LEAVE AND LICENCEE AGREEMENT

THIS LEAVE AND LICENCEE AGREEMENT made on this 1st


day of September,2022.

BETWEEN

SRI. Rabindra Nath Mondal, son of Late Sarat Chandra


Mondal, By faith Hindu, By Nationality- Indian, By Occupation-
Businessman, Residing at 298 Briji West, P.O- Garia, P.S- Patuli,

Kolkata-700084, hereinafter called and referred to as the “1
Party/ Licensor” of the ONE PART.
AND
SRI. Biku Kumar Singh, Son of Sanjay Singh, by faith – Hindu, By
Nationality – Indian, By Occupation – Student, residing at Vill-
Fatehpur, Palakiya, P.O- Sherghati, P.S- Sherghati, Gaya, Bihar, Pin-
8242211, herein after called and referred to as “2nd Party /
LICENSEE” of the OTHER PARTY.

AND WHEREAS the 2nd Party being in urgent need of accommodation


for him and his family within the vicinity of Kolkata and as such
approached to the 1st Party with a request to grant license for the
said residential flat in his favor for a period of 11(Eleven) months
with effect from 1st September,2022 to 1st August,2023 on the terms
and conditions hereinafter appearing.

Whereby it is agreed and declared by and between the parties here


to as follows: -
1. The 2nd Party will take on occupation of a Ground Floor 2BHK Flat
situated at 298 Briji West, P.O- Garia, P.S- Patuli, Kolkata-700084
for a period of eleven months effective from 1st September,2022
to 1st August,2023 for residential purpose only.
2. That the 1st Party shall allow the 2nd Party to possess, use and
enjoy quietly and peacefully the said residential Rooms during the
term of 11 months of occupancy. However, if required, the 2nd
Party will allow the 1st party/ his agent (s) to inspect the room to
ensure that the rooms are maintained in good order by the 2nd
Party without prior notice to him. The 2nd Party will maintain
peaceful relation with the 1st Party and neighbors.
i. The 2nd party shall pay to the 1st party for the said in respect
of the said flat for the licensee fee of Rs. 7,700/- only(seven
thousands and seven hundreds only) per month including
maintenance charge and excluding electricity bills. The unit
charges will be paid as per the demand of C.E.S.C. for
separate electric meter attached to the said flat along with 1
water pump meter charges and 1 house hold meter charges
and bound to pay the bill amount in time, to the 1st party
regularly. The 2nd party shall pay the licensee fee on or
before 10th of each month by cash in favor of 1st party.

ii. That on signing this agreement, the 2nd party shall pay an
amount of Rs. 7,700/- only (Seven Thousand and seven
hundred only) “security deposit”. This security deposit
amount shall be returned to the occupier without any
interest when the agreement will terminate provided no
damage is caused to the occupied/ used aforesaid rooms.

3. That the license shall be valid for a fixed period of 11 months


which as commenced on and from the 1st September,2022 to 1st
August,2023. The 2nd Party will not transfer, assign, sub-let or part
with possession of the said room or any portion thereof.
4. The 2nd party shall use and enjoy the said 2bhk Ground floor
residential rooms for the purpose of residence of their own (3
persons) by keeping in a neat and tidy condition without making
any material alteration or additional but shall not store any
contraband articles or shall not carry on any trade in the said
residential rooms. It is strictly mentioned here that the permission
for stay is granted only for only 3persons, however the second
parties relatives may come and stay with them for limited period
only.
5. The 2nd party will not claim tenancy in respect of the said
residential rooms at any relevant point of time as this Agreement
is specifically executed for a fixed period of Eleven months and
shall not be treated or construed as Tenancy or Lease.
6. That if any dispute arises in future shall be amicably settled in
and between the well-wishers of both the parties.
7. That the 2nd party shall make no charges, alterations, additions in
the existing structure of the said room without written permission
of the 1st party.
8. That the 2nd party shall have the right to terminate the
agreement by giving 30 days (full one month) notice.
9. The 1st party has also the right to terminate the agreement by
giving 30 days (full one month notice) to the 2nd party.
10. The 2nd party will not keep any material which may damage /
cause to damage the floors, walls/ ceiling of the room itself.
11. As the electrical wirings are concealed the 2nd party will not nail
the walls for their own safety.
12. The 2nd party will not carry on any type of activity or activities
which will be contrary to law of the land or are in anyway, illegal,
dangerous for the building or injurious or prejudicial to the health
of the inmates of the buildings or in the vicinity.
13. That in case of default on payment of license fee at the rate
stated herein above for more than one month or breach of any
terms of the agreement stated herein before and/or under this
agreement shall be terminated without any notice to the 2nd party.
14. That both the party shall strictly abide by the terms and
conditions mentioned in the foregoing paragraphs and on event of
death their legal heirs and successors shall strictly abide by the
same.
15. The 2nd party shall vacate the aforesaid residential rooms after
the date of expiry of the term as fixed and shall handover the
vacant possession to the 1st party in good condition,
simultaneously the 1st party shall refund security deposit only in
cash after deducting the arrears dues, damage charges if any
without any interest thereupon to the 2nd party.
16. That it is clearly agreed by the 2nd party that if any electrical
equipment like, switch, water tap etc. are required to repair/
exchange / replace, during the period of use, they shall solely bear
the amount what so ever is charged by the mechanic.
17. That the 2nd party will allows the 1st party and his new party to
inspect the rooms after giving notice to quit as per the terms of
notice stated above so that 1st party shall show the room to the
new party in the meantime. The 2nd party will be bound to clear
the said room at the time of leaving as he is receiving at the time
of taking possession.
18. That on expiry of the said licensee period, if the licensee fails to
or refuses to give vacant possession of the flat to the licensor the
licensee shall be liable to pay damage Rs. 500/- (Rupees five
hundred only) per day and by way of compensation (over and
above the regular payment of licensee fees, furniture and fixtures
charges etc) to the Licensor until recovery of full and vacant
possession thereof.

IN WITNESS WHEREOF the 1st party and the 2nd party have signed
this Agreement on the date and place aforementioned.
