Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring
arbitrary, high handed action of the respondent No.2 in issuing impugned Charge Memo

circumstances in its true perspective and proceeding with, while pending Criminal Case in
Cr.No.05/ACB-WRL12022. dt.23.09.2022, ACB Warangal Range, Warangal, which is
pending before the Court of Hon'ble Special Judge for SPE and ACB Cases, Hyderabad
(transferred to Warangal). as illegal. arbitrary, unjust, violative of the Principle of Natural
Justice and violative of Article 14 and 16, l9(lXg), 2l of the Constitution of India and
contrary to ratio laid down by the Hon'ble Supreme Courl in Capt. M Paul Anthony Vs.
Bharat Gold Mines Ltd. And another reported in (1999) 3 SCC 679 and consequently direct
the Respondent No.2 not to proceed with the Departmental Enquiry pursuance to Charge
Memo CCLA's file No. CCLA'S REI'-.NO.VSII(2y91712022, dt.16.08.2023. by framing
Articles of Charges and consequential proceedings in CCLA's Progs. No. VSIi(2)191712022,
dt.07.08.2024 till conclusion of Criminal Case in Cr.No.05/ACB-WRL12022, dt.23.09.2022,

The petition coming on for hearing, upon perusing the Petition and the afficlavit filed
in support thereof and upcn hearing the arguments of Sri. M P KASHYAP Advocate for the
Petitioner, GP FOR SERVICES I for the Respondents, the Court made the following.
ORDER:
Notice before admission.
Learned Government Pleader for Services-I takes notice on behalf of the
respondents, rvaives furttrer notice and seeks time to file counter-affidavit.
Registry is directr:d not to take out notice to the respondents in view of above
walver.
Having regard to the submissions made by learned counsel for the petitioner and
in view of l:rw laid down by the Hon'ble Supreme Court in the case of Captain, M.Paul
Anthony v. Bhorat Goltl tWines Limited oncl another [(1999) 3 SCC 6711, there shall be
interim stay of all further proceedings in the Departmental Enquiry initiated ag:ainst the
petitioner pursuant to thr: Charge Memo issued against him vide CCLA's Ref.No.VSII
by respondent No.2, till conclusion of the (lriminal
