CHAPTER-VII

A STUDY ON GRANTING OF BAIL BY SESSIONS


COURT AND ADDITIONAL DISTRICT COURTS IN
GUNTUR, A.P, INDIA

This chapter deals with study on granting bails by Sessions Court,

i.e., Principal District Court in Guntur and Additional District, i.e.,

Additional District Court in Guntur for three successive years from 2007

to 2009. This study is tabulated in 13 columns with each and every

information of the accused who applied for bail in those study period.

Six tables of both the above Courts for three years are drawn with

collected information of granting of bails to each individual accused.

Statistical Methods are applied to these six tables, to draw a final

conclusion that, generally on what factors the Courts in Guntur will grant

bail to the accused. Here, factor means whether actually economical

status influences (or) Caste of the accused influences (or) Residence of

the accused if he belongs to town (or) village (or) city influences (or) any

other factor influences in granting bails to the accused.

The Empirical study proposed in this research investigation is

undertaken by confining the data source from Principal District Court of

Guntur District and the I Additional District Court out of the eleven

Additional District courts of the Guntur District. Thus the sampling

frame restricted to two out of the eleven data sources, basing on about

20% of the available sources. This is purely a deterministric choice

focusing the District Headquarters.

The two courts choosen for data source are completely

innumerated for the latest three years namely, 2007, 2008 and 2009. All

the Bail applications for each of these three years from the two choosen

courts are thoroughly studied and the data collected are tabulated in a 13

column tables as follows:

1) Serial Number.

2) Criminal Misllaneous petition Number.

\ 3) Name of the accused.

4) Nature of offence (or) offence changed.

5) Occupation of accused.

6) Bailable or Non-bailable offence.

7) Bail is sanctioned or not.

8) If Bail is not sanctioned reasons, if any.

Among the above is, quantative Analysis using descriptive as well

we have used formation of frequency counts as a descriptive tool, chi-

square test and proportionality tests as inferential tools. Frequency count

is a tabular form depicting the distribution of sample units (Bail

applicants) in various categories into which they can be divided. A chi-

square test is a tool that would be helpful to say whether two distinct

attributes or characteristics of an applicant are influencing each other to

get or not to get a bail.

Proportionality test is a tool that helps in knowing whether the

sanction of bail for applicants is evenly distributed or not with respect to

specific characteristics of the applicants. For example among applicants -

of non-bailable offence the proportion of those who are sanctioned bail

and those who are not sanctioned bail may be even or uneven. The extent

of unevenness is assessed by proportionality test.
