SECTION 151 CPC SEEKING CONDONATION OF DELAY IN
FILING WRITTEN STATEMENT:

MOST RESPECTFULLY SHOWETH:

1. That the present application has been filed on behalf of the


defendant for seeking condonation of delay in filing written
statement. The applicant prays to refer and reply upon the
contents of accompanying written statement at the time of hearing
the present application and the content of same have not been
repeated herein for the sake of convenience and brevity.

2. That in written statement the defendant has annexed few


documents those are pertaining to the old records, therefore, the
time has consumed to trace out the same and accordingly the
written statement could not be draft and prepared in time.

3. That the defendant has received complete set of plaint on


06.10.2023 accordingly the timeline as explained under Order VIII
Rule 1 of CPC ended on 04.11.2023. However, due to above stated
reason delay has occurred and the written statement could not be
placed on record within the prescribed time limit, hence there is a
delay of 46 days in filing the written statement before this Hon’ble
Court.

4. That delay in filing written statement which is not deliberate and


intentional owing to aforesaid facts and circumstances, the
defendant humbly prays before this Hon’ble Court to kindly
condone the delay of 46 days in filing written statement on record.

Prayer:
In light of the above it is therefore most respectfully prayed that
this Hon’ble court may graciously be pleased to:

A. Allow the present application;


B. Condone the 46 days delay in filing the written statement
and kindly take written statement on record.
C. Pass such other order/orders as are deemed fit and
proper in the facts and circumstances of the present case.
