Project Brief

Make and present a case-study based on group presentation on


Fashion and Design industry in India highlighting the concern related
to Ethics and Morality.
SABYASACHI
Sabyasachi is a renowned Indian fashion
brand founded by designer Sabyasachi
Mukherjee. Specializing in traditional
Indian clothing, the brand is celebrated
for its exquisite bridal wear and
commitment to preserving the rich
heritage of Indian textiles and
craftsmanship. Sabyasachi's designs
showcase the timeless beauty of
handcrafted textiles and embroidery,
empowering local artisans and
promoting Indian culture on a global
scale. The brand is synonymous with
luxury, authenticity, and the celebration
of India's diverse cultural traditions.
Sabyasachi Mukherjee, the renowned Indian
fashion designer, has built a strong brand that
is known for its distinctive and luxurious
ethnic designs. Sabyasachi's brand is

In one of his interview’s Sabyasachi described his style


as ‘personalized imperfection of the human hand’. He
has drawn most of his ideas from his surroundings and
his childhood. Kolkata’s scenic backdrops and imprints
that have left a never changing impact on his mind is
what comes through beautifully in all his creations.
Traditional and very ‘Indian’ is his style and he makes
the most of it. Gypsies, deserts, antique use of fabrics,
textiles, and embroideries get beautifully woven into
each sari, lehenga or salwar kameez, which are his
areas of expertise. What gives his designs a twist is his
unique blend of colors and fabrics. One may never
think of putting 4 different shades in four different
sections of a sari with different designs, but when
Sabyasachi comes out with the final product, one gets
compelled to believe that it is possible and achievable.
Fusion of different patchwork designs on vibrant
colors is his trademark.
Case Law : Sabyasachi Calcutta Llp Vs Mr. Ankit Keyal Proprietor Asiana Couture and Ors
In a recent case of Sabyasachi Calcutta LLP (plaintiff) and Mr. Ankit Keyal proprietor Asiana Couture and ORS (defendants),
the Delhi High Court decides whether the defendants are using a design which is similar to the registered design of plaintiff.

Recently the High Court of Delhi at New Delhi, in the case filed by Plaintiff, passed an order regarding the infringement of
Plaintiff’s designs. The issue raised under the case was related to the Novelty and Piracy of the designs. Plaintiff is a Limited
Liability Partnership concern under the leadership of a well-known designer, Mr Sabyasachi Mukherjee, who claims to have a
significant presence in the Indian fashion industry and enjoys a global reputation.

Plaintiff claims that the defendants are using a design similar to the registered designs of Plaintiff to constitute piracy within the
meaning of Section 22 of the Designs Act, 2000. According to Section 22 (Piracy of Registered Design) of the Act, during the
existence of copyright in any design, it shall not be lawful for any person.

The hallmark of her eponymous label, House of


Masaba, is her signature design language, which
exudes a playful and experimental aura, defying
stereotypes and transcending conventions, by
blending innovative silhouettes with effortless
sophistication.
Masaba took to her Instagram handle yesterday,
writing a three-page long open letter to the
plagiarism accusation by ‘Diet Sabya’. Calling her
brand as ‘ABSOLUTELY ORIGINAL’, she gave a kick
reply saying, “I read a quote a couple of mornings
back on social media that said, ‘Everyone is a judge
on twitter until proven guilty.” This is probably the
truest statement of our times, so here are my
thoughts. The 12 prints you see on Masaba by
Nykaa packaging are all original house of Masaba
prints. Some dating back to 2009 that some of you
may remember. From then until now, which marks
10 years of my label- we have never been called
out because the work we have done is
ABSOLUTELY ORIGINAL. We started working on the
beauty line with NYKAA in 2017. Print is the DNA of
the brand & every product we do must reflect the
DNA. The same DNA that has made the brand
unique”.

was accused of copying the packaging
design of Sephora’s ‘Lip Stories’ collection
by an anonymous Instagram account called
‘Diet Sabya’, recently. Just a few days back,
‘Diet Sabya’ shared a post on their
Instagram page taking a dig at Masaba
Gupta’s recent collaboration with ‘Nykaa’.
