Ang Republic Act 9344 as amended by RA 10630 usa ka balaod nga naghatag ug
proteksyon ug nagpromote sa ilang mga katungod. Kini usa malangkobon nga
balaod alang sa batang adunay problema sa balaod or CHILDREN IN CONFLICT
WITH THE LAW (CICL) ug mga batang posiblang magkaproblema sa balaod tungod
sa nagkalain-laing hinungdan or CHILD AT RISK (CAR).

Isip amahan sa atong barangay dako ang akong pagtuo nga angayan protektahan
ug e-promote ang mga katungod sa mga kabataan tungod kay sila man ang atong
umaabut. Sila ang sumusunod nga mga lederes. Ang gipahigayon nga 2 days
Orientation-Writeshop kabahin sa Comprehensive Local Juvenile Intervention
Program (CLJIP) dako kaayo ug natabang aron masabtan ang ka importante sa
balaod nga RA9344 as amended by RA 10630 ug mas natabangan aron mamugna
ang Local Juvenile Intervention Program ning atong Barangay. Kini usa ka action
plan alang sa mga kabataan nga naghatag og pagtagad sa mga kabataan nga

among suporta sa paghimo, pag-implement ug pagtan-aw o pagmonitor sa
implementasyon sa CLJIP ug monitor labi na sa mga kabataan og ako manghinaut
nga ang mga ginikanan usab mohatag og insakto nga papasunod/disiplina sa ilang
kabataan aron dili makahimo ug mga sala-od ngadto sa atong katilingban.

Ang kahiusahan ug pagtinabangay mao ang susi sa kalampusan niining maong

I-INTRODUCTION

The Barangay Council for the Protection of Children key BCPC members
composed of Barangay Chairman, Barangay Secretary, Day Care Worker and
School Principal with the School Teacher fortunately attended the 2-day
Comprehensive Local Juvenile Intervention Program (CLJIP) Orientation-
Write-shop last April 11-12, 2018. It was conducted to purposely analyze the
situation of children in the barangay particularly the children in Conflict with
the Law (CICL) and the Children at Risk (CAR). The Situational Analysis will
then become the basis in crafting the 5 year CLJIP. This document is a product
of this write-shop.

This document describes the situation of the CICL and the CAR in Barangay
Libertad. It identifies underlying causes of CAR and CICL. It also enumerates
the reasons why these children were pushed to break the laws and eventually
become CICL using the CAUSALITY ANALYSIS TOOL that uses the 3 levels
of analysis: DEMAND SIDE, SUPPLY SIDE AND ENABLING
ENVIRONMENT. The demand side analysis refers to the underlying causes or
the determining factors that directing affecting the family that surrounds the
child; the Supply Side analysis refers to the determining factors within the
community that entice the children to become CAR/CICL while the enabling
environment refers to the implementation/enforcement of the child related laws;
local ordinances affecting minors, allocation of budget for children programs
and the functionality of structures like BCPC that have concerns on children.

This document was purposively drafted for the members of the BCPC and other
stakeholders to develop and carry out plans and programs for CAR and CICL in
the Barangay. It will also be utilized to strategically utilize funds in accordance
to the needs for children’s program that promotes and protects their rights to
fully develop children capabilities, skills, knowledge and attitude.

This Situational Analysis focused on the issues and concerns surrounding


children in conflict with the Law (CICL) and Children at Risk (CAR) covering 3
Puroks based on available data and based on the focus group discussion
among key members of the BCPC.

II- METHODOLOGY

Using the causality analysis tool was of great contribution in coming up with
the data and information on Children at Risk and children in Conflict with the
Law. Other relative information on children was also gathered thru the data
from Barangay Secretary, Barangay Nutrition Scholar, Day Care Workers and
data from School. The focused Group Discussion done during the CLJIP
Orientation-Write-shop among key BCPC members (Barangay Chairperson,
Secretary, Day Care Worker, School Principal/School Teacher) last September
27-28, 2017 was also an avenue that the committee come up with a clear
manifestations and determining factors of CAR and CICL in barangay Libertad.
III-BRIEF PROFILE OF THE BARANGAY

Barangay Libertad was created in September 1942; it has a total land area of
296 hectares with 102.14 hectares land area cultivated.

The total population as of latest data is 2,193. It comprises of 417 households


of which 151Hh are engaged in farming and 266Hh are non- farming livelihood
activities. The number of Children
ages 18 years old and below is 911;
and as of school year 2017, the
number of School children from
grade 1-VI is 360; while total Number
of Day Care Children as of 2017 is 42.

This Barangay Libertad was


named “DOSE-DOSE” or “twelve-twelve “ which means equal
distribution of land with dimension of twelve (12) hectares for each family
who were first settlers.

The first settlers of this place who owned 12 hectares each were named
as follows: Hilario Cabahug, Eyog Cabahug, Zacarias (Alan)
Cabatingan, Arsua, Anselmo Romanillos, Lagare, Mayol, Bontia,
Bontilao, Zanoria, Sino, Pepito, dela Cerna, Arabis, Romarate, Oporto,
Medel, Perilla, Ceniza, Colina, Sergio Mascual, among others. The
barangay has total land area of 369.5900 hectares before; but as years
passed by Barangay San Jose was created as well as Barangay
Maguikay of which some of the lot area was shared to these nearby
created barangay thus the remaining total land areas of Libertad is
292.000 hectares.

After the WORLD WAR II in the year 1946, ALEJANDRO CENIZA was
appointed by President Manual L. Quezon as first Mayor in Municipality
of Aurora it was then that “TENYENTE DEL BARRIO” was also elected
through “VIVA VOCE” or voting by raising of the hands of the
constituents of which the first “TENYENTE DEL BARRIO” elected
through VIVA VOCE was SERGIO RAMOS MASCUAL. During his time,
WORLD WAR II ended, the name “DOSE-DOSE” was changed to
“LIBERTAD” which means LIBERTY or FREEEDOM. FREEING

From the year 1946-1968, SERGIO RAMOS MASCUAL served around


22 years as tenyente del barrio of Libertad. The struggle in accessing
basic services long years ago was experienced by the constituents of
this barangay to name some: the absence of Infrastructures; absence of
basic services such as water for drinking, washing, bathing, for cooking
etc.; thus people need to get water and washed their clothes at “KA-
ODON” located in barangay Maguikay, where spring water was
abundant but people from Libertad have to walk around 2kilometers to
reach the source by foot. Other constituents went to “Cuatro-Cuatro”
where deep well is located named “KA SEGUNDO MASCUAL”, the
father of Sergio Mascual with a distance of 3kilometers to be reached by
foot and the other source of water was at “KIMPA” located at the lot of
Gaudencio Arabis with distance of around 1kiometer.

Because of that difficulty, Tenyente del Barrio Sergio Mascual with his
council agreed to create a “DEEP-WELL” thru bayanihan. In 1950, deep-
well with 10meters below the ground was established. In the year 1965,
Sergio Mascual asked for assistance from the province and was
provided two (2) “PUSO ARTISANO” dug well of which 1 was
established in Purok Sta. Cruz and the other 1 was in Purok Sto. Nino.

In the year 1960, Sergio Mascual requested for the construction of


School Building to the School Superintendent and he donated 1 lot
measured more than half hectares. The construction of grade-I to grade
VI building was made possible through BAYANIHAN SYSTEM.

MORE Leaders came after him and improvements are started to be visible in
the barangays.

There are organizations organized in the barangay such as RIC WOMEN’S


ORGANIZATION, FARMERS ORGANIZATION, SENIOR CITIZENS ORGANIZATION
and the DEATH AID ORGANIZATION.

The common agricultural products of Barangay Libertad are the
following: Coconut, Banana, Corn, and Cassava. Fruits such as: Manga,
Rambotan, Lanzones, Mangosteen, Durian among others. Different
Flowers and vegetables are also evident in this barangay.

Common Tribes live in the barangay: Visayan/Cebuano, Boholano,


Sequihidnon, Subanen and Muslim,

Purok _____________________. Most of the CICL cases are robbery, theft and drug related

problem. Cases of Children at Risk are as follows: teenage pregnancy, gambling, teenage
drug surrenderees, child abuse, children that are product of violence, young smokers, drop
outs, cyber addicts and identified malnourished.

Most of CICLs are at the age of 15; Mostly of the identified CICL are boys .They are involve in
the robbery, theft and drug related case. There are however a number of girls in CAR cases
of which they experienced the teenage pregnancy.

B. ANALYSIS OF THE MAJOR CAUSES OF CICL AND CAR

Causality Analysis was used during the 2-day orientation-write-shop as a tool to understand
deeper the situation of children in Barangay Libertad and it also explains the underlying
causes of the situation. The 3 levels: demand side, supply side and enabling environment of
analysis precisely identify the factors that cause a social problem.
It is vital to accurately address the issues particularly root causes that push children to
become CICL and to prevent the CAR from becoming CICL.

DEMAND SIDE

The 7 cases of Children in Conflict with the Law and 29 Children at Risk in Libertad occur due
to the various reasons such as on issues of the MANAGEMENT OF THE PARENTS to
their children, Broken family, parent’s lack of time for family bonding due to work/business,
lack of communication, vices of parents, peer influence, curiosity, lack of spiritual guidance,
abandonment, low family income,

Libertad has also products of professional parents who are employed either in government,
non-government or engaged in business. Unfortunately, they have lack time for family
bonding; family interactions and communication with children are not given prime
importance;

Children lack the Parental guidance due to the parent’s vices like gambling, drinking hard
liquor. Some children resulted to malnutrition as well due to parents not able to prepare
nutritious food, lack of knowledge on the importance of nutritious food, low income,

Most of the families with CAR and CICL are often from the marginalized and disadvantaged
sectors with large family size and from broken families;

With lack of role models children are prone to give in to peer pressure, becoming school
drop-outs and into delinquency.

SUPPLY SIDE

Barangay Council for the Protection of Children is the legal body created to
address issues and concerns for children but unfortunately BCPC of Barangay
Libertad needs to be reactivated.

BCPC does not fully understand the RA9344 as amended of which vital
functions and responsibilities are stipulated; the DILG circular on the
functionality of BCPC needs to be reviewed by the committee;

BCPC members are not oriented and trained on the Barangay Protocol in
Managing CAR and CICL as well as the Diversion and Intervention Program;

Children/Youth are not organized and Sangguniang Kabataan not capacitated in


Children/Youth Organizing thus they are unproductive and prone to be
influenced by bad company.

VAWC Desk not yet organized

Values Formation Activities not active and Parish Youth Apostolate (PYA) needs to be
reactivated;

ENABLING ENVIRONMENT SIDE

Comprehensive Local Juvenile Intervention Program is just recently introduced of which it is


important for a comprehensive program for Children since this CLJIP will stipulate the
necessary Programs, Plans And Activities (PPAs) in addressing different issues concerning
children: CICL and CAR and the necessary PPAs to capacitate the BCPC and other the Duty
Bearers in Barangay Libertad;

The Barangay is aware on the allocation of 1%budget or more for children’s program but
unfortunately not fully aware if it is really addressing the needs of CAR and CICL;

Barangay is not aware on the importance of the DATABASE for children particularly CAR
and CICL as it is a mandate per RA9344as amended. BCPC is also poor in
recording/documentation

V-CONCLUSION AND RECOMMENDATIONS

A. CONCLUSION

Barangay Libertad has 7 cases of CICL 29 cases of CAR in 2016 up to 3 rd quarter of 2017.
Though it is small in number but it refers to CHILDREN who have the full right to survival,
development, participation and protection. Though cases are little to count but it should be
given attention in order to prevent other children to become CAR/CICL. BCPC should adhere
to execute programs, plans and activities for children and the duty bearers as mandated by the
Law to prevent CICL from re-offending and the CAR from committing an offense or of
becoming a victim.

The CICL cases occurs in the Barangay are the following theft, robbery and RA 9165 or drug
related cases and the common CAR Cases are Teenage Pregnancy, Identified Malnourished
school children, child labor, gambling, teenage drug surrenderees and cyber addicts.

BCPC is not aware on the many provisions in the RA 9344 such as the development of CICL,
the utilization of 1%IRA to address children’s concerns and the diversion and intervention
program.

With the identified situation of CAR and CICL in the barangay along its underlying causes
using the causality analysis tool, the BCPC will then be guided on the steps to be done and
the 1% budget allocation will be aligned in accordance to the needs and priority to be
addressed. This Situational Analysis will be the basis in crafting the Comprehensive Local
Juvenile Intervention Program in Barangay Libertad. It will be the guide in the works of the
BCPC and the duty bearers.

B. RECOMMENDATIONS

In order to respond to the causes of the problem surrounding CAR and CICL,
BCPC of Libertad recommends some programs, plans and activities to be
undertaken as follows:

DEMAND SIDE

 For the Municipal Links/Parent Leaders/Day Care Worker to strengthen the


implementation of Parent Effectiveness Service (PES), Family Development
Session (FDS), ERPAT, to build skills of parents and care-givers particularly
parents of CICL and CAR
 For Teachers to incorporate in their session the positive child rearing and
positive discipline
 For the Teachers to call attention of parent who are found CAR and CICL
 For the BNS to implement nutrition programs for children
 For the DCC for implement early childhood care and development program
 For the Religious Leaders to undertake Values Formation Activities for
Children
 For the School to continuously create and avenue to develop Knowledge,
Attitude, Skills and Values (KAVS) of school children;
 For the BCPC to support reactivation of youth/children’s association/ PYAs to
develop KAVS of children and to prevent them from becoming CICL;

 For BCPC to fund capacity building programs barangay leaders in
handling CICL and CAR Cases as well as Diversion and Intervention
Program;
 For Barangay to regularly conduct BCPC Meetings (Bi-Monthly as
mandated per DILG Circular) to address children’s issues and
concerns
 For the BCPC to undergo training on CAR and CICL Management
using the DILG Circular issued re: Barangay Protocol in Handling CAR
and CICL
 For the Teachers/SK/Youth Groups to implements activities that will develop
the skills and talents of the young people and increase level of participation.
 FOR THE Barangay Council to organize the VAWC Desk

ENABLING ENVIRONMENT

 For the LGUs allocate 1% from IRA for children programs


 BCPC to ensure functionality of BCPC by giving refresher on their
duties and functions

 For For MCPC to conduct intensive monitoring in the


implementation of the LGUs CLJIP

 For the BCPC to allocate funds for implementation of programs for


children

I. INTRODUCTION:

The Republic Act 9344 as amended by Republic Act 10630 mandated the Local
Government Unit to develop the 3-5 years Local Juvenile Intervention Program (CLJIP).
It is with this mandate that Barangay Libertad is developing this document. This CLJIP is

giving primary importance to our CHILDREN. It will be a comprehensive document that
comprises programs for children of which 1% budget from IRA shall be allocated as
mandated by the Law.

This CLJIP will help Children At Risk (CAR) from preventing to become Children in
Conflict with the Law (CICL) and will assist the CICLs to be reintegrated to their own
communities and families and will help them averting to re-offending through the
strengthening of the Barangay Council for the Protection of Children.

The development of this Comprehensive Juvenile Intervention Program is an effort to


address the needs of the young people to protect and promote their rights.

II. ASSESSMENT OF THE BARANGAY SITUATION OF CHILDREN


(CICL/CAR)

Based on the issued Guidelines in the Development of CLJIP which was issued by DILG, the
first step to develop the document is to conduct deeper analysis on the situation of children in
the barangay; thus the Causality Analysis was conducted to analyze the human situation and
as it explained WHY a situation occurred. It explored meticulously the factors that caused a
social problem at different levels: demand side, supply side and enabling environment. It
seriously addressed the goal of reducing or eliminating the cases of CICL in the barangay.

As a result of causality Analysis there are identified 29 common cases of CAR such as
gambling, teenage pregnancy, teenage drug surrenderees and cyber addicts, and 7 common
cases of CICL as follows robbery, theft. Data based on 2016 up to 3rd quarter of 2017.

III. PROPOSED BARANGAY INTERVENTIONS (GOALS AND EXPECTED


RESULTS)

By the end of 2022, the 36 cases of children in conflict with the law shall be reduced by
75%; Children at Risk (CAR) will be prevented from committing crimes and Children in
Conflict with the Law (CICL) will be rehabilitated, reintegrated within their families and
communities and shall be prevented from re-committing crimes. It could be achieved through
the delivery of expected results as follows:

OUTCOME 1. Increased awareness of parents in positive child rearing/positive


discipline. This will be done thru the conduct of Family Development Session of which
Municipal Links of DSWD shall include in their session topics on positive child rearing and
positive discipline. The Parent Leaders, Day Care Workers or Teachers may also facilitate the
Family Development Session. The BHW or Health Center’s worker shall have a target of
session per year for mother’s class of which same topic shall be integrated. School Head shall
ensure that PTA meeting conducted with session for parent’s positive discipline. BCPC
should also ensure Barangay assembly with session on positive discipline. And the Day Care
Teacher, Teacher, Religious leader will conduct session for parents with CAR and CICL as
identified.

OUTCOME 2. Children made aware of their rights and responsibilities (that they
prevented from becoming CICL). This will be implemented through the school; the school

principal shall direct and monitor the implementation that Values Education conducted
should have integration child's rights and responsibilities. The Values formation session shall
also conducted by religious leader to the young. It will be an effort to reactivate the young’s
involvement in the church activities. Religious leader with the child/youth leaders will
implement an monitor this activities and will give report to the BCPC.

OUTPUT 3. CICL/CAR (parents or children) availed of SKILLS TRAINING. This will


be implemented by the BCPC. BCPC shall identify the CAR and CICL (children and
Parents). They shall do the assessment for possible training for children or parents of which
main goal is to assist these families earning income to prevent their children to become
CAR/CICL. There shall be assigned BCPC members to do close monitoring for the success
of this intervention.

OUTCOME 4. Functional Barangay Committees manifested thru functional


implementation of children's program. Functionality of committees is very vital for the full
implementation of the CLJIP. BCPC shall be reactivated; a regular conduct of meeting will
be done bi-monthly as per required based on DILG guidelines. BCPC shall be trained on RA
9344 as amended. Chairperson will invite personnel from DILG to train the BCPC members
on the Act and other important laws and guidelines that BCPC should be doing like the
diversion/intervention program. The chairperson shall also ensure that this CLJIP will be
reviewed annually for possible updating and revision; this CLJIP will be integrated in the
Annual Investment Plan (AIP). CLJIP will be implemented, monitored and evaluated by the
BCPC. It is also very important the BCPC shall be able to establish data on Children.

OUTCOME 5. Other BCPC Activities Implemented.

Other programs will be implemented by the BCPC such as: Implementation of Medical
/Financial Assistance, Supplemental feeding for malnourish children, Nutrition Program
Parents responsibility for heir children's health and on proper nutrition facilitated, Daycare
Services Program (DCS), like establishment of Playground for DCC enhanced/established,
Children's congress Tsikiting Day During "Adlaw sa Aurora ", Registration of Unregistered
children to Local Ciivil Registrar, Advocacy on fertility awareness and reproductive health
among adolescent individual conducted.

IV. PROGRAM COMPONENTS

With the 7 cases of CICL and 29 cases CAR in 2016 to 3 rd quarter of 2017, Barangay Council
for the Protection of Children must have to come up with plans and programs in order to
reduce if not eliminate the CICL cases and to prevent more children of become CAR/CICL in

BCPC has identified OUTCOMES that will be achieved by implementing programs for
children:

1. Increased awareness of parents in positive child rearing/positive discipline.

2. Children made aware of their rights and responsibilities (that they prevented from
becoming CICL).

3. CICL/CAR (parents or children) availed of SKILLS TRAINING.

PRIMARY INTERVENTION
1. Early Childhood Care and Development (ECCD)
2. Establishment of Youth Resource Center in every municipality
3. Institutionalization of activities on children and youth e.g., congress, camps, summit,
fora
4. Health services/education
5. Accessing of the children to Child and Youth Organization like SK, PYA and church-
based organizations, Barangay Children Associations, Children and Youth Federations
and the National Anti-Poverty Commission – Children and Youth Sector

SECONDARY INTERVENTION
1. Organization of youth e.g. Pag-Asa Youth Association and Faith-based organization,
Children Association/ Federations
2. Psychosocial intervention such as group/ individual session by the social worker to
children at risk
3. Involvement of former CICL in self-help groups as advocates
4. Family therapy to the family of the children at risk
5. Organization of watch groups
6. Development of foster families
7. Establishment of Special Drug Education Center Family Drug Abuse Prevention
Program
8. Institutionalization of Birth Registration in Barangays

TERTIARY INTERVENTION
1. Release on recognizance

These programs will be implemented thru the concerted efforts of the barangay Council for
the Protection of children and thru the functional committees and other existing organization
in the Barangay.

V. INSTITUTIONAL AND COORDINATION MECHANISMS FOR PLAN
IMPLEMENTATION

The BCPC members will be at the forefront in the implementation of the various intervention
activities to achieve the goal of reducing the cases of CAR and CICL.

The lead person/unit/committee in a specific activity together with the BCPC shall make sure
of its smooth and efficient conduct. Activities conducted should be documented for further
monitoring on the efforts done by the BCPC in implementing the children’s program.

V. MONITORING, REPORTING AND EVALUATION OF PLAN


IMPLEMENTATION

Monitoring and evaluation is necessary in the program cycle. It will ensure the effective
implementation of each intervention. M and E is an integral part of this plan and this is to
measure where the plan is heading; if it is within its set direction, what needs to be enhanced
or if there is a need of re-planning.

During the BCPC Meeting all BCPC members shall prepare their report on the activities
implemented relative to children in relation to the implementation of CLIP. There should be
data banking for children. Documentation Report from each assigned person/committees
shall be submitted to the secretariat for reference and future submission to DILG and for
reference during BCPC evaluation. All undertaking relative to children program should be
reported and documented. All BCPC reports shall be submitted to Municipal Council for the
Protection of Children for their reference.
