ABSOLUTE SALE DEED

THIS INDENTURE OF ABSOLUTE SALE is made and


executed on this the 13th day of December Two
Thousand Twenty (13.12.2021) at Bengaluru;

Hereinafter referred to as the VENDOR; which term


shall mean and include her heirs, legal
representatives, administrators, executors, assigns
etc., of the One Part;
IN FAVOUR OF :

Hereinafter referred to as the PURCHASERS;


which term shall mean and include their heirs, legal
representatives, administrators, executors, assigns
etc., of the Other Part;

WITNESSETH AS FOLLOWS :

I. WHEREAS the VENDOR is the sole and absolute


owner in Possession and enjoyment of the
property site bearing of No. 10, E-katha
No.150200401601420181 in Sy.No.15/2,the
above said land converted residential purpose in
236695 dated 18.09.2021 situated at.
Nimbekaipura village, Bidarahalli Hobli,
Bangalore East Taluk, measuring to an extent of

East to West 42 feet and North to South 30 feet
in all measuring totally 1260 sq feet herein after
called as Schedule property.
II. WHEREAS, the VENDOR has acquired the
schedule Property through a registered
sale deed dated.02.12.2020 registered as
Document No. KRI-1- 06279/2020-21, BOOK-1,
stored in CD NO. KRID1116, registered in the
office of the Sub-Registrar K.R.Puram,
Bengaluru, after obtaining the registered sale
deed the vendor is in peaceful possession and
enjoyment of the same, it is free from all types
of encumbrances.

III. Whereas the Katha of the schedule property


stands in the name of the VENDOR and
necessary taxes has been paid up to date. The
VENDOR has got good and marketable title over
the schedule property and got full and absolute
right to enter into this sale Deed.

IV. Whereas since the date of purchase of the
Schedule Property by the Vendor is in peaceful
possession and enjoyment of the Schedule
Property by exercising all the acts of ownership
over the same and whereas the Vendor has also
transferred all the relevant records and the
Vendor is also paying property tax to the
concerned revenue authority and the schedule
property is free from all kinds of encumbrances.

V. Whereas the Vendor desirous to alienate the


Schedule Property in favour of the Purchasers
for a valuable sale consideration of
Rs.17,00,000/- (Rupees Seventeen lakhs
only) free from all kinds of encumbrances and
whereas the Purchasers has also come forward
to purchase the Schedule Property for a
valuable sale consideration of Rs.17,00,000/-
(Rupees Seventeen lakhs only) free from all
kinds of encumbrances;

NOW THIS INDENTURE OF ABSOLUTE SALE
WITNESSETH AS FOLLOWS

1 That in consideration of the foregoing and the

price herein and hereby reserved, the Vendor hereby

agrees to sell and the Purchaser hereby agrees to

purchase the schedule property for a valuable sale

consideration of Rs.17,00,000/- (Rupees

Seventeen lakhs only)free from all kinds of

encumbrances to the Vendor in the following

manner:-

a) Rs.10,00,000 (Ten lakhs Rupees only) through


the by way of cheque bearing No.00016 dated
19.12.2020, Drawn Union Bank of India, K.R.Puram
Branch, Bangalore

b) Rs.5,00,000 (Five lakhs Rupees only) through
the by way of cheque bearing No.007201 dated
13.07.2020, Drawn Union Bank of India K.R.Puram
Branch, Bangalore,
c) Rs. 2,00,000/- (Rupees Two lakhs only) by
way of cash in favour of the Vendor. On this day
and the Vendor has acknowledged the receipt of
the same as full and final settlement of the sale
consideration in the presence of the witnesses
signed hereunder as witnesses to this sale
transaction as well as acknowledges the receipt of
the sale consideration by the Vendor.
2. The Vendor hereby grants, conveys, transfers
and assigns, absolutely his right, title and interest in
the Schedule Property together with all
hereditaments, appurtenances, right of easements
TO HAVE AND TO HOLD the same UNTO the use of
the Purchaser and the Purchasers is at liberty to
enjoy the Schedule Property as an absolute owner

thereof without any let or hindrance either by the
Vendor or any one claiming under him.

3. The Vendor covenants that he is the full and


absolute owner of the Schedule Property and the
Schedule Property acquired by him through a
Registered Sale Deed and that he has got good and
marketable title and interest in the Schedule Property
and that there are no other person/s who have any
kind of right, title, claim, share or interest whatsoever
in the Schedule Property and hereafter wards the
Purchasers can enjoy the Schedule Property without
any let or hindrance either by the Vendors or any one
claiming under him.

4. The Vendor assures the Purchasers that there


are no encumbrances, attachments, court
proceedings, acquisition proceedings, liens/charges
by the Government Departments in respect of the
Schedule Property, the Vendor hereby indemnifies
the Purchasers against any discrepancy in the title in

respect of the Schedule Property and he will set right
the same at his cost and risk, if any found.

5. The Vendor shall and will from time to time and


upon the request of the Purchasers, his heirs,
representatives, undertakes to execute or cause to
be executed all such assurances, deeds and things as
may be legally required or necessary to complete the
transfer of right, title and interest for better
enjoyment of the Schedule Property at the cost of the
Vendor.

6. The Vendor has this day delivered all the


original title deeds and other records in respect of
the Schedule Property to Purchasers and the
Purchasers has taken delivery of the same and
whereas the Vendor has also this day handed over
the vacant possession of the Schedule Property to
the Purchasers and the Purchasers has taken delivery
of the same.

7. The Vendor has no objection to transfer the
khatha and other relevant revenue records including
the BESCOM and BWSSB in the name of the
Purchasers in respect of the Schedule Property in the
concerned revenue departments/ authorities/offices.

SCHEDULE PROPERTY

All that Piece and parcel of the Property site bearing

of No. 10, E-katha No.150200401601420181 in

Sy.No.15/2, the above said land converted residential

purpose in 236695 dated 18.09.2021 situated at.

East by : Sy No.15/1,

West by : Road,

North by : Site No.9,

South by ; Site No.11,

The stamp Duty is paid as present market value

IN WITNESS WHEREOF both the parties have set and


subscribed their respective signatures to this
Indenture of Absolute Sale, on the day, month and
the year first above written at Bangalore.
