Terms & Conditions

1) An application to purchase the Unit shall be deemed accepted by Saujana Permai Development Sdn
Bhd (“the Developer”) only upon payment to the Developer of a sum equivalent to ten percent (10%)
of the Purchase Price of the Unit hereby reserved (“the 1st 10% payment”) and upon issuance of the
Developer’s official receipt.
2) I/ We agree to abide by the terms of the Sale And Purchase Agreement and the Deed of Mutual
Covenants (“the Agreements”) of which I/we have read and examined upon execution of the same
at the Solicitor’s office.
3) I/We hereby undertake to:-
a) Execute the Agreements and all other relevant documents in respect of the Unit at the Solicitor’s
office mentioned herein within fourteen (14) days from the date of this form;
b) Settle the balance of the 1st 10% payment upon execution of the Agreements;
c) Settle the disbursements, stamp duties and other charges payable in respect of the Agreements
to the Solicitors upon execution of the Agreements;
d) Immediately apply for financing from one or all of the Developer’s panel end financiers to finance
the purchase of the Unit, in the event that I am/we are not a cash purchaser; and
e) Forward to the Developer a copy of the duly accepted letter of offer from any of the Developer’s
panel end financiers evidencing the approval and my/our acceptance of the loan within fourteen
(14) days from the date of this form.
4) In the event that I/we fail to comply with the terms stated at Paragraphs 3 (a) to (e) above, I/ we
hereby agree that the Developer has the absolute discretion to cancel this application, return my/our
cheque for any monies paid in respect of the Unit and forthwith be at liberty to sell the Unit to any
third party or otherwise deal with the Unit in any manner the Developer deems fit without further
notice/ reference to us and I/we shall have no claim whatsoever and howsoever against the
Developer and the Unit.
5) I/We have inspected the plans of the Unit and is/ are satisfied with the same. I/ We understand and
agree that the Developer reserves the right to amend the said plans and specifications as may be
required by the relevant authorities or architects and engineers.
6) I/We hereby agree that the terms and conditions herein shall be read and construed together with
the provisions of the Sale and Purchase Agreement and in the event of conflict, the provisions of the
Sale and Purchase Agreement shall prevail.
7) No oral communications shall form part of the terms and conditions herein.
8) This form is exclusive to me/ us and therefore transfer of booking/ sale of the Unit including all
monies paid in respect thereof is strictly prohibited and is not assignable nor transferrable in anyway
without the Developer’s consent. This form shall be binding on my/our personal representatives,
successors-in-titles and permitted assigns (as the case may apply) and the Developer’s successors-
in-title and assigns.
9) I/We hereby agree that the Developer and/or CDB Group may collect, obtain, store and process
my/our personal data that I/we provide in this form for the purpose of implementing the relevant
transaction(s) that I/we may have with the Developer and/or CDB Group and/or for receiving
updates, news, promotional and marketing mails or materials from the Developer and/or CDB Group,
I/ we hereby give consent to the Developer and/or CDB Group to:-
a) Store and process my/our personal data;
b) Disclose my/our personal data to the relevant governmental authorities or third parties where
required by law or necessary for the purpose(s) as stated in this form or for legal purposes.
10) In addition, my/our personal data may be shared or transferred to any company within CDB Group
which may involve sending my/our data outside Malaysia. For the purpose of updating or correcting
such data, I/we may at any time inform the Developer and/or CDB Group in writing of such updated
personal data.
11) For the avoidance of doubt, Personal Data includes all data defined within the Personal Data
Protection Act 2010 including all data that I/we had disclosed to the Developer and/or CDB Group
in this form.
