhanush‟ of
SSP which gave rise to another dispute among both the factions. The matter then got the
notice of Election Commission of Indiana (ECI). The ECI directed both the factions to
submit their written submission and any documents in favor of the claims.
26. A writ petition was filed before the Supreme Court of Indiana. For ease of reference,
SSP (faction led by Mr. Jitendra Jagga) shall be called the Petitioner and SSP (faction
led by Mr. Jagganath Salvi) as the Respondent.

ISSUES RAISED :

1. Whether the Anti-Defection law under 10th Schedule of the Constitution affect
legislators‟ ability to make decisions? Does change in ideology after the elections by a
political party entitle the elected members to quit their party/switch sides without being
penalized under the Anti-Defection Law?

2. Whether a notice for removal of a Speaker restricts him/her from continuing with
disqualification proceedings under 10th Schedule of the Constitution?

3. Whether the pendency of disqualification petition against members impact the


proceedings of the house of State Legislature?

Note:

• All the laws of Indiana are pari-materia to that of India and the state Laws of
Mahapradesh are pari-materia to that of state of Maharashtra.
• This proposition is a work of fiction. Any events or names mentioned if coinciding with
real life events is purely a coincidence.
• The participants should strictly adhere to the above-mentioned issues enumerated in the
present moot proposition.

- Rules & Regulations -


• Date & Venue

The competition is scheduled to be held in three parts, where in all the rounds
will be conducted online in 2024.

• Language -

The competition shall be conducted only in English language.

• Eligibility - The competition is open for students who are pursuing a law degree
either a three-year course or a five-year integrated course during the current
academic year. Also, only one team can participate from one institution.

• Team Composition – Each team should consist of a minimum of 2 and


maximum of 3 members (under no circumstances these number can be
modified). There shall be 2 speakers and a researcher. Each team will be
provided with a team code after the successful registration. And, no team shall
disclose the identity of their institution during the competition; such disclosures
shall invite penalties or disqualifications at the discretion of the convener of the
Moot Court Committee.

• Dress code for participants throughout the event will be –


Girls : Black salwar and white kurta or white shirt and black
trousers along with black blazer and black shoes.
Boys : White shirt, black trousers and black tie along with black
blazer and black shoes
Note: The participating teams shall also adhere to the above-mentioned
dress code while attending the inaugural and valedictory ceremonies of
the competition

- Registration -
The procedure for registration for the competition, is as follows:

❖ Registration- Interested teams are required to register themselves to


participate in the Competition by filling a registration form on this link -

❖ The teams are also required to mention the E-Mail ID of either the respective
committee or the head/dean of the Institution in the Registration Form.

❖ Deadline for the online Registration – 15th April 2024 (Till 11:59 P.M. IST).

❖ Registration Fee - ₹1, 800/- [Per Team].

❖The confirmation of Registration will be notified to the teams by the


Organizers, after the completion and verification of the Registration formalities.

❖ The teams will be provided with a Team Code and in any stage of the
Competition, a team must be identified only by the allotted team code.

❖ All team members must refrain from disclosing the identity of their
Institution at any time and in any manner during their participation in the
Competition. Non–compliance with this rule shall lead to severe penalty or
disqualification as determined by the Administrators

- Memorial & Evaluation -


1. Submission
The following requirements for memorials must be strictly followed. Non-
conformities will be penalized:
• Each team must prepare memorials for both parties to the dispute (Petitioners
and Respondent).
• Soft copy of the memorials in word format as well as PDF format must be
mailed mcc.law@dypvp.edu.in.
• One advance PDF copy of the memorials (both Applicant and Respondent)
must reach the host institution for evaluation by 22nd April 2024 through
mail.
• Late submission will be penalized by one point each memorial for every day
of delay after due date.
• Once the memorials have been submitted, no revisions / supplements /
additions will be allowed.

2. Memorial
The memorials have to be submitted on given email and must contain:
a) Table of Contents
b) Index of Authorities
c) Statement of Jurisdiction (not more than 1 page)
d) Statement of Facts (1 page only and argumentative statement of facts
would attract penalties)
e) Statement of Issues (not more than 1 page)
f) Summary of Arguments (not more than 2 pages)
g) Arguments Advanced (not more than 15 pages)

- Memorial & Evaluation -


h) Prayer (not more than 1 page)

• Uniform font style is to be used throughout the Memorial. The Font


Style should either be Times New Roman. The font size of the text
should be 12 points (double space) and the font size of the footnotes
should be 10 points (single space) with double space between two
footnotes.
• The memorial must have a margin measuring 1 inch on all sides of
each page.
• All the pages of the memorial, except the Cover Page shall be
numbered.
• The page numbering should be on the top right corner of each page.
• The Bluebook: A Uniform System of Citation (20th Edition) should
be followed in the written submission throughout. Non-compliance
will result in a penalty of 1 mark per page. Substantive/Speaking
footnotes are strictly prohibited. Non-compliance will result in a
penalty of 1 mark per substantive citation.
• Cover must be placed on briefs as follows:

Applicant: Blue color

Respondent: Red color

The Cover Page of the Memorial must contain the following information:
The „team code‟ in the top right corner.
• The cover page of the memorial must state the following:

a) The cause titles.


b) Identify brief as Applicants & Respondents as is applicable.
c) Provisional Team Codes on the top right corner of the
Cover Page.

• Non- compliance of the rules mentioned in Memorials Guidelines shall


attract severe penalties

The teams are advised not to reveal their personal identities or the identity
of their institution anywhere in the memorials. Violation of this provision
shall result in penalties including deduction of marks or disqualification
from the Competition. The decision of the Moot Court Committee shall be
final in this regard.

- Structure of Competition -

1. General Guidelines for Oral Submissions:

i. Teams are not permitted to raise issues in the Oral Rounds that have not
been submitted in their written submissions.

ii. The use of mobile phones, laptops, or any other electronic gadgets for
research or reference purposes is strictly prohibited during the Oral Rounds.

iii. Participants may use their bare acts, print outs and commentaries provided
that anonymity is not violated during the Rounds.

iv. The decision of the Judges as to the marks allotted to each team shall be
final and binding.

2. Structure of Rounds:

i. The Competition shall be conducted over a period of 2 (Two) days i.e.,


from 29th to 30th April, 2024.

ii. The Competition shall consist of the following rounds:

A. Preliminary Rounds B. Semi – Finals C. Final

3. Preliminary Rounds:

i. Each team shall argue once from both sides, i.e., Petitioner and
Respondent, order of which shall be decided by way of draw of lots to be
conducted by the Administrators.

- Structure of Competition -
ii. No two teams shall face each other more than once in the Preliminary
Rounds nor will they argue before the same panel of judges.

iii. Draw of Lots: The fixtures/match-up of teams in Preliminary Rounds shall


be determined on the basis of the draw of lots.

iv. Each side shall get a maximum time of 30 minutes to present their
arguments of which no Speaker shall be permitted to address the Bench for
more than 18 minutes. The time limit is inclusive of the time for Rebuttal or
Sur-rebuttal respectively. The maximum time for Rebuttal is 2minutes and
the maximum time for Surrebuttal is 1 minute. Each speaker is required to
speak for a minimum of 12 minutes exclusive of the time taken for
Rebuttals and Sur-rebuttals.

4. Scoring in the Preliminary Rounds:

i. The qualification or disqualification of the Teams for the Advanced


Roundshall be determined on the basis of the wins only in each Preliminary
Round.

ii. The win or loss of a Team shall be determined on the basis of aggregate
score. The Team with a higher aggregate score shall win the round.

iii. The aggregate score of a Team shall be computed as the total of - Oral

iv. Only those Teams shall qualify to the (Semi Finals) who win the
preliminary rounds. In case of shortage of such teams to even out the
competition in the advanced rounds, the top teams as determined by their
cumulative scores for both the rounds shall be taken into consideration by
the Administrators irrespective of the fact that whether such a team had
won/lost any round whatsoever.

v. In the event of a tie, the following methods shall be used to determine the
rank of the Team:

a) The aggregate score of the Team in their Oral Round One shall be
considered, the Team with a higher score will be allotted a higher rank;

b) If the tie subsists, the Team with the higher speaker score will be allotted
the higher rank;

c) If the tie still subsists, the Team with the highest individual speaker score
out of speakers of tied Teams will be allotted the higher rank;

d) If the tie still subsists, the Team with the higher Memorial score will be
allotted a higher rank;

e) If the tie still subsists, then the rank shall be determined by a toss of a coin.

vi. The Best Mooter Award for each round will be awarded on the basis of the
scores awarded to the Speakers in each such Rounds, meaning thereby that
there will be the Best Mooter award for each round of the Competition.

5. SEMI-FINALS:
i. The top four Teams from the Preliminary Round shall qualify for the Semi-
final round. It shall be a knock out round. The side of pleadings and the
opponent shall be determined on the basis of draw of lots.

ii. Each side shall get a maximum time of 50 minutes to present their
arguments of which no Speaker shall be permitted to address the Court for
more than 30 minutes. The time limit is inclusive of the time for Rebuttal or
Sur-rebuttal respectively. The maximum time for Rebuttal is 5 minutes and
the maximum time for Sur-rebuttal is 3 minutes. Each speaker is required to
speak for a minimum of 22 minutes exclusive of the time taken for
Rebuttals and Sur-rebuttals.

iii. The winner of each courtroom fixture i.e., 2 Teams from the semi-final
round shall proceed to the final round.

6. FINAL ROUND:

i. The top two Teams from the Semi-Final Round shall qualify for the final
round. It shall be a knock out round, where the side for pleading shall be
determined on the basis of draw of lots.

ii. The maximum time for arguments shall be the same as in the Semi-finals.

iii. The Winner of the Final Round shall be declared the winner of the
Competition.

7. SCOUTING

i. Scouting is strictly prohibited.

ii. Any participant/ member of the organizing committee may submit a


complaint regarding Scouting to the Organizers.

iii. Teams found scouting shall be disqualified immediately.

Anonymity
Student counsel may introduce her/himself to the court in the usual manner and
may also state her/his names. However, the team's college / institution
affiliation may not be mentioned at any time before the awards ceremony.
Further, all team members shall refrain from identifying a team’s school at any
time and in any manner, including, but not limited to, wearing any identifying
items, such as school clothing, ties, patches, or pins or carrying identifying
material (such as a book with a college logo, or college seal).

Copyright
The copyright over the memorials submitted for participation in the competition
is assigned by participants and shall also vest completely and fully in Dr. D.Y.
Patil Law College, Pimpri, Pune. The participants shall certify in writing the
originality of materials contained therein and shall be responsible for any claim
or dispute arising out of the further use and exhibition of these materials.
Further use and exhibition of these materials, electronically or otherwise, shall
be the exclusive right of Dr. D.Y. Patil Law College, Pimpri, Pune, and they
shall not be responsible for any liability to any person for any loss caused by
errors or omissions in this collection of information, or for the accuracy,
completeness or adequacy of the information contained in these materials

Disclaimer
If there is any situation, not covered by the Rules, the decision of the Organizers
shall be final and binding.
At no instance the Moot Proposition maker should be contacted by any
participating team, such an action can cause penalties or disqualification
