This Rulebook shall be referred to as the Competition Rules for the 1 st JNVU
MCMT Club Moot Court Competition, Jodhpur, 2004.

Oral Rounds
1.4. INTERPRETATION
The Organiser will have the exclusive authority to interpret the Rules in
the interest of fairness and equality. The interpretation placed upon these
Rules by the organisers shall be conclusive and the decision of the
organisers regarding the application of these Rules shall be final.
Penalties

7. ORAL SUBMISSIONS
1. Each team must have 2 speakers to make oral submissions the
speaker making pleadings will remain the same throughout the
competition.
2. Only one speaker may be permitted for rebuttal which cannot be
longer than 5 minutes
3. If the applicant/petitioner waives rebuttals the respondent’s sur-
rebuttal will be automatically waived.
4. The time split between the speakers must be communicated to the
bailiff prior to the commencement of each round. The speakers
cannot be changed in different rounds of the competition.
5. The speakers in no manner shall disclose the identities of
themselves or the institution they represent during the course of
their oral submissions
6. In the event of no appearance of the team for the oral submission
exceeding 10 minutes. The other team would be allowed to make
their submissions ex-parte
7. Teams can pass on compendium of the sources they cite in their
memoranda if so requested by the judges
8. Use of any electronic device ,other than the one being used to
present the submissions, is prohibited
9. The timekeeper will keep track of time during each round and
indicate the remaining time to the bench and teams at ‘half time’, ‘5
minutes’, ‘2 minutes’ and when the time allotted has elapsed.
10. Teams are requested to pay heed to the time provided. Please note
that only the bench has the authority to award additional time if it is
considered that questions have taken considerable time off the
pleadings, or if substantial submission(s) of the speaker are pending
to be heard.
11. In the circumstances of a tie in evaluation or memorial and speaker
scores
12. The teams are required to communicate their respective time split
to the court master prior to the commencement of a round.
7.1. EVALUATION OF THE ORAL SUBMISSIONS
The evaluation for the oral submissions would be done on
the following criteria:
1. Persuasiveness, Articulation & confidence: 20
2. Application of Legal Principles and Usage of Authorities: 20
3. Knowledge and Marshalling of Facts: 20
4. Advocacy skills, courtesy and demeanour: 15
5. Ingenuity & Response to Questions: 10
6. Court Etiquette, Presentation Style and Time Management: 10
7. Effective rebuttals :5
8. Advocacy skills, courtesy and demeanour: 15
7.2. Preliminary Rounds
1. Each team will have the opportunity to argue from both the sides.
2. The fixtures for the Preliminary Rounds shall be determined by
draw of lots.(to be checked)
3. For the Preliminary Rounds, the winner of each such round shall be
determined on the basis of the criteria of evaluation of the memorial
scores and the speaker scores.
4. Time limit for the oral submissions shall be thirty 15 minutes for
each team. This shall include the submissions of both the speakers
from the team and the time reserved for rebuttal/sur-rebuttal.
5. Only 1 speaker from each team shall be permitted to rebut/sur-rebut,
as the case may be, subject to a maximum time limit of 5 minutes.
7.3. Quarter finals
1. The 8 highest ranked teams from the Preliminary Rounds shall
proceed to the Quarter Final Rounds, as determined by the Rules
above. These teams shall each argue only once for the side allotted
by a draw of lots.
2. Time limit for the oral submissions shall be 35(30+5) minutes for
each team. This shall include the submissions of both the speakers
from the team and the time reserved for rebuttal/sur-rebuttal.
3. Only 1 speaker from each team shall be permitted to rebut, as the
case may be, subject to a maximum time limit of 5 minutes.
4. Time extensions may be given to each team at the discretion of the
Judges shalll be upto 2 minutes.
5. Judges shall endeavour to ensure that both teams get an opportunity
to speak for the same amount of time.
7.4. Semi finals
1. Top 4 teams shall proceed to the Semi Final Rounds, as determined
by the Rules above, and each shall argue only once for the side
allotted by a draw of lots
2. Time limit for the oral submissions shall be forty-seven (40+7)
minutes for each team. This shall include the submissions of both
the speakers from the team and the time reserved for rebuttal.
3. No speaker can speak for more than 25 minutes for his/her
individual oral submissions.
4. No team shall be allowed more than 7 minutes for rebuttal
7.5. Final Round
1. The top 2 teams shall proceed to the Final Round, as determined by
the Rules above, and each shall argue only once for the side allotted
by a draw of lots.
2. Time limit for the oral submissions shall be forty-seven (40+7)
minutes for each team.
3. This shall include the submissions of both the speakers from the
team and the time reserved for rebuttal.
4. . No speaker can speak for more than 25 minutes for his/her
individual oral submissions.
5. No team shall be allowed more than seven (7) minutes for rebuttal.
6. Time extensions may be given to each team at the discretion of the
Judges shall not exceed for more than 3-5 minutes.
7. The Judges shall endeavour to ensure that both teams get an
opportunity to speak for the same amount of time.
8. RESEARCHERS TEST
8.1. Only the Researcher, as indicated in the team registration form, shall take
the researcher test. The test shall be limited to general understanding of
law and to the moot proposition.
8.2. The researcher exam will comprise of 25multiple choice questions each
containing 2 marks with negative marking of 0.50
8.3. In the event of tie, researcher’s ranks will be determined first by who has
answered more questions correctly; if still tie persists rank will be decided
by who has attempted more questions.
