    Service Agreement

    This Service Agreement is made on this 10th day of Nov. 2024, between:

    M/s Bimlraj Outsourcing Pvt. Ltd., having its Corporate office at 117, 1 st floor, Vipul Trade Centre,
    Sector-48, Gurugram, Haryana -122018 , hereinafter referred to as the “Hirer,”

    And

    Sameer Earth Movers (GSTIN: 09KFSPK6901M2ZH), having its registered office at Vill. Kakarala,
    Sector-80, Phase-II, Noida, Nearby Ultratech, G.B Nagpur U.P., hereinafter referred to as the “Owner.”

    1. Equipment and Service Terms:


    The Owner agrees to provide the following equipment to the Hirer on a Service basis:
    • Tipper (Registration No. UP16ET3070): Service fee of INR 1,25,000/- per month.
     Tipper (Registration No. UP16ET7886): Service fee of INR 1,25,000/- per month.
    • JCB Excavator (Registration No. UP13BT9017): Service fee of INR 90,000/- per
    month.

    2. GST and Billing:


    An 18% GST will be charged separately on the total bill amount. The Hirer shall pay the Service fees
    and GST as per the invoice provided by the Owner.

    3. Payment Terms:
    Payments shall be made by the Hirer within 10 days from the receiving date of invoice.

    4. Duration and Termination:


    This agreement shall be valid for one year that is from 10/11/2024 to 10/01/2025 and may be renewed
    or terminated by mutual consent.

    5. Liability and Maintenance:


    The Owner is responsible for regular maintenance of the equipment. The Hirer agrees to use the
    equipment responsibly and is liable for any damages caused by misuse.

    6. Equipment Replacement:
    In case of any breakdown or malfunction of the equipment that hinders operation, the Owner agrees to
    provide a replacement or carry out necessary repairs within 24 hours. Failure to do so will result in a
    proportional deduction from the Service fee for the period the equipment remains non-operational.

    7. Termination for Non-Performance:

    If the Owner fails to provide the equipment as agreed or does not meet the quality and condition
    standards suitable for operation, the Hirer reserves the right to terminate the agreement with immediate
    effect. In such a case, any advance payments made for the Service period will be refunded by the
    Owner within 7 days of termination.
