1. INTRODUCTION
1.1. SHORT TITLE

This Rulebook shall be referred to as the Competition Rules for the 1 st JNVU
MCMT Club Moot Court Competition, Jodhpur, 2004.

1.2. DEFINITIONS

1. Team: Team” means the team which is eligible to participate in the


competition under rule 2.2 and after completion of the registration
procedure.
2. “Team Code” refers to the code allocated to a participating
institution by the organisers after the completion of their final
registration.
3. Memorial” means the written submissions submitted by each team,
pursuant to these Rules.
4. "Court Bailiff" refers to the student volunteer who shall be entrusted
with duties such as maintenance of order in a courtroom during a
round and letting speakers know the time duration for which they
have spoken.
5. “Moot Proposition” means the official moot problem of the
competition, prepared by the administrator, supplemented,
corrected, or clarified thereof.

Oral Rounds

1.4. INTERPRETATION
The Organiser will have the exclusive authority to interpret the Rules in
the interest of fairness and equality. The interpretation placed upon these
Rules by the organisers shall be conclusive and the decision of the
organisers regarding the application of these Rules shall be final.

2. CLARIFICATION TO THE PROBLEMS


2.1. All requests for clarification to the problem must be submitted to the
organisers via the email mcmtclub@gmail.com with the subject
‘Clarification to the moot problems’
2.2. This is our email address which shall be provided by the organizers.
2.3. The teams may seek clarifications via e-mail.
2.4. The organisers reserve the right to provide clarifications only in relation
to the facts of the case and not related to the substantive arguments of the
case.
2.5. The clarifications, as and when issued, shall become a part of the
moot proposition.
3. GENERAL RULES
1. The JNVU MCMT Club Moot Court Competition 2.0 will be held on
09th-10th NOV. 2024 at Jai Narain Vyas University, Faculty of law ,
old campus, Jodhpur, (Raj.).
2. The Organizing Committee shall function as the point of contact, and
any changes in the rules of the competition shall be notified by email
to all participating teams.
3. The Competition shall be conducted in accordance with the rules
mentioned hereunder.
4. Participants are required to comply with the rules and procedures
prescribed herein and it will be presumed that all participants have
noticed of these rules..
3.1. ELIGIBILITY
1. Students enrolled in an undergraduate law course or its equivalent,
conducted by any recognized college/university/institution are eligible
to participate in the Competition.
2. Any college/ university/institution, whose students fulfil the eligibility
criteria or for exceptional circumstances have been deemed by the
organisers to be eligible for this Competition, shall be entitled to send
only ONE team to the Competition, subject to the completion of
registration formalities as detailed in the Invite' to the Competition.
3. If two registrations are received from the same College or Institution,
the Team which sends an email first to the Head/Dean of the
Institution/Moot Court Committee, authorizing them to participate on
behalf of the College or Institution shall be entitled to participate and
will be registered.
4. Students from different Colleges/Institutions are not allowed to form
an Inter-college team.
3.2. TEAM COMPOSITION
1. A team shall consist of three (3) members, i.e., two speakers and one
researcher.
2. The roles of the participants shall be the same throughout the
competition.
3. Teams of any other composition shall not be allowed to
participate in the event.
4. The registered team composition shall compulsorily remain the same
throughout the competition. However, in cases of unforeseeable
circumstances, changes in team composition may be allowed at the
discretion of the organisers , if justifiable reasons for the same are
provided before the submission of memorials.
5. Students pursuing the three or five-year courses of the LL.B. degree or
its equivalent in the academic year 2024-2025 from any recognized law
school/college/University in India/abroad are eligible to participate.
6. Any recognized law school/college/University shall be entitled to send
only 1 (one) team to the Competition.
7. Team of 3 members no other composition will be allowed.
3.3. REGISTRATION DETAILS
1. The teams should provisionally register themselves by filling out
the following google form by , 2024 at the latest.(only for
national moot)
2. Teams must complete their registrations by sending an email to
mcmtclub@gmail.com with subject ‘College name-
Registration’ by 25th oct, 2024 at the latest. The email should
include a scanned copy of duly filled registration form.
3. Successfully registered teams will be provided with a Team
Code via email.
4. After the allotment of the Team Code, the Team Code must be
mentioned in all future correspondence(s) with the organizers.
Teams are requested to not display or add the names or logos of
their Colleges, Universities, or Institutions anywhere in any
communications) addressed to the organisers or in
memorials/material submitted for the competition. Non-adherence
to the stipulated rules will attract severe penalties or
disqualification.
5. The Registration Fee is INR 500/-- for the participating teams.
Payment procedure has been defined in the ‘Registration Form’
link.
3.4. SCOUTING
1. All research, writing and editing must solely be the product of team
members.
2. The advice from the coach/faculty must be limited to general advice on
the area of law concerned, the structure of arguments and general
commentary on the team's arguments. No advice whatsoever may be
taken from any member of another team or any coach/faculty advisor
of another team.
3. Research, writing and editing must solely be the product of team
members.
4. Teams shall not be allowed to observe the orals of another team unless
they have been officially knocked out of the competition. Scouting is
strictly prohibited. Scouting by any team shall entail instant
disqualification.
5. Audio or video recording in any manner whatsoever, by participants in
the oral rounds, is strictly prohibited. Any act of audio or video
recording during oral rounds shall lead to immediate disqualification
of the team.

4. ACCOMODATION DETAILS (only for national moot)


4.1. Accommodation shall be provided to the teams who opt for an
accommodation, by the Organisers from the evening of 25 th to the
morning of 29th. Teams who intend to arrive prior to or leave after the
specified dates are required to inform the Organizing Committee in
advance.
4.2. Food and transportation to and from the venue shall be provided to all the
teams for the aforementioned duration.
4.3. Teams should send their travel plan, as and when asked by the Organizing
Committee, once the Payment Receipt has been submitted and the
registration is completed.
4.4. Availing of Accommodation is at the option of participants and the Fee
of accommodation is INR 4,500/- for 3 days including food and transport.
The Payment procedure for accommodation is same as the competition
procedure as described in the separate link ‘Registration Form’.
5. COMPETITION FORMAT
5.1. The Competition will be structured as per the following format:
a. Preliminary Rounds
b. Quarter Final Rounds
c. Semi Final Rounds
d. Final Round

5.2. LANGUAGE OF THE COMPETITION


The official medium of exchange for written and oral pleadings in the
competition shall be English.
5.3. DRESS CODE
● For Males - Western Formals (White formal shirt with black formal pants
and a black blazer
With black tie)
● For Females - Western Formals (White formal shirt with black formal
pants and a black blazer). Indian Formals (White Kurta with Black Pants
and Black Blazer).
6. MEMORIAL
1. Each team must prepare the petitioner/applicant and respondent
memorial
2. The memorial must be e-mailed in MS Word (‘.doc’ or‘.docx’) format
and in PDF format.
3. The soft copies of the memorial must be emailed to
mcmtclub@gmail.com before [dates]
4. The soft copies should be attached to mails under the subject
“Memorials for team (team code)”
5. The file name of soft copies of the memorial must contain only the
team codes assigned during registration and the side being represented
(applicant or respondent) [for ex. T10- P or T10-R]
6. Hard copy must be identical to the soft copy. Violation of this rule may
lead to disqualification
7. 2 hard copies representing each side must be submitted to the
organisers at the time of registration on [dates]
8. Petitioner memorials are required to have a Blue cover and Respondent
memorials are required to have a Red cover.
9. The memorials shall not contain any form of identification apart from
the team code or any such identification or mark, symbol, etc. which
has the effect of identifying the team.
10. The maximum plagiarism limit permitted for the entire memorial shall
not exceed 10%. Notwithstanding the plagiarism % for the entire
memorial, any substantial similarity in the content of memorials (in part
or wholly) from any source or authority shall also be considered
plagiarism.
6.1. MEMORIAL FORMAT
1. Each memorial must contain the following
● Cover page
● Table of contents
● List of abbreviations
● Index of authorities
● Statement of jurisdiction
● Statement of facts (not exceeding 2 pages)
● Issues to be considered
● Summary of arguments
● Written arguments
● Prayer (not exceeding 1 page)
2. Cover page
The cover page must only contain the following
● The team code
● The name and place of the forum
● Relevant legal provisions under which it is filed
● Name of parties and their status
● Memorial filed in behalf of…..
3. The Memorial shall be typed on A4 size page in Font type: Times New
Roman
⮚ Font size: 14
⮚ 1.5 - line spacing &
⮚ 1-inch margin on each side.
⮚ For citation Blue Book 20th edition must be followed.
6.2. MEMORIAL EVALUATION
Memoranda shall be evaluated on the following criteria:
a) Application and Appreciation of Facts: 20 Marks
b) Identification, Structuring and Presentation of Issues: 20 Marks
c) Application of Legal Principles, Authorities and Precedents: 20
Marks
d) Ingenuity and Logical Reasoning: 20 Marks
e) Grammar, Style and Clarity: 10 Marks

6.3. Exchange of memorials


1. There shall be an exchange of memorials between the
respective opposing teams, in accordance with the fixtures as
determined by a draw of lots, prior to all the rounds of the
Competition.
2. The teams are prohibited from making any copies of the
exchanged memorials.

7. ORAL SUBMISSIONS
1. Each team must have 2 speakers to make oral submissions the
speaker making pleadings will remain the same throughout the
competition.
2. Only one speaker may be permitted for rebuttal which cannot be
longer than 5 minutes
3. If the applicant/petitioner waives rebuttals the respondent’s sur-
rebuttal will be automatically waived.
4. The time split between the speakers must be communicated to the
bailiff prior to the commencement of each round. The speakers
cannot be changed in different rounds of the competition.
5. The speakers in no manner shall disclose the identities of
themselves or the institution they represent during the course of
their oral submissions
6. In the event of no appearance of the team for the oral submission
exceeding 10 minutes. The other team would be allowed to make
their submissions ex-parte
7. Teams can pass on compendium of the sources they cite in their
memoranda if so requested by the judges
8. Use of any electronic device ,other than the one being used to
present the submissions, is prohibited
9. The timekeeper will keep track of time during each round and
indicate the remaining time to the bench and teams at ‘half time’, ‘5
minutes’, ‘2 minutes’ and when the time allotted has elapsed.
10. Teams are requested to pay heed to the time provided. Please note
that only the bench has the authority to award additional time if it is
considered that questions have taken considerable time off the
pleadings, or if substantial submission(s) of the speaker are pending
to be heard.
11. In the circumstances of a tie in evaluation or memorial and speaker
scores
12. The teams are required to communicate their respective time split
to the court master prior to the commencement of a round.
7.1. EVALUATION OF THE ORAL SUBMISSIONS
The evaluation for the oral submissions would be done on
the following criteria:
1. Persuasiveness, Articulation & confidence: 20
2. Application of Legal Principles and Usage of Authorities: 20
3. Knowledge and Marshalling of Facts: 20
4. Advocacy skills, courtesy and demeanour: 15
5. Ingenuity & Response to Questions: 10
6. Court Etiquette, Presentation Style and Time Management: 10
7. Effective rebuttals :5
8. Advocacy skills, courtesy and demeanour: 15
7.2. Preliminary Rounds
1. Each team will have the opportunity to argue from both the sides.
2. The fixtures for the Preliminary Rounds shall be determined by
draw of lots.(to be checked)
3. For the Preliminary Rounds, the winner of each such round shall be
determined on the basis of the criteria of evaluation of the memorial
scores and the speaker scores.
4. Time limit for the oral submissions shall be thirty 15 minutes for
each team. This shall include the submissions of both the speakers
from the team and the time reserved for rebuttal/sur-rebuttal.
5. Only 1 speaker from each team shall be permitted to rebut/sur-rebut,
as the case may be, subject to a maximum time limit of 5 minutes.
7.3. Quarter finals
1. The 8 highest ranked teams from the Preliminary Rounds shall
proceed to the Quarter Final Rounds, as determined by the Rules
above. These teams shall each argue only once for the side allotted
by a draw of lots.
2. Time limit for the oral submissions shall be 35(30+5) minutes for
each team. This shall include the submissions of both the speakers
from the team and the time reserved for rebuttal/sur-rebuttal.
3. Only 1 speaker from each team shall be permitted to rebut, as the
case may be, subject to a maximum time limit of 5 minutes.
4. Time extensions may be given to each team at the discretion of the
Judges shalll be upto 2 minutes.
5. Judges shall endeavour to ensure that both teams get an opportunity
to speak for the same amount of time.
7.4. Semi finals
1. Top 4 teams shall proceed to the Semi Final Rounds, as determined
by the Rules above, and each shall argue only once for the side
allotted by a draw of lots
2. Time limit for the oral submissions shall be forty-seven (40+7)
minutes for each team. This shall include the submissions of both
the speakers from the team and the time reserved for rebuttal.
3. No speaker can speak for more than 25 minutes for his/her
individual oral submissions.
4. No team shall be allowed more than 7 minutes for rebuttal
7.5. Final Round
1. The top 2 teams shall proceed to the Final Round, as determined by
the Rules above, and each shall argue only once for the side allotted
by a draw of lots.
2. Time limit for the oral submissions shall be forty-seven (40+7)
minutes for each team.
3. This shall include the submissions of both the speakers from the
team and the time reserved for rebuttal.
4. . No speaker can speak for more than 25 minutes for his/her
individual oral submissions.
5. No team shall be allowed more than seven (7) minutes for rebuttal.
6. Time extensions may be given to each team at the discretion of the
Judges shall not exceed for more than 3-5 minutes.
7. The Judges shall endeavour to ensure that both teams get an
opportunity to speak for the same amount of time.
8. RESEARCHERS TEST
8.1. Only the Researcher, as indicated in the team registration form, shall take
the researcher test. The test shall be limited to general understanding of
law and to the moot proposition.
8.2. The researcher exam will comprise of 25multiple choice questions each
containing 2 marks with negative marking of 0.50
8.3. In the event of tie, researcher’s ranks will be determined first by who has
answered more questions correctly; if still tie persists rank will be decided
by who has attempted more questions.
