Whereas the party of the first part desirous of constructing a Residence, compound wall
as per Agreement specification, condition and requirements laid down in schedules
attached to this agreement and signed by both the parties to this agreement and
whereas the Party of the second part has agreed to execute and complete the above
work at the places reserved for the purpose within the specified period or earlier and in
accordance with the specification, condition and requirements detailed in the
schedules.
1. The Party of the second part will execute and complete the works as per drawings and
specifications to the satisfaction of the Party of the first part.
2. The Party of the second part shall execute the works as per plans approved by the
Party of the first part and as per the specification indicated in their quotations and
schedule attached. In case of any discrepancy or ambiguity or alteration or decoration,
the Party of the second part must consult the Party of the first part and get his approval
before executing the work.
3. Water and power will be supplied by the Party of the first part at work site.
4. Payments will be made to the Party of the second part as per schedule stage by stage
here in enclosed.
5. GST etc., if any, will have to be paid by the Party of the first part, at the rate in force
and thereafter increased, imposed or modified from time to time in respect of works and
materials and all contributions and taxes for unemployment compensation, insurance
annuities etc., either by State Government or Central Government of local Statutory
authorities.
6. The Party of the second part must give receipt for every payment made by the Party of
the first part.
7. Quality work should be maintained by the Party of the second part. If the work is found
defective, the defective work should be rectified by the Party of the second part on his
own cost.
8. If the Party of the second part shall desire an extension of time for completion of the
work on the grounds of his having been unavoidably hindered in its execution or on any
other grounds, he shall apply in writing to the Party of the first part within 15 days of the
date of hindrance on account of which he desires extension as aforesaid, and the Party
of the first part shall, if in his opinion [which shall be final] reasonable grounds be shown
therefore, authorize such extension of time, if any, as may in his opinion, be necessary
and proper.
9. During the construction if, any unexpected or unwanted incidents happen and loss
arise, it should be borne by the second party only. First party will not part with that
incident or loss. The First Party holds no responsibility towards such incidents connected
with laborers, vehicles etc.
10. The Party of the second part has agreed to complete the work within 8 to
10- Months to ten Months or earlier.
The below are construction specifications committed by the BUILDER to the OWNER.

10 DOORS& WINDOWS Main Entrance with door –3’3”x7’ First Class Teak
doorframe with Teak wood Shutters.
Bedroom door frame with 2nd Class Teak wood size

Inner Doors are Membrane doors size 3’0” x 7’0” –

Bathroom & Toilet Doors– WPC Material for both frames
& Doors.
