 An instrument for promoting more balanced urban-regional development, since
centralization was associated with the concentration of economic development in the
country’s capital, often derisively referred to as “imperial Manila”

SECTION 2. Declaration of Policy. (a) It is hereby declared the policy of the State that the
territorial and political subdivisions of the State shall enjoy genuine and meaningful local
autonomy to enable them to attain their fullest development as self-reliant communities
and make them more effective partners in the attainment of national goals.

DUAL NATURE OF LOCAL GOVERNMENT UNITS
SECTION 15. Political and Corporate Nature of Local Government Units.
Every local government unit created or recognized under this Code is a body politic and
corporate endowed with powers to be exercised by it in conformity with law. As such, it
shall exercise powers as a political subdivision of the national government and as a
corporate entity representing the inhabitants of its territory.

Implications:
1. Political Nature / Subdivision – partner in national development
To manage its territory on behalf of the National State (Section 3 (i))
2. Corporate Nature – self-reliant community
To promote the general welfare of its inhabitants (Section 16)

SECTION 3(i), RA7160
Local government units shall share with the National Government the responsibility in the
management and maintenance of ecological balance within their territorial jurisdiction,
subject to the provisions of this Code and national policies. – Co-Management

SECTION 16, RA7160. General Welfare.


Every local government unit shall exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient
and general welfare. Within their respective territorial jurisdictions, local government units
shall ensure and support, among other things, the preservation and enrichment of culture,
promote health and safety, enhance the right of the people to a balanced ecology,
encourage and support the development of appropriate and self-reliant scientific and
technological capabilities, improve public morals, enhance economic prosperity and social
justice, promote full employment among their residents, maintain peace and order, and
preserve the comfort and convenience of their inhabitants.

 According to a study conducted by DILG:
 Only 11 out of the 27 NGA-mandated plans can be recalled by LGUs
 Disaster Management Plan and the Solid Waste Management Plan were
considered most useful
 LPRAP and GAD were consistently mentioned as unnecessary
 38% of NGA-mandated plans have not been formulated
 Reasons:
 No sanctions anyway
 Plans were not considered necessary or beneficial
 Repetitive
 No focal person to steer the plan formulation process

What is it?
 Policy guide for the regulation of land uses within the LGU territory
 Skeletal-circulatory framework for the physical development of the territory
 Plan for the long-term management of the local territory

Who is responsible?
 The Sanggunian, on behalf of the national State, which is directed to
“…regulate the ownership, acquisition, use and disposition of property…”
(Article XIII, Sec. 1, Philippine Constitution)

Basic Contents of the CLUP


 The 4 policy areas: protection, production, settlements, and infrastructure
 The desired urban form
 The land use policy framework

 The creative combination of the built and the unbuilt environment
 The organizing concept for the proper location of space – using activities to
ensure sustainable environment for human habitat
 The “formworks” to shape the built environment and to preserve the
unbuilt one

 The chosen urban form is used as the organizing concept for the location of
various land uses and the formulation of location policies to be enforced
through the zoning ordinance and other regulatory measures
 4 policy areas are distributed in the different geographical sections of the
LGU
 Ensure horizontal integration of CLUPs and consistency of land use policies
among adjoining LGUs

 The plan with which the LGU promotes the general welfare of its
inhabitants in its capacity as a corporate body
 Can be regarded as the action plan of the CLUP
 Timeframe may vary from long-term to medium-term

 Infrastructure and Land Use Development Plan


 Lays down the physical base of the social and economic development of the area,
and provides infrastructure support requirements of other development sectors

 Environmental Management Plan
 Consolidates the environmental implications of all development proposals within the
LGU and provides mitigating and preventive measures for their anticipated impacts
 Maintaining the cleanliness of air, water, and land resources and rehabilitating

 Preservation/conservation and management of protected areas and wildlife

 Institutional Development Plan


 Focuses on strengthening the capability of the bureaucracy and elective officials to
manage effectively planned growth and change
 Fiscal administration
 Seeks to provide mechanism for the effective partnerships and linkages
