This is a case of cheating coupled with criminal breach of trust by an
employee in private firm that occurred prior to 01.07.2023 at 11:00 hrs, at Shop
No.3 in Sector-11, Ukkunagaram, Steel Plant, Visakhapatnam City and reported on
01-07-2023 at 11:00 hours.
On 01-07-2023 at 11:00 hours, wherein the complainant Adduru Krishna Rao
S/o Apparao, Age 53 years, Caste by SC(Mala) R/o D.No.6-17, Adduri Veedhi,
Cheepurupalli, Vizianagaram District lodged a report which is as follows:
“I'am Adduru Krishna Rao S/o A.Apparao. I am allottes of Shop No.3 in Sector-
11, Ukkunagaram, Visakhapatnam under SC/ST Category to run medical shop
business from Vishakhapatnam Steel Plant authorities in the year'2006. I am
enclosing copy of the allotment order issued by steel plant authorities for kind
reference(Annexure-1). Because of my financial constraints, I have taken loan from
my friends for investing into medical shop business. I have been doing the business
in the said shop in the name of “Sri Venkateswara Medicals™
I have appointed one Andavarapu Siva Sankar Rao, S/o.Prasada Rao as an
employee 10 look after day to day affairs of the shop. He made us to believe him
like anything. We are all believed and trusted him. so I have given an authorization
for necessary activities such as purchase, sales of medicines and vendor payments
etc., In the year 2018, in order to facilitate bank transactions, I have given
authorization to him for issuing of Cheques and net banking. The copy of the said
authorization is enclosed herewith for kind reference (Annexure-2).
 I have opened business current account 093511011900071 in Andhra Bank
(merged with Union Bank of India), Sector-5. Ukkunagaram, Visakhapatnam and
established POS machine/QR codes to receive the online receipts into this account.
The said employes opened separate bank account in Paytm Bank (Vc No.
917702431198) Indusind Bank (Ac.No.201014512415) in his personal name and
also obtained QR codes and diverted digital receipts from the customers of our shop
into these personal accounts without my knowledue and amount so received used
for his personal needs. Similarly he obtained phonepe QR code in his personal name
and diverted online receipts to phonepe wallet and used the amounts for his
personal needs. Some of the phonepe amounts directly credited into his personal
account 095510100077018 with Union Bank of India, sector- V. Ukkunagaram,
Visakapatnam. These online receipts instead of crediting to Shop's Bank account. he
got credited into his personal bank account and misused funds for his personal
gains. Copy of the paytm statement (Annexure-3). phonepe invoice (Annex-4) is
attached for your ready reference. When I asked the online receipt data, he has
deleted the apps from his mobile. It is understood that he has cot several accounts
in other banks also used for diversion of funds.
I have trusted him and engaged him to run business and handover my shop
to him with the belief that he would run the business properly but he never shown
proper accounts pertaining to all transactions of my bank account as well as cash.
Two of his brothers A.Sridhar and A.Ramana Murthy Gupta and father conspired and
grabbed money from the business and cheated me without showing genuine
accounts and misappropriated more than Rs. 1,00,00,000/- (Rupees One Crore)
from the shop accounts by using his personal bank account and showing the lower
cash sales.
His brother Andavarapu Ramana Murthy Gupta has also worked in my shop
for some time. He opened current account No 20105227347 in Indusind Bank in his
personal name and obtained QR code(Annexure-5) and kept in the above shop and
diverted business receiptsto his personal account and misappropriated the same.
We trusted them and handover the shop but they have conspired with a
malafide motive to grab money from the shop. They have executed the conspiracy
successfully, cheated us and misappropriated funds from my shop and diverted
online receipts to their personal bank accounts amounting to more than
Rs.1,00.00,000/- and they have invested said amounts for purchase of house sites,
gold and other valuables and luxurious articles and constructed building bearing
D.No.55-1-478 at Samatanagar, Desapatrunipalem, Parawada Mandal and opened
new shops. He has also open RD accounts in the name of his children and his
brother children and amount deposited out of the diverted amount from my shop.
When he came to Visakhapatnam in the year 2006 with empty hand for joining in
the shop. Now he has accumulated so much of property by cheating me.
His another brother Andavarapu Sridhar and Smt. Andavarapu Prasanti W/o
Siva Sankar Rao also abated them to commit all these offences so that all of them
committed offences of Criminal Conspiracy, Criminal breach of trust,
misappropriation of funds and cheating for their wrongful gains. They have shown
false accounts of shops by suppressing genuine accounts to defraud us. They have
planned and knowingly issued 103 cheques to our vendors on behalf of our shop,
those cheques are dis-honoured due to lack of funds. It’s clearly shows that criminal
intention of the supra mentioned 5 persons so that they have committed above
criminal offences.
One Meesala Gopi, Tailor, Desapatrunipalem has helped them in the
conspiracy and substantial amounts diverted to his personal accounts and accounts
of his family members from our business.
Since 8th Mar 2023, Andavarapu Siva Sankar Rao is absconding with
available cash in cash box and he has taken away the cash sales book and
important papers/blank cheque books from the shop.
Further there are about Rs.30 lakhs outstanding to various vendors who are
pressuring for the payment. Sales receipts he has used for his personal needs
without making payraent to vendors who supplied the medicine on credit.
As the above misappropriation is very huge and have impact on the my
financial position and I am unable to pay the vendors as total money diverted by
him to his personal account. I am requesting you sir to take appropriate legal action
against 1) Andavarapu Siva Sankara Rao and his father 2) Andhavarapu Prasada
Rao 3) Andavarapu Ramana Murthy Gupta, 4) Andavarapu Sridhar and 5)
Andavarapu Prasanthi W/o A.Siva Sankar Rao, 6) Meesala Gopi tor the above
offences and do needful help to us in recovery of supra mentioned huge amount.

As the Inspector of Police/SHO of Steel Plant PS was engaged on other duties,

I registered the above report as FIR in Cr.No.52/2023 U/S 420,408,406,403 r/w 34
IPC of Steel Plant PS and submitted the original FIR along with the complainant’s
report to the Hon’ble court of VIII Addl. CMM, Visakhapatnam and remaining copies
of FIR to all concerned officers and took up investigation.
Having registered FIR, I then secured the presence of the complainant,
examined him and recorded his detailed statement in my case diary part II as LW1.
On examination LW 1 Adduru Krishna Rao S/o Apparao, Age 53 years, Caste
by SC(Mala) R/o D.No.6-17, Adduri Veedhi, Cheepurupalli, Vizianagaram District
stated the same facts which were narrated in his earlier report i.e. FIR complaint.
I then left from the police station and visit the complainant Shop No.3 in
Sector-11, Ukkunagaram, Steel Plant, Visakhapatnam City which is at a distance of
6.5 km west to the Steel Plant Police Station.
I secure the presence of mediacl shop staff L.Srinu as LW 2, examined and
recorded his detailed statement in my part-II case dairy.
On examination as LW 2 Lakkaraju Srinu S/o Ramulu, Age 38 years, Caste by
Kapu R/o D.No:-1-39, Desapatrunipalem village, Parawada MD, Anakapalli stated
that he is studying 10th class and well known to Siva Sankar as a neaighbour. In
2013 he was joined in Sri Venkateswara Medicals as medicines delivery boy in the
salary of Rs.4,000/-. He took medical parcels from Vizag and delivered to the shop.
In 2015 Kadimisetti Laxman Kumar was joined the same medical shop and took the
work of medicine sales and bills in the medical shop. Siva Sankar took all the
transactions, bank works, digital payments of UPI (Phonepay, Paytm, etc) apps. Also
Siva Sankar had payed the amount for purchase of medicines and paid cash to the
bank. Sometimes Siva Sankar wife Prasanthi came to the shop and relieve him from
the work and took cash counter in medical shop. In 2021 his colleague Kumar was
left the shop due to salary issue. All the phone pay and digital payments were
deposited in the account of Siva Sankar. While customers were more at the medical
shop, one Meesala Gopi who is working in Sector-11 tailor shop came to the medical
shop and sell the medicines. Siva Sankar had brought the co-operative loan amount
of Rs.70,000/- in the name of his credential and did not return. Also he came to
know that Siva Sankar had borrow the medicines from nearly 40 medical shops.
After March Siva Sankar was not came to the medical shop. The medical shop
Nageswara Rao instructed him to got to Siva Sankar home to get cash book,
amount, medical records. He then went to Siva Sankar’s home and brought only
cash. Siva Sankar running the medical shop and not returned the amount to the
shop owner and committed to cheat in other medical shops by borrowing the
medicines without payment. Today he stated and corroborated the same facts as
LW 1 in all aspects etc.
In this case investigation is not completed yet, while trying to secure other
witnesses but they were unavailable. After securing the witnesses have to be
examined and recorded their statements. Bank transactions and accounts
statements to be received from the concerned banks as well.

Today I secure some more victims as LW’s 3 to 5, examined and recorded
their detailed statements in my part-II case dairy U/s 161(3) Cr.P.C.
On examination LW 3 Kadimisetti Laxman Kumar S/o K.Pedavenkata Ramana,
age 39 years, Caste by Vyshya R/o Kailasagiri colony, near Lohaman Casting work,
Anakapalli N/o D.Yerravaram, Nathavaram, Anakapalli stated that present he is
working as sale boy in Sri Ratnavilli Medical shop at Aganampudi. Previously he is
working as salesboy in Sri Venkateswara Medicals at sector-11, Steel Plant. Siva
Sankar took all the transactions, bank works, digital payments of UPI (Phonepay,
Paytm, etc) apps. Also Siva Sankar had payed the amount for purchase of medicines
and paid cash to the bank. Sometimes Siva Sankar wife Prasanthi came to the shop
and relieve him from the work and took cash counter in medical shop. Siva Sankar
asked him to for money then he gave debt of Rs.1,50,000/-. While asking about to
increase the salary to the shop management but in vain. Then he quit from the job
and joined in Sri Ratnavilli Medical shop at Aganampudi. Siva Sankar was not return
his money. Also he came to know that Siva Sankar had borrow the medicines from
nearly 40 medical shops and running the medical shop but not returned the amount
to the shop owner and committed to cheat in other medical shops by borrowing the
medicines without payment.
 LW 4 Devarasetti Nageswara Rao S/o Laxmana Rao Late, age 57 years, Caste
by Vyshyas R/o Flat No.403, Star residency, Gallavanipalem, Aganampudi,
Visakhapatnam City stated that he is working as Senior Foreman in Energy
Management department, Steel Plant. In the year of 2006 he gave an amount of
Rs.2,50,000/- to Adduri Krishna in the name of his wife as investment to run a
medical shop at Sector-11. In the same manner his brother Late Parvatheswara Rao
and P.Srinivasa Rao put investment of Rs.7,50,000 in the medical shop. Later the all
the business works were took over by Adduri Krishna. After 2006 he advised
P.Srinivasa Rao for joining of one person in the shop to took the work of Sales,
purchase, cash book, payments etc. Then Adduri Krishna Rao joined one
Andavarapu Siva Sankar who is relative of Srinivasa Rao in the medical shop to
handover the business works of medicines. After some time Siva Sankar demanded
to increase salary for his work but Krishna Rao in vain and also replied him to invest
money then Siva Sankar invest money of Rs.2,00,000/-. Later Siva Sankar kept
digital payments mode from Phonepay, Paytm and transferred money to his self
account thereby committed cheating. After some time Siva Sankar was not came to
shop then he came to know that Siva Sankar had borrow the medicines from nearly
40 medical shops and running the medical shop but not returned the amount to the
shop owner. Later Krishna Rao informed me that Andavarapu Siva Sankar had
cheated an amount of Rs.30,00,000/- and used his personal without maintain proper
cash book. Today he stated and corroborated the same facts as LW 1 etc.
LW 5 Potnuru Srinivasa Rao S/o Late Neelakantam, age 55 years, Caste by
Vysyas R/o Flat No.104, Star residency, Gallavanipalem, Aganampudi,
Visakhapatnam City stated that he is working as employee in Finance department,
Steel Plant Visakhapatnam. His friend Adduri Krishna Rao had brought a shop No.3,
at Sector-11, Steel Plant under SC/ST category. Then he along with the relative
Devarasetti Nageswara Rao and his brother Late Parvatheswara Rao had invested
money each one of Rs.2,50,000/- in the name of his wife as debt to run the medical
shop and the shop named as Sri Venkateswara Medicals running by A.Krishna Rao.
Later Krishna Rao asked one honest person to took over the sales, purchase of
medicines, maintain cash book etc. Then he joined his relative A.Siva Sankar in the
medical shop to look over the business works of medicines. After some time Siva
Sankar demanded to increase salary for his work but Krishna Rao in vain and also
replied him to invest money then Siva Sankar invest money of Rs.2,00,000/-. Later
Siva Sankar kept digital payments mode from Phonepay, Paytm and transferred
money to his self account thereby committed cheating. After some time Siva Sankar
was not came to shop then he came to know that Siva Sankar had borrow the
medicines from nearly 40 medical shops and running the medical shop but not
returned the amount to the shop owner. Later Krishna Rao informed me that
Andavarapu Siva Sankar had cheated an amount of Rs.30,00,000/- and used his
personal without maintain proper cash book. Today he stated and corroborated the
same facts as LW 1 etc.
Investigation is not yet completed in this case. Some more witnesses and
evidences to be collected due to the amount mentioned in the ablove was
transferred in between the hands of victims and accused.
 In this case the accused apprehend, I will set up information to trace out the
accused.

This day I resumed further investigation in this case.
Today I served notice to the accused A1 to A6 U/s 41-A Cr.P.C as per the
guidelines of Hou’ble APEX Court and inform them that during the investigation of
case in Cr.No:-52/2023 U/Sec 420,408,406,403 r/w 34 IPC of Steel Plant Police
Station, Visakhapatnam City. It is revealed that there are reasonable grounds to
question you to ascertain facts and circumstances from you. Hence they are
directed to appear before me/the investigating officer from the receipt of the Notice
at Steel Plant Police Station, Visakhapatnam City. Failing which necessary action will
taken against you according with law.
While I was present in the police station at evening, the marginally noted
accused A1 to A6 came to police station in the evening and surrenders before me. I
then examined the accused about the accident and admitted their guilt.
Then I served noted to the accused A1 to A6 u/s 41-a Cr.P.C at about 16.00
hours and since they have complied the instructions issued in the notice and I felt
that they would not commit similar type of offences again, not tamper the
evidences, not influence and threaten the witnesses and further assured that they
would appear before court and police as and when summoned, I have let off them
without any arrest, duly taking bonds from them. The accused assured that they will
attend before the Hon’ble court on receipt of summons.
Closed the CD for the day and further CD will be submitted.
