2. PREFACE
PROCESS DESCRIPTION: Sand from storage area is to be fed into the Sand Storage bin using Loaders. The sand is then
transferred to a Vibrating screen using a mechanical conveyor at a controlled rate. The sand is screened to 2 fractions
and fed into the hopper of the bucket elevator and transferred to the sand storage silos using a diverter valve. Fly
ash, Minerals like Dolomite, Gypsum or Cement is conveyed to the silos using truck mounted blowers or a separate
pneumatic blower included in this offer.
All raw materials are to be screened, dry and free flowing prior to conveying to respective silos using a combination
of mechanical and pneumatic conveyors as mentioned in the offer. Performance Additives as per formulations are
charged manually into a hopper located on the mixer platform using a hoist and charged into the mixer. All batched
materials are then discharged into respective weigh batch hoppers and dosed into the mixer. On completion of mixing
the finished product is discharged into a bin and conveyed to the hopper of the Packing machine. The complete plant
is operated by a PLC/SCADA management system with minimum of dust.
NOTE: For sand which is not washed, dried and screened a separate section is provided for this on request
DESIGN HIGHLIGHTS: We are pleased to submit our quotation for the design, supply, installation and commissioning
of a Production Facility capable of producing the below listed products at a rate of 6 MT/HR
The quality requirements presume our process control system specifically designed for Dry Material Mixing plants.
The control enables complete plant control from raw material acceptance through to finish product bagging.
The plant specified is in accordance with a concept, which has been proven in the numerous plants that we have built
during the past and using core components, and equipment that have been tested and proven in rugged industrial
conditions. This combination gives the highest plant availability, reliability and safety together with continuous high
product quality.
Spare place can be considered to allow direct bulk loading or material distribution to a second bagging plant from
the mixer in a further step of extension. Moreover, a mobile bin can also be connected to the mixer hopper. This
will also allow a direct discharge of mixed batches.
The raw material feeding of fillers and cement has been equipped with separated screws for each silo. Thus, wear
and tear will be minimised. Bulk big and small-bag discharge units can be provided for unloading bags into the
pneumatic blower for quick and economical transfer of raw materials.
Separate filter units on all silos, weighers etc. minimize spillage, because most of the material will be fed back
into the appropriate bulk silo, weigher batch etc.
Basically, the plant has been designed for automated production. Nevertheless, manual additions have been
considered for specific products, too. The mixer discharge into the mixer hoppers, i.e. pre-hopper for bagging
machine and intermediate hopper for filling of mobile bins are provided.

CAPACITY: 15 TPH FROM HOPPER TO SILO (6 TO 7 BAGS PER MIN) & 25 TO 30 TPH FROM BULKER TO SILO
Process: Cement and Minerals like Lime, Calcium Carbonate, Calcite, and Dolomite from Jumbo bags or
small bags are to be emptied and dumped into a bin manually. The material from the bin is directed into
the blower for conveying the mineral to the respective silos.
CEMENT AND MINERAL BLOWER
The System we address is designed to convey Cement and Minerals with an estimated bulk density of 0.9
to 1.2 gm/cc. The Cement /Minerals will be conveyed from manual cement feeding hopper to the Cement
Silo Conveying Capacity 15 Tons/hour. Conveying distance horizontal 20 M, Vertical 20 M. Nos. of 90-degree
long radius Bends 3 Nos. Service Duty Continuous. The system is mounted on a sturdy base frame having
anti-vibration pads.
System has an option to convey cement / Fly Ash /Minerals from Bulker as well as bags (which have
integrated piping for Aeration & discharge pipe) to Silo. The apex. Conveying rate will be 25 to 30 T/Hr.
The discharge line of blower will have 2 Nos. isolation valves. By closing the valve meant for manual feeding
hopper & opening the bulker line valve, the Blower will enable unloading from Bulker to Silo.
Scope of Supply:

THE MATERIAL FROM THE STORAGE SILOS ARE CHARGED INTO 2 WEIGH BATCH HOPPERS AND FED INTO THE MIXER.
THE WEIGH BATCH HOPPERS AUTOMATICALLY DISCHARGES THE REQUIRED QUANTITY OF MATERIAL INTO THE
MIXER AS PER RECIPE MANAGEMENT SYSTEM. THE TIME FOR EACH BATCH OF 840 KGS WILL BE APPROX 7-8 MINUTES
FOR POWDERS: Mainly for cement, Fly Ash, Gypsum, Dolomite, Lime etc. The
weigh batch hopper is of 0.6 m3 capacity fitted with 4 load cells, inlet flanges, vent
line, vibrator, electro pneumatic discharge valve 200 mm, level indicators and
inspection door. The hopper is located above the mixer and has the required input
ports and accessories. The hoppers are mounted on a sturdy frame structure free
from vibrations.

FOR SAND: Mainly for Cement, Fly Ash, Gypsum, Dolomite, Lime etc. The
weigh batch hopper is of 0.8 m3 capacity fitted with 4 load cells, inlet flanges,
vent line, vibrator, electro pneumatic discharge valve 250 mm, level
indicators and inspection door. The hopper is located above the mixer and
has the required input ports and accessories. The hoppers are mounted on a
sturdy frame structure free from vibrations.
ADDITIVE HOPPER: A hopper of 40 KGS capacity mounted on the mixer for charging of minor fillers and
additives like polymers, cellulose etc from bags. The hopper is to be charged manually. A pneumatic valve
of 125 mm is fitted at the bottom of the hopper and opens into the mixer. The valve is interconnected to
the PLC system. The material from the deck is to be manually dumped into the Hopper. The hopper is
connected to the dust extraction system for dust free manual additions. A small platform is included.
DRIVE: The mixer is driven by a 3ph, TEFC, 50Hz electrical motor coupled to a worm reduction gear box The
drive is mounted on a sturdy base frame.
The material from the mixer is automatically discharged into the discharge
bin at a predetermined time. The bin is of 0.8 m³ capacity and provided
with a pneumatic valve, level indicators, balance line, sample port,
discharge aids and inspection windows with proximity switches, return
vent line and a slide gate valve.

Material from the collection bin falls into the hopper of the product transfer elevator and is conveyed
to the hopper of the Double Spout Packing machine. The system is complete with the necessary
instrumentation, discharge aids and fittings to integrate the process with the automation system.

PLANT CONFIGURATION
PLC based control panel along with power panel for operation of Mortar plant having following features.
The system is designed so as to configure all the equipment, instruments and valves supplied by us for
proper weighing batching and formulating of raw materials from silos, weigh batch hoppers and mixer
PLC based software for control of Mortar plant has following features
1. Plant works in MANUAL mode without PLC (By passing PLC).
2. Formula setting for 450-850 Kgs of mix and actual quantities are to be derived based on the actual
quantity being produced.
3. Software is capable storing of mix designs to the capacity of hard disk.
4. Software is in position to make delivery ticket mentioning mix name, cycle start time and cycle
stop time.
5. Selective Discharge criteria for mixer gates (Auto Discharge / Manual Discharge).
6. Alarms occur for various faults (which is mentioned user manual).
7. Aggregate weight gets compensated in next aggregate in the same cycle.
Weight displayed in computer & weight indicator to be same.
8. All charging gates (Aggregate, cement etc.) openings are selective.
9. Auto in flight system for all batched RM.
10. Weighing Termination is possible.
11. Queuing / Scheduling of the mix formulas is possible (OPTIONAL).
12. Printer, Computer and UPS provided will be of HP/DELL

• Standard weights (Preferably of 20 Kgs) to the tune of at least80% of the full scale and sufficient labor
to handle the weights should be provided by you at site.
• Sufficient production should be ensured during commissioning so that your personnel are trained
properly and sufficiently.
• A period of minimum 8 -10 days should be ensured for commissioning.
• In case of any part being defective / damaged before, during or after commissioning (the material not
supplied by us) has to be provided by you. We shall not be liable for such defects.
• PLC make would be Schneider/Allen Bradley/Siemens.
A. PACKING MACHINE
Packing Machine with Single spout MODEL FE 01 E for weighing and filling
of dry mortar and free flowing powders in standard valve type bags (20-50
kg).
Machine will be complete in all respects, factory assembled and ready for
installation under a feed hopper. The Machine will include:
WORKING PRINCIPAL: Automatic Packing Machine with single Spout Model FE01E is designed for filling
and packing of valve type bags up to 250 bags / hr of 40kg. The machine is suitable for free-flowing dry
powders like cement, lime and other similar powders. with the help of one operator.
The operator places the bag on the spout and actuates the push button. The bag is automatically clamped
and the filling is assisted by an impeller type feeder which densifies the material and directs the material
towards the filling nozzle.
A two position pneumatically operated shutter valve is opened for coarse and fine feeding. The
Shutter valve changes its position upon completion of coarse feed. The product is weighed on the bag
holding assembly through load cells and electronic controller. The weight is displayed on the control panel
at any given time. Set points for coarse and fine feeding can be easily programmed. When the final weight
is achieved the bag clamp automatically releases the bag after a small delay. The machine is now ready for
the next cycle.

ACCURACY: After 5-7 fills, the machine’s electronic Indicator automatically adjusts itself to get an
accuracy of ± 150 grams for a 50 kg bag for an Average of 10 consecutive fills, provided the bag size is
uniform, with sufficient perforations (120cm 3/h) & proper valve size and relatively constant product
density. Adjusting phase will be of 5 weighting’s when stopped for more than 10 minutes.
2. Suspension frame with a filling spout mounted on Load cells complete with filling tube and guide chutes.
3. Filling assembly consisting of balanced carbon steel wear resistant EN 31 SERIES metal impeller blades
installed in steel housing complete with bearings, pulleys and V belts, air flushing system, driven by a 10 HP
motor complete with belt drive and protection guards.
4. Electrical Pneumatic Panel Box with controls for fine and coarse fill, weight indicator, on/ off switch, safety
cut out, relays, solenoid valves and controls, indicating lamps. Duly prewired and enclosed in a IP 54 steel
enclosure.
5. FRL, Pressure Regulators & Pressure Gauge.
6. Pneumatically controlled Slide Gate Valve, with 3 positions Air Cylinder.
7. Adjustable bag rest.
8. Solenoid Valves & fittings.
9. Bag holders with Air Cylinder/Spout.
10. Bag size 350-650mm L and 350-550 mm W.
11. De dusting hood provided above the filling nozzle.

SPECIFICATION PERFORMANCES
Scope of Supply: Air cooled system, Air Compressor Mounted on Horizontal Air Receiver complete with
V Belts, Motor pulley, Belt Gaurds, Pressure control switch, Pressure gauge, Safety valve, Drain and
service valve and FRL unit.
CAGE HOIST 1 MT
A cage hoist is provided for lifting material from floor level to the
height of the weigh batch and additive hopper platform. The
hoist is complete with beams and structural members made
from rolled steel sections and provided with reputed make
electrical mechanical hoist having a SWL of 1 MT. The hoist is
provided with a push button station complete with operating
cord and limit switches. The cage provided is of size 1.5 x 1.5 mtrs
with safety railing enclosure.

PLATFORM: A structural steel platform is provided for installing the mixer and weigh batch hopper. The
platform is provided with access ladders and railings. The platform is provided with foundation plates to be
fixed and grouted on a leveled concrete surface. The platform is painted with 2 coats of Primer and Epoxy
paint. All ducting, tubing and piping within battery limits will be included.
NOTE: The mixer is mounted on a sturdy framework at ground level. The collection bin is paced in a pit
of suitable size below the mixer. The discharge valve of the bin is connected to the hopper of the bucket
elevator and is controlled by a slide gate valve.
STEEL STRUCTURE FOR SILOS: Drawings for the silo and steel structure will be provided by us. Customer to
fabricate the same locally.

Supervision of Plant Startup. FE undertakes to supervise and assist in the plant startup and be ready for
production within 4 weeks from date of manpower and equipment mobilization at site. The charges for
providing start up assistance will be Rs.100,000 extra for a period of 15 days. Charges for delay beyond 4
weeks will be charged at Rs. 3500/ Per Person/ Per Day Extra. We will be deputing engineers in stages. Air
Ticket / lodging boarding / out of pocket expense and insurance of person is to be arranged by the client.
The start-up charges are to be paid in advance.
3rd Party inspection and certification: if required, charges will be extra. Any documents required for
importation or carrying out work at site are to be obtained by buyer.
Our engineers will be present during production of batches during which they will train your chemist.
All local permissions and contractual labor laws are to be arranged and complied by the buyer.
NOTE:
1. A Prerequisite E&C list will be provided 30 days prior to arrival of our engineer. Same is to be complied
with prior to his arrival.
2. FE will not be responsible for any 3rd party erecting or commissioning the plant without FE consent in
writing. Our Warrantee will stand cancelled if the same is carried out without our consent.
The Buyer is not entitled, without the supplier’s prior written consent, to use the Equipment or any part
thereof before the start-up and acceptance protocol has been signed. If the buyer nonetheless uses the
equipment prior, the supplier shall be entitled to sign the startup and acceptance protocol without the
supplier’s prior written consent, the supplier shall be relieved of any duties to conduct acceptance tests
and shall be entitled to sign the startup and acceptance protocol.
Our Engineer will stay on site for duration as specified in the order and T and C. Thereafter it will subject to
our confirmation and progress of work on site. Please note the engineer deputed will be a Project supervisor
to ensure work is being conducted as per design. You will need to employ a Project Manager and Site
Manager separately. The total period of stay of our engineer will be approx. 4-6 weeks from date of their
arrival. Thereafter it will be subject to our confirmation. Final Painting and Finishing of Plant is to be carried
out by client at site. Total time frame for above will be approx. 1 month depending on the scope of work
and site conditions.
Tool and Tackles (detailed list will be separately given in advance) like long-arm cranes, chain pulley blocks,
welding machines, gas-cutting set, cutting & grinding wheel sets and assortment of tools like set of
spanners, handheld drill machines etc. which may be generally required by our erector. Arrangement of
scaffolding work that may become as and when necessary, along with necessary forklifts and cranes. Client
to provide cranes & forklift as required. All materials required along with manpower is to be provided at
the time of Erection & Commissioning, we will not be held responsible for any delays and our charges will
be applicable from the date our technician leaves Bombay till he returns.

Civil Work: We will provide all foundation drawings relating to civil works for equipment supplied by us.
Balance civil design and drawings are to be prepared by the local civil contractor. The client is to employ a
qualified contractor understanding civil drawings to execute the work as per our drawings and comply with
local regulations.
Electrical: We will provide all wiring and circuit drawings for equipment supplied by us. Balance electrical
design and drawings are to be prepared by the local electrical contractor. The client is to employ a qualified
electrical contractor understanding electrical drawings to execute the work as per our drawings and able
to comply with local regulations. All earthling work will be in client’s scope.
Piping and Insulation: We will provide all P&IDs and insulation drawings for equipment supplied by us.
Balance design and Piping drawings are to be prepared by the local Piping contractor. The client is to employ
a qualified piping and insulation contractor understanding the drawings and able to comply with local
regulations.
Plant Structure: All the components / parts will be supplied by FE as mentioned in the offer and actual
erection & final required welding of structural parts at site will be done under supervision of FE engineer.
Final painting and touch up will be carried out at site by client.
The client will provide all labor skilled and unskilled.
Time Period: The plant is to be erected and commissioned within 3 months of all equipment reaching site.
FE will not be responsible for any damages, losses, missing parts or equipment for delays arising from
customer’s end. The charges for erection and commissioning will have to be renegotiated after 3 months.
Under special circumstances the Client and FE can renegotiate this clause by way of a undertaking provided
by the client. The supplier shall assign sufficient suitably qualified personnel to perform the services. The
supplier shall provide the buyer with all necessary documentation to show the buyer the manner in which
the equipment is to be installed. After completing its obligations above, the buyer shall invite the supplier’s
representatives to attend at the site to proceed with the installation by issuing a written notice no later
than 8 weeks after delivery. After delivery, the buyer shall take all other preparatory steps necessary to
ensure that the site conforms with the conditions necessary for installation of the equipment.
The buyer shall ensure that:
(a) The supplier’s personnel can start work in accordance with the agreed time schedule, provided that the
supplier’s personnel shall only be required to work during normal working hours;
(b) The buyer has, in the notice of installation, informed the supplier of all relevant safety regulations in
force at the site and that all necessary safety measures are taken before services are performed.
(c) The buyer has, in the notice of installation, informed the supplier of any changes in the laws, regulations
and rules in connection with the provision of the services in the jurisdiction of the site between the
placement of the order and the time that such services are to be performed.
(d) The buyer arranges for the supplier suitable and reasonable accommodation in the vicinity of the site
for the supplier’s personnel.
(e) The buyer makes available to the supplier’s personnel free of charge at the proper time on the site all
necessary cranes, lifting equipment and equipment for transport on the Site, tools, machinery, materials
and supplies (including fuel, oils, grease and other materials, utilities, gas, water, electricity, steam,
compressed air, heating, lighting, etc.), and the buyer’s measuring and testing instruments.

(f) the buyer makes available to the supplier free of charge offices on the site which shall be equipped with
telephone and internet connection
g) the buyer makes available to the supplier free of charge all necessary storage facilities to provide
protection against theft and/or deterioration of the equipment, any equipment or tools and the personal
effects of the supplier’s personnel; and
(h) The access routes to the site are suitable for the required transportation of the supplier’s personnel and
equipment.
(6) Upon the supplier’s request the buyer shall within reasonable time:
(a) Provide to the supplier relevant information on all laws, regulations and rules as may be applicable in
connection with the services in the jurisdiction where the services are to be performed.
(b) Make available to the supplier, free of charge, such labour and operators as may be reasonably required.
for the avoidance of doubt, the persons made available by the buyer under this clause shall provide their
own tools and the supplier shall not be liable for such labour provided by the buyer or for any acts or
omissions of the persons concerned.
(c) Give all necessary assistance required for the import and re-export of the supplier’s equipment and
tools, including assistance with customs formalities. such assistance shall be provided to the supplier free
of charge; and
(d) give all necessary assistance to ensure that the supplier’s personnel obtain, in good time, visa’s and any
official entry, exit or work permits, and tax certificates required in the buyer’s country, as well as access to
the site. such assistance shall be provided to the supplier free of charge.
(1) If the buyer anticipates that it may be unable to fulfil its obligations in a timely manner, the buyer shall
immediately notify the supplier in writing of such anticipated delay, stating the reason and the time when
the buyer can carry out its obligations (“notice of buyer’s delay”).
(2) Without prejudice to the supplier’s upon receipt of the notice of buyer’s delay, the supplier may (but
shall not be obliged to postpone the scheduled acceptance date to a new date to be decided by the supplier
(“extended acceptance date”).
(3) Regardless of whether the buyer issues a notice of buyer’s delay, if the buyer fails, neglects or refuses
to fulfil its obligations correctly and/or on time:
(a) The supplier may at his own discretion choose to carry out or employ a third party to carry out the
buyer’s obligations or otherwise take such measures as are appropriate under the circumstances.
(b) The supplier may suspend in whole or in part its performance of the contract. he shall forthwith notify
the buyer of such suspension.
(c) The buyer shall pay any part of the price for service which, but for the default, would have become due.
(d) The buyer shall reimburse the supplier for any costs not covered by the price for services which are
reasonably incurred by the Supplier.

9. FORCE MAJEURE: Delivery of equipment is subject to force majeure by which it means causes such as
war, invasion, and civil disobedience. Government order or restrictions, strikes, lockouts, riots, fires,
epidemics, sabotage, trade embargo, earthquake, flood, accident breakdown of labour raw material,
wagons, shipping space or any other acts of God causes whosoever beyond our reasonable control,
affecting us or our sub-contractors suppliers etc.
10. JURISDICTION/GOVERNING LAW/ARBITRATION: All contracts between client and vendor are deemed
to be entered at Bombay, India and are therefore subject to the jurisdiction of courts at Mumbai - India.
These conditions and any contracts which are formed by reference to these conditions, and all questions
concerning its constructions, performance, validity, and interpretation shall be governed by the laws of
India. The United Nations convention on contracts for the international sale of goods shall not apply. In the
event that a dispute or difference arises between the parties, such dispute or difference shall be referred
to arbitration in accordance with the arbitration rules of the Arbitration committee of India. The place of
arbitration shall be India. Any award by the arbitration tribunal shall be final and binding upon the parties.
11. WARRANTY: FRIGMAIRES shall guarantee all equipment manufactured and supplied by them against
defective materials and workmanship for a period of 18 Months from the date of dispatch or 12 Months
from a date of commissioning, whichever is earlier based on single shift operation. Defective items may be
replaced or repaired at our option after conducting a thorough study of the defects occurred within shortest
period at no extra cost to the buyer. Defects arising from transportation shall not be within preview of our
warranty clause.
This warranty is subject to the following:
i) Buyer operating plant/equipment as per operating instructions and procedures furnished by the Seller
ii) Buyer carrying out regular and preventive maintenance of equipment.

iii) Buyer not carrying out any modification or replacement without Seller’s approval in writing during
guarantee period.
iv) Seller shall not be responsible for replacement or repairs for normal wear and tear of component due
to operation.
v) Also, seller shall not be responsible for any consequential or indirect damages.
vi) All shipping, clearing and custom charges for damaged/replacement parts will be in client’s scope
vii) Replacement goods will be dispatched on FOB Basis.
Delivery of replacement goods will be within 1-4 weeks depending on type of replacement required and
availability.
12. SPECIFICATIONS & DESIGN ALTERATION: The information as regards specifications of equipment given
in the offer or in any of the seller’s publications, drawings, literature etc., is only intended to present a
general idea of the goods offered for sale. They are not binding on the seller in all minute details. The
specifications are subject to reasonable alternations without notice. The seller also reserves the right to
make changes in the design of components or materials which in the seller’s judgment are necessary or
which are necessitated by the non-availability of raw materials/components provided. Such changes are
not likely to affect the performance specifications materially. Special request for design alteration is to be
received and confirmed by seller well in advance of placing PO for commercial & delivery considerations.
The specified change in design on components are subject to availability. we reserved the rights with equal
or better alternative if necessary.
13. HANDING OVER: The Client is to provide a completion certificate within seven days from the date of
commissioning. In absence of this certificate FE will not attend to any customer complains. In case the buyer
is not able to supply adequate quantities of raw material and chemicals, performance of individual
equipment will be shown and the plant will be handed over to the buyer. The buyer is expected to put the
plant to commercial use only after settling all the dues of the seller and issuing a formal completion
certificate. The seller’s guarantee of the plant will be inoperative if the plant is put to use without formal
taking over.
14. ERRORS AND COMMISSIONS: The seller reserves the right to correct all typographical errors and
omissions and make engineering changes in the specifications where necessary and desirable with the
understanding that the quality and /or value of the equipment will not be adversely affected.
15. CANCELLATION: Orders once placed cannot be cancelled. In case of cancelation the advance and all
payments made will be forfeited. All loses incurred by FE due to order cancelation will be claimed from
client.
16. DELAYS: In case the client fails to take delivery or make payment once notified within 15 days, all
pending dues will be subject to interest, warehousing charges or any other charges incurred by the supplier
@3%/month. FE reserves the right to dispose the equipment to any alternate client and manufacture new
equipment/plant at the prevailing price. The supplier also has the rights to suspend performance of its
obligations under this contract.
17. INSPECTION: Goods to be inspected within a week of receiving inspection notice from the seller at the
premises
instructed by the seller. All third party inspections will be to client’s account. Extra tests, requests or
compliances required

by the 3rd party inspector will be on a chargeable basis. FE will not be liable for any delays caused by 3rd
party inspection agency. All raw materials required for FAT are to be supplied by the buyer. No running
trials can be provided in case of variation in voltage and frequency to meet buyers country specifications.
Once the goods have been tested by the inhouse testing of supplier or the buyers inspector the same have
to be lifted and paid withing 15 days unless otherwise agreed upon in writing. In case the buyer is unable
to be present for the inspection/acceptance test the seller will prepare a report for the same and forward
to the buyer.
18. PRE-STARTUP: The buyer is not entitled, without the supplier’s prior written consent, to use the
equipment or any part thereof before the start-up and acceptance protocol has been signed. If the buyer
nonetheless uses the equipment prior to the signing of the start-up and acceptance protocol without the
supplier’s prior written consent, the supplier shall be relieved of any duties to conduct acceptance tests
and shall be not responsible to any damage or non- performance.
19. SUB CONTRACTOR: FE reserves the right to subcontract any part or equipment mentioned in the offer.
The inspection and despatch for the same will be conducted at the sub-contractor’s site if required.
20. RISK & TITLE: The risk of damage to or loss of the equipment’s shall pass on to the buyer at the time of
delivery unless otherwise agreed upon in writing.
21. FORCE MAJEURE: (1) The supplier shall not be liable to the buyer or be deemed to be in breach of
contract by reason of any delay in performing or any failure to perform any of the supplier’s obligations if
the delay or failure was due to any cause beyond the supplier’s reasonable control (“Force Majeure”)
without prejudice to the generality of the foregoing the following shall be regarded as causes beyond the
supplier’s reasonable control:
(a) Act of God, explosion, flood, tempest, fire, or accident.
(b) War or threat of war, sabotage, insurrection, civil disturbance, or requisition.
(c) Acts, restrictions, regulations, byelaws, prohibitions, or measures of any kind on the part of any
governmental parliamentary or local authority
(d) Import or export regulation or embargoes.
(e) Strikes, lockouts or other industrial actions or trade disputes (whether involving employees of supplier
or of a third party)
(f) Difficulties in obtaining raw materials, labour, fuel, parts, or machinery.
(g) Power failure or breakdown in machinery
(2) If the duration of any period of force majeure exceeds 180 days, either party may terminate this
agreement by giving 14 days’ notice in writing to that effect to the other party. Parties are only entitled to
compensation.
(a) loss of profits, loss of use or anticipated savings or similar losses; (b) indirect or consequential damages
(even if such losses were reasonably foreseeable or it had been advised of the possibility of these being
incurred); regardless of whether such liability arises out of breach of contract or warranty, tort (including
negligence), product liability, indemnity, contribution, strict liability or any other legal theory whatsoever.

(3) Notwithstanding any other provision in these conditions, the supplier shall have no liability whatsoever
after the end of the warranty period.
Notwithstanding any other provision in these conditions and/or in the contract, the suppliers total
aggregate liability for any damages or compensatory payments for any cause whatsoever in relation to the
equipment’s and/or the services, regardless whether such liability arises out of contract, tort (including
negligence), product liability, indemnity, contribution, strict liability or any other legal theory whatsoever,
including those liabilities shall be limited to an amount equivalent to 10% of the price.

26. CONFIDENTIALITY
(1) Each Party undertakes that it and its directors, officers, employees, representatives, agents, contractors
or affiliates will fully respect the confidentiality of internal business affairs of the other Party. Each of the
Parties hereby undertakes to treat as confidential all information. obtained from the other Party or
communicated to the receiving party pursuant to the Contract or through discussions or negotiations prior
to the Contract being entered into or acquired in the performance of the Contract, and will not divulge such
information to any person except to persons mentioned above who have a need to know the certain
information, and will use such information solely in connection with performing its obligations under these
Conditions and/or the Contract and not for its own benefit or for the benefit of any third party.
(2) The confidentiality of information shall not extend to information:
(a) Which is rightfully in the possession prior to the commencement of the negotiations resulting into the
contract; or
(b) Which is already in the public domain or becomes so at a further date other than as a result of breach
of this Clause; or
(c) Which is communicated or disclosed to the receiving party by a third party lawfully in possession thereof
and entitled so to disclose it; or
(d) Which a party is required to disclose by any applicable law or by any order of a tribunal of competent
jurisdiction.
NOTE: 3rd Party inspection and certification: if required, charges will be extra. Form M to be provided by
client. FE will not be responsible for quality of finish for Equipment not lifted within 1 month of intimation.
Charges for painting and finishing will be extra if required.
