Jamia Millia Islamia, an institution originally established at Aligarh in United Provinces,


India in 1920, became a Central University by an Act of the Indian Parliament in 1988. The

story of its growth from a small institution in pre-independence India to a Central University
located in New Delhi—offering integrated education from nursery to research in specialized
areas is a saga of dedication, perseverance and vision of people who worked against all
obstacles and saw it growing step by step.

The Faculty of Law, Jamia Millia Islamia was established in 1989. Over the past two decades,
it has made significant progress in terms of restructuring courses and syllabi, introducing new
courses, experimenting with innovative techniques of imparting legal education and
strengthening its clinical programs.

The Faculty of Law offers a range of undergraduate, postgraduate, and doctoral programs in
law. The undergraduate program is a five-year integrated LLB (Bachelor of Laws) program,
[replacing three-year LL.B. Course], from the academic session 2002-2003. Further, the
postgraduate programs include an LLM (Master of Laws) program and a Ph.D. in Law. The
students here have participated in Moot Courts, Client Counselling, literary and debating
activities and have won several laurels for the institution.

The Faculty of Law at JMI has a long history of producing highly skilled and competent legal
professionals who have made significant contributions to the legal field in India and abroad.
It is known for its excellent faculty, who are highly qualified and experienced in their
respective areas of expertise. The faculty members are engaged in a wide range of research
activities and regularly publish their work in leading national and international journals. They
also participate in various national and international conferences and seminars, to share their
research findings and insights with the legal community.

In addition to its rigorous academic program, the Faculty of Law at JMI also provides a range
of extracurricular activities and opportunities for its students to develop their skills and
knowledge outside the classroom. Overall, the Faculty of Law at Jamia Millia Islamia is a
topranked institution that is ranked 7th in the NIRF ranking 2022 and is highly regarded for its
excellent academic program and research output, as well as its commitment to producing
highly skilled and competent legal professionals.

The 6th Intra-Faculty Moot Court Competition, 2024, is being organized by the Moot Court
Association of the Faculty of Law, Jamia Millia Islamia. The Association is a student-run body
that administers and promotes excellence in Mooting and Legal Research activities at Jamia. The
Association has been consistent in organizing events related to National and International Moot
Court Competitions, Legal Research and Publication, Avenues in Higher Education and many
more that play key role in honing the skills of a law student.
Moot court is the first step to experience the application and functioning of law. In simple terms,
Mooting can be described as the experience we get in our classes when we listen to the facts of a
case law from the teacher and we try to predict the decision of that case by applying the
appropriate law. But there are some additional things that are taken into consideration in a Moot
Court. The students are required to think from both the sides and have to substantiate their stance
with the application of both the facts and laws that convince the Judges to pass a favourable
decision. When the budding lawyers stand before the bench, they present their arguments and
defend them by answering questions being raised by the judges in between. The assistant of
watchdog of law tries its best to help them to apply the right law to the presented case. Going
through the process of mooting, students end up by acquiring: cognitive skills, research, writing,
and, confident attitude in public speaking.
In addition to the practical skills that students can gain from mooting, the experience is also
valuable for building confidence and developing a sense of professionalism. Participating in
moots helps the students to understand the expectations that will be placed on them as
professionals and gives them an opportunity to practice meeting those expectations. Overall,
mooting is an important aspect of a law school education. It provides students with the
opportunity to gain practical skills, build confidence, and develop a sense of professionalism.
These skills will be invaluable to them as they begin their careers as lawyers.

RULES FOR THE COMPETITION

1. Title, Applicability & Power of The Organizers

a) These rules may be called “Rules for 6th Intra-Faculty Moot Court Competition (2024).”

b) These rules apply to the 6th Intra-Faculty Moot Court Competition (2024) organized by
the Moot Court Association, Faculty of Law, JMI.
c) The Organizers reserve the absolute right to: alter, amend, and interpret these rules at any
point of time.

2. Structure of the Competition


The Competition consists of two levels: (a) Memorial Elimination Round and (b)
National Rounds.
a) Stage I: Memorial Selection Round: There will be a memorial elimination round
which will determine the teams selected for the Oral Rounds. The top 24 teams with the
highest memorial marks will proceed to the Stage II of the competition.
b) Stage II: Oral Rounds: The oral round shall consist of two Preliminary Rounds,
Quarter finals, Semi-finals and a Final round.

3. Eligibility Criteria

a) All bona fide students from 1st to 3rd year of the Faculty of Law, pursuing 5-year
B.A.LL.B. (Hons.) are eligible to participate in the competition.
b) Each team shall generally comprise of 3 participants including 2 Speakers and 1
Researcher. The team may also comprise of 2 participants, wherein both the members
shall act as Speakers and one of the two shall act as the Researcher also.
c) Combination of team may include students of Regular and Self Finance participating as
a team.
d) Combination of team may also include students across different batches.

4. Registration Procedure

a) All interested teams must fill out the registration form before the last date of registration
as mentioned in the “Timeline” section of the brochure.

b) Registration form must be filled out only once by any one of the team members.

c) The Registration Form shall be filled online by accessing the link provided herein:
https://forms.gle/GfKerMDq1SEc6s166.

d) Each team shall be allotted a Mentor, after successful registration by the concerned team.
Please note that teams are requested to complete the registration process at the earliest
so that mentors can be allotted as soon as possible. All the details of the Mentor shall be
shared with the team through an Email within 1-2 days of registration.

e) Once the Team Registration is completed, no further alterations shall be allowed, except
under exceptional circumstances at the discretion of the Moot Court Committee (MCC).

f) A team code shall be assigned to each of the participating teams at the culmination of
Registration formalities by 22nd February 2023 on their respective email IDs.
g) In case, students who have completed the final registration for the competition, refuse to
participate at any stage of the competition, including but not limited to non-submission of
memorials, failure to appear in oral rounds, or before they are eliminated or disqualified
as per the rules of the competition, shall be liable to disciplinary action or other penalty
imposed as per the discretion of the Faculty.

5. Clarification Procedure

a) All the students, whether registered or not, may send their queries to the organizers to
the official Email ID of MCC (mcc@jmi.ac.in) before the last date of seeking
clarification as mentioned in the “Timeline” section of the brochure.
b) Clarifications shall be released in a single document, which will be mailed to the
concerned students.

6. Contact And Communication

a) All participating teams may contact the Organizers through the official Email ID of
MCC (mcc@jmi.ac.in).
b) Each team shall use the same email address for all purposes.

c) Communication to organizers through any way other than the aforementioned rules shall
not be treated as official communication to the organizers.
d) Participants are required to use their team codes for all communication purposes and

shall abstain from disclosing their identities such as their names and their year of study
or any other information about themselves or their team unless asked expressly.
e) Violation of the above rules may result in, an immediate disqualification, or, any other
penalty as the organizers may deem fit.

MEMORIALS

I. CONTENT OF MEMORIALS

1. Each memorial shall necessarily consist only of the following sections:


• Cover Page

• Table of Contents

• Index of Authorities

• Statement of Jurisdiction (max. 1 page)

• Statement of Facts (max.1 page)

• Issues Raised (max. 1 page)

• Summary of Arguments (max. 2 pages)

• Written Submissions (max. 20 pages)

• Prayer (max. 1 page)


2. Formatting: Except for the cover page, the Headings shall be 14 pt., and the text shall
be
12 pt. The font style should be ‘Times New Roman’. The text should have 1.5 line
spacing except for the Cover page. There should be 1 inch margin on both sides of the
page.
3. Table of Contents must be Hyper-Linked.

4. Citation: Bluebook (20th Edition) System of Citation must be followed for footnoting
and citations. The footnotes must have 1.0 line spacing.

5. Quotations of sources outside of the memorial of fifty words or more in any part of the
memorial shall be block quoted and must be single-spaced.
6. Each memorial shall have the following and only the following on its cover page:

• The team code on the top right-hand corner of the cover page.

• Name of the Competition.

• The name and place of the Adjudicating Institution/Court/Forum.

• The legal provision under which the filing was made.

• Name of the parties and their status, meaning thereby Appellant/Respondent.


• Memorial Filed on Behalf of Appellant/Respondent.

7. Names of the participants or their year of study must not be mentioned anywhere in the
memorial. Any other mark, character or text that reveals the identity of the team
members would also be considered a violation of this Rule. Violation of this Rule shall
attract severe penalty at the discretion of the MCC.
8. The hard copies of the memorial must bear a cover page in conformity with the
following scheme – • Appellant(s): Blue

• Respondent(s): Red

II. SUBMISSION OF MEMORIAL

1. The electronic copy of each memorial must reach the following e-mail address:
mcc@jmi.ac.in latest by 6th March 2023 (at or before 16:59 hours IST) with the subject
of the e-mail being ‘Intra-Moot Memorial Submission by Team Code- ’.
2. The memorials must only be submitted in ‘.doc’ or ‘.docx’ format at the given email
address.
3. The file names of the soft copy of the memorial must contain only the team code and the
side being represented in the following format: TC23-A or TC23-R, where ‘A’ and
‘represents the ‘Appellant’ and ‘R’ represents the ‘Respondent’, and ‘TC’ along with a
number represent the Team Code.
4. The teams must submit 4 hard copies (obtained after conversion to .pdf format, to avoid
any formatting issues) of their memorial from each side to the Moot Court Committee
latest by 6th March 2023 (at or before 16:59 hours IST). The hard copies must be
submitted at the ‘Conference Room’ of the Faculty of Law.
5. Delay in submission shall attract a penalty as enlisted in Rule No. IV.

IV. PENALTY CRITERIA FOR MEMORIAL


Penalties shall be deducted in the following manner-

RESEARCHER’S TEST

1. There shall be a Researcher’s test which will be conducted on 17th March 2023 after
the Registration for the Test at the Registration Desk.
2. No member, other than the Researcher shall be allowed to write the Researcher’s Test.

ORAL SUBMISSIONS

1. The language of the Court shall be English only.

2. Dress Code shall be professional formals and strictly black and white.

3. Teams shall be informed about the details of their scheduled courtrooms, well in
advance before the competition. Teams must reach the courtroom 15 minutes prior to
the time indicated for their rounds in the detailed itinerary.
4. Each team should have 2 speakers to make oral pleadings. The speakers shall remain
the same throughout the competition. However, in extraordinary circumstances, the
researcher may be allowed to speak on behalf of the speaker, subject to the discretion
of the bench.

5. Only one speaker from each team shall be permitted to rebut/sur-rebut, as the case
may be. The sur-rebuttal shall be limited to the rebuttals made by the team. If the
Appellant waives rebuttal, the Respondent’s sur-rebuttal is automatically waived as
well.
6. The time split between the speakers must be communicated to the court master before
the commencement of each round.
7. Teams shall not be permitted to use any electronic devices while their rounds are in
session.
8. The teams shall not disclose, in any manner whatsoever, for the entire duration of the
rounds, their identities to anyone, especially to the bench.
9. Teams can pass on a compendium comprising sources they cite in their memorial, if
so, is requested by the bench, or if they wish to produce it before the bench.

10. In every round of the Competition, teams arguing for the Appellant will argue their
case first, followed by the Respondent.

SCOUTING

1.No member of any team will be permitted to hear the arguments in any courtroom in
which that team is not one of the contesting teams whilst that team is still in the
Competition. The organizers may take appropriate action, including disqualification
from the Competition, against any team found to be scouting through a team member or
any other means.
2. However, every team shall be allowed to witness the final round.

EXCHANGE OF MEMORIALS

1. There shall be an exchange of memorials between the respective opposing teams, in


accordance with the fixtures as determined by a draw of lots, before all the rounds of
the Competition.
2. The teams are prohibited from making any marks on the exchanged memorial.

3. The teams are prohibited from making any copies of the exchanged memorial.

4. After their respective rounds, the teams are required to return the exchanged memorial to
the court masters where the round is so conducted.

PRELIMINARY ROUNDS

1.Each team (qualified after the Memorial Elimination Round) shall argue from both sides
(Appellant and Respondent) during the two Preliminary Rounds.

2. Fixtures for the Preliminary rounds shall be based on the Exchange of Memorials and
Draw of Lots. Details rega.rding the same shall be communicated via e-mail.
3. Each side shall plead for maximum 20 minutes in this round. It is the discretion of the
teams to decide the time they wish to reserve for rebuttals and sur- rebuttals which shall
not be more than 4 minutes in any case.
4. A speaker shall reserve no less than 8 minutes for the pleadings. Pleading time can be
extended only at the discretion of the bench.

QUARTER-FINAL ROUNDS

1. The top eight teams with the highest scores in the preliminary rounds will be qualified
for the Quarter-final Rounds. In case of a tie in the Preliminary Rounds, the memorial
marks will be taken into consideration to decide the winner.
2. Fixtures for the Quarter-finals shall be based on the Draw of Lots and Exchange of
Memorials after the Preliminary Rounds.
3. Each side shall plead for 30 minutes in this round. It is upon the discretion of the teams
to decide the time they wish to reserve for rebuttals and sur- rebuttals which shall not be
more than 4 minutes.
4. A speaker shall reserve not less than 12 minutes for the pleadings. Pleading time can be
extended only at the discretion of the bench.

5. This round shall be a knock-out round and the winner from each courtroom shall proceed
to Semi-Final Round.

SEMI-FINAL ROUNDS

1. For the Semi-Finals, each side shall plead for 30 minutes in these rounds. It is at the
discretion of the teams to decide the time they wish to reserve for rebuttals and sur-
rebuttals which shall not be more than 4 minutes.
2. A speaker shall reserve not less than 12 minutes for the pleadings. Pleading time can be
extended only at the discretion of the bench.
3. The same pattern of fixtures as followed in the Quarter-final rounds shall be followed in
the Semi-Final round.
4. The Semi-Final round shall be a knock-out round and the winner from each courtroom
shall proceed to Final Round.

FINAL ROUNDS

1. Each side shall plead for 40 minutes in this round. It is at the discretion of the teams to
decide the time they wish to reserve for rebuttals and sur- rebuttals which shall not be
more than 6 minutes.
2. A speaker shall reserve not less than 17 minutes for the pleadings. Pleading time can be
extended only at the discretion of the judges.
3. Each team shall be marked as per the criteria laid down. On the basis of the aggregate
score attained by the two speakers, the teams shall be ranked. The team with the higher
score shall be declared as the Winner.
4. In case of a tie between teams, the Memorial Scores shall be taken into consideration. The
team with the higher Memorial score shall proceed to the next round in such a scenario
