    PETITION UNDER SECTION 10A OF THE DIVORCE ACT, 1869


    READ WITH SECTION 7 (1A) OF THE FAMILY COURTS ACT, 1984

    The Petitioners above named humbly submit as follows:

    1. The First Petitioner is Mrs.D.Cindrella, Daughter of Soosai Nathan


    Christian, aged about 25 years, residing at No.6A, 2 nd Kamarajar
    Street, Mummoorty Avenue, Kaspapuram. Mappedu
    Kanchipuram Dist– 600 126.

    The address for service of all notices and processes on the First
    Petitioner is as stated above. E.M.S. NATARAJAN, M. HARI
    PRASAD, R. MANI, Having the office address at Sholinghur Road,
    opt to B.D. Office, Pallipat, Thiruvallur Dist – 631207.

    2. The Second Petitioner is Mr.L.S.Cibbumon. S/o R.Lawrance


    sabasten Christian aged about 30 years, residing at No.179,
    Chittoor Road, Tirutani, Thiruvallur Dist 631209 .

    Second Petitioner is as stated above.

    3. The Petitioners submit that the marriage between them was


    solemnized on 02-09-2020 at Mahalakshmi Marriage Hall East
    Tank Street, Tiruvallur. In the presence of friends and exchanged
    the garlands and wedding ring, the same was registered with the
    Registrar of Marriages, Sub Registrar office Tiruvallur , Dated
    14/09/2020 as Serial number of marriage TMR/Tiruvallur/314 of
    2020, within the jurisdiction of this Hon’ble Court.

    4. The petitioners state that the Marriage was performed with the
    knowledge of the both the parents of both the petitioners, First
    petitioner stayed at second petitioner’s house soon after the
    marriage at residing at No.179, Chittoor Road, Tirutani,
    Thiruvallur Dist 631209 for more than an month.

    5. The Petitioners started their matrimonial life immediately after


    the reception at Mahalakshmi Marriage Hall East Tank Street,
    Tiruvallur. After that both the petitioner’s were living in second
    petitioner’s house No.179, Chittoor Road, Tirutani, Thiruvallur
    Dist 631209 .From the day one of their marriage life as the
    difference of opinion arose between the Petitioners, Even after
    they started live together the petitioners could not reconcile
    themselves. The Petitioners have been living separately since
    October 2020.

    6. The Petitioners respectfully submit that they have not been able
    to live together and reconcile themselves. Several attempts
    made by the family members and elders were went on vein. As
    referred to above, the Petitioners have been living separately
    since November October 2020 and it has become impossible for
    them to reconcile themselves and live together.

    7. The Petitioners submit that the marriage having been irrevocably


    broken down, the Petitioners have mutually agreed that their
    marriage solemnized on 02-2-2020 at and the same was
    registered with the Registrar of Marriages, sub Registrar office,

    Tiruvallur Dated 14/09/2021 as Serial number of marriage 314 of
    2021, should be dissolved. The Petitioners further state that with
    a view to avoid ruinous litigation and to maintain family dignity
    and honor, they have decided to file a mutual consent petition
    for dissolution of marriage. Accordingly the Petitioners are filing
    this mutual consent Petition for divorce under Section 10A of the
    Divorce Act, 1869.

    8. The Petitioners respectfully submit that, both the petitioners


    have spent amount equally for the marriage and reception. So
    both the petitioners have mutually agreed not to ask any
    permanent alimony without any hesitation. Hence in future both
    the first petitioner and the second petitioner will not ask any
    alimony.
    9. The First Petitioner submits that she has taken back all her
    belongings including jewels and has no further claims in respect
    of any articles, jewels, valuables or testimonials. Similarly the
    Second Petitioner has also taken back all his belongings. The
    Petitioners submit that there is no claim against each other in
    respect of any article or property. The Petitioners further submit
    that no child is born out of the wedlock.

    10. The Petitioners submit that there is no collusion or


    connivance in filing this Petition and the consent has not been
    obtained by threat, force, coercion, undue influence or fraud. The
    Petitioners have been living separately from October 2020 and
    there has never been any cohabitation thereafter.

    11. The Petitioners submit that the cause of action for the
    Petition arose on 02.09.2020 when the Petitioners got married at
    Mahalakshmi Marriage Hall East Tank Street, Tiruvallur and
    registered on 14.09.2020 with the Registrar of Marriages Sub
    Registrar office, At Tiruvallur as Serial number of marriage 314 of
    2020, which are within the jurisdiction of this Hon’ble Court,
    when the Petitioners began living as husband and wife and on
    October 2020 when the parties got separated from the address
    at Second Petitioner house.

    12. The Petitioners submit that the Petition is incapable of
    valuation and hence a sum of Rs. /- has been paid as Court Fee
    as per Article 1 Schedule II of the Tamil Nadu Court Fees and
    Suits Valuation Act, as amended.

    13. The Petitioners submit that there is no other Petition filed


    by either of the Petitioners.

    In the circumstances, it is prayed that this Hon’ble Court may be


    pleased to grant a Judgment and decree dissolving the marriage
    between the Petitioners solemnized on 02-09-2020 at Mahalakshmi
    Marriage Hall East Tank Street, Tiruvallur and registered on 14-09-
    2020 with the Registrar of Marriages Sub-Registrar office, Tiruvallur
    as Serial number of marriage TMR/Tiruvallur/314 of 2020, on the
    grounds of Mutual Consent under Section 10A of the Divorce Act
    and thus render justice.
