1. Project Overview

 Brief Project Description: This dissertation will examine the evolving legal framework
surrounding trademark protection in the context of e-commerce. It will analyze the
unique challenges posed by online marketplaces, social media platforms, and the rise of
digital counterfeiting and brand infringement. Furthermore, the research will investigate
the adequacy of existing legal frameworks to protect consumers from misleading
advertisements, counterfeit goods, and online brand impersonation.
 Research Methodology: This research will employ a mixed-methods approach. It will
involve a comprehensive review of existing legal literature, including scholarly articles,
court judgments, and relevant legislation. Additionally, qualitative data will be collected
through semi-structured interviews with legal experts, brand owners, and consumer rights
advocates.

significance of brand recognition, consumer confusion, and the role of goodwill.
o Explored existing legal frameworks for trademark protection in the digital
environment, focusing on relevant legislation (e.g., the Trademark Act, the Digital
Millennium Copyright Act) and case law.
o Identified key legal challenges such as cybersquatting, trademark dilution, and the
rise of counterfeit goods on online platforms.
 Methodology Development:
o Began drafting the interview guide for semi-structured interviews with legal
experts and stakeholders.
o Identified potential interview participants, including attorneys specializing in
intellectual property law, representatives from major e-commerce platforms, and
consumer protection organizations.
 Ethical Considerations:
o Considered ethical guidelines for data collection and analysis, including informed
consent, data confidentiality, and participant anonymity.

3. Challenges Encountered

 Finding a comprehensive and up-to-date database of relevant legal cases and scholarly
articles related to trademark law and e-commerce.
4. Next Steps

 Continue the literature review, focusing on specific case studies of successful and
unsuccessful trademark enforcement in the e-commerce context.
 Finalize the interview guide and schedule initial interviews with key stakeholders.

5. Reflections

This week has highlighted the dynamic and complex nature of the intersection between
trademark law and e-commerce. The rapid evolution of online platforms and consumer behavior
presents significant challenges for both brand owners and policymakers. The research will delve
deeper into these challenges and explore potential solutions to ensure effective trademark
protection and consumer protection in the digital age.
