DECLARATION OF OWN WORK

I Bayanda Mkhize, Student Number 2021360884, hereby declare that this is my own and
original work.
On the 7th of October 2024, I attended job-shadowing at the Computer Labs. The aim of
the job-shadowing was to give us a practical tutorial on what we will be doing as legal
practitioners.

Firstly we had to sign the register and log into the computer. We had to download the job
shadowing slides and two other documents, notices and pleading. The first task the
lecturer gave us was to draft a letter of demand. After drafting the letter of demand we
went through action proceedings. Shortly after that we took a quiz with 10 questions. After
writing the quiz, we had to write draft combined summons, particulars of claim and a plea.
When we were done we went home.

I expected the job shadowing to be a legal practitioner showing us their day to day tasks.
I was expecting to see videos and presentations.

After the workshop, my expectations did change because the show shadowing was not
what I expected. Instead of the presenter doing the work , we had to do the work.

My favourite task was drafting. I enjoyed drafting the letter of demand, combined
summons, particulars of claim and plea. Even after the lecturer had dismissed the class,
I stayed until I finished drafting because I could not stop myself. Drafting is really fun. It
kind of calmed down my anxiety.

My least favourite part of the job shadowing was definitely the quiz. I was not expecting it
so I kind of went blank. There were ten questions and for each question there was only a
few seconds to answer. It was multiple choice questions. Luckily I knew the work, so the
quiz was not that difficult. The issue started when I saw the clock running. I would put the
answer but forget to save it. When the computer calculated the marks I got 3/10 because
there were no answers submitted for the other questions. This made me sad because I
believe in academic validation so much that a small set back makes me feel bad about
myself and my capabilities. I was even so embarrassed to show my marks to the student
that was sitting next to me.
I am excited to pursue a career in real estate law because it combines my passion for
property and business with my interest in law. Throughout my academic and professional
journey, I have been drawn to the dynamic and fast-paced nature of the real estate
industry. I am fascinated by the complexities of property transactions, land use
regulations, and the intricate relationships between buyers, sellers, landlords, and
tenants. Working in real estate law will allow me to apply my analytical and problem-
solving skills to navigate complex legal issues, advocate for clients’ interests, and facilitate
successful transactions. Ultimately, I aim to make a meaningful impact in people’s lives
by ensuring their property rights are protected and their business goals are achieved. I'm
drawn to conveyancing because it combines technical expertise with meaningful client
interaction. Guiding clients through significant financial transactions, navigating complex
title issues, and facilitating smooth settlements appeals to me. I thrive in fast-paced
environments where attention to detail and effective communication are crucial. My goal
is to provide personalized service, build lasting relationships, and ensure clients achieve
their property goals, securing their ownership and property rights. I am therefore going to
do my articles, conveyancing, and get a qualification on real estate. A big thank you to the
guest lecturer that gave a lecture on conveyancing on the 3rd of October. The issues I
might face when trying to obtain a job is that the industry is based on connections. The
more connections you have in conveyancing, the higher your success rate. This means
that I will be competing with people who have been in the legal field and have more
connections, while I am still fresh from University.

Clinical legal education is important for legal scholars because it shows them the legal
sector beyond textbooks, journals and articles. Scholars get to have practical education
on the legal field. In the article The role of clinical legal education in developing legal
professionals by M.A. du Plessis (2021), the author wrote that through clinical legal
education, students can gain a profound understanding of ethics beyond theoretical
concepts. By working with real clients in a sheltered clinical setting, students will develop
a deeper appreciation for legal professionalism, values, and ethics. This hands-on
experience allows students to reflect on the impact of their decisions on clients,
considering diverse perspectives and the broader legal profession. In this environment,
students can explore their professional identity, contemplate their role as a future legal
practitioner, and cultivate essential skills for a responsible and ethical career.

In conclusion , the job-shadowing played a huge role in my life because it made me realise
just how much I love the law and all things related to it. Drafting in class felt so good, I
can only imagine how it will feel when I start getting paid for it and helping people with
their legal issues.
GUEST LECTURERS

11 August 2024 (Monday)

On this day we had Mme Mamello Makhetha, the director of OMM Attorneys. She
delivered a lecturer on the Administrator Of Estates. She touched on what happens with
the estate of a person when they pass away and also told us that attorneys get 3.5% of
the estate the administrate.

30 September 2024 (Monday)

The lecture on SCA Matters was delivered by Mr Duncan Murray, the director of Lovius
Blocks Attorneys. This gave us an overview of the jurisdiction of the Supreme Court of
Appeal and how it generally works.

03 October 2024 (Tuesday)

Conveyancing Matters is the title of the guest lecturer that was delivered by Uyleta Nel-
Marais, who is also from Lovius Blocks Attorneys. I learnt about the duties of a
conveyancer and the daily tasks of a conveyancer.

Dear Mr. Wannabe Singer URGENT

LETTER OF DEMAND

1. We refer to you the above matter and confirm that we are acting on the instructions of our
client, Miss Good Heart, hereby referred to as “or client”.

2. It is our client’s instructions that on the 12th of March 2020, she entered into a loan agreement
with yourself whereby you loaned you R20 000 to purchase a karaoke machine.

3. Our client further instructs that you agreed to pay back the loan as soon as you start earning
money from karaoke performances or when you obtain a job.

4. We hold instructions that on the 20th of January 2023 you obtained a job as an accountant.
It has been almost 20 months since you have obtained a job, and you still haven’t paid the loan
back to my client; which is a breach of the contract between you and my client.

5. We hereby demand that you with immediate effect, repay the R20 000 loan to our client.

6. We hereby advise you to inform us immediately that you have complied within 7 days of
receiving this letter. Failure to do so will result in further legal steps being taken against you:
6.1 We will issue summons claiming the R20 000 plus interest thereon including legal fees
6.2 We will claim all damages suffered by our client as a result of your breach.

and documents in the action;

as aforesaid, file with the Registrar or Clerk of the Court and serve upon the plaintiff or
plaintiff’s attorney a plea, exception, notice to strike out, with or without a counter-claim.

judgment as claimed may be given against him/her without further notice to him/her or
if, having failed and served such notice, defendant fails to plead, except, make
application to strike out or counter-claim, judgment may be given against him or her.

The plaintiff is Mrs Glitz Glam, a teacher residing at 23 Heimstra Avenue, Brandwag, Bloemfontein.

The defendant is Drink And Eats Pub, an eatery business located in 19 Second Avenue, Willows,
Bloemfontein.

On the 12th of March 2020 at 23h10, the plaintiff suffered an injury while visiting Drink And Eat Pub.
As an Employee Of Drink And Eat Pub was walking up the stairs while pushing a trolley, he/she
collided with Mrs Glitz Glam.

The plaintiff sustained a 13cm deep laceration over her left knee, with further injury to her knee joint.

The injuries sustained by the Plaintiff was due to the negligence of the Defendant’s employees in one
or more of the following respects:

5.1 The Defendant’s employees failed to act with reasonable care when pulled the trolley up the
stairs.

5.2 The Defendant’s employees failed to keep a proper lookout for clients utilising the stairs.

5.3 The stairs at the entrance of Defendant’s establishment is unsafe for public use.
