REQUIREMENTS FOR INVENTORSHIP In order to be an inventor, an individual must make a material contribution to the claimed invention. Simply taking instruction for another, rendering drawings, or managing a department does not make an individual an inventor. However, the conception must be sufficiently complete to enable a person skilled in the art to make the invention using no more than routine experimentation. If ingenuity is required to make the invention, it is likely that the person employing such ingenuity has made a material contribution to the invention. Filing U.S. patent applications with properly designated inventorship is important. U.S. patent laws require U.S. patent applications to be filed in the name of the inventors rather than in the name of the owners. Improper inventorship can be used to invalidate issued U.S. Patents.
