Buffalo Public Schools

Background

On June 16, 2015, the NYS Board of Regents (BOR) approved new regulations for
APPR -3012-d, and during the December 2015 meeting, the BOR adopted sections
30-2.14 and 30-3.17.

The new law requires teachers and principals to be evaluated based on two
categories: the Student Performance Category and the Observation/School Visit
Category.

Under the new law, New York State continues to differentiate teacher and
principal effectiveness using four rating categories Highly Effective, Effective,
Developing, and Ineffective.

Education Law 3012-d requires APPRs to result in a single composite teacher or


principal effectiveness rating that incorporates multiple measures of effectiveness.
As in the past, the results of the evaluations shall be a significant factor in
employment decisions, including but not limited to promotion, retention, tenure
determination, termination, and supplemental compensation, as well as teacher
and principal professional development (including coaching, induction support, and
differentiated professional development).

four year transition period for annual professional
performance reviews (APPRs) while the State completes
the transition to higher learning standards through new
State assessments aligned to the higher learning
standards, and a revised State-provided growth model

Education Law 3012-d requires APPRs to result in a single


composite teacher or principal effectiveness rating that
incorporates multiple measures of effectiveness. As in the
past, the results of the evaluations shall be a significant
factor in employment decisions, including but not limited
to promotion, retention, tenure determination,
termination, and supplemental compensation, as well as
teacher and principal professional development (including
coaching, induction support, and differentiated
professional development).

Student performance categories:


Teachers

Grades 4th-8th in ELA and Math

During the 2015-16 through 2018-19 school years, such score and
ratings shall only be used for purposes of calculating original
scores and ratings.

Additional grades/subjects covered by growth scores, as measures


become available, based on existing and new State assessments

Where the State-provided growth score covers less than 50% of a


teachers students, SLOs must be developed following the rules
and options set forth for all other classroom teachers.

All OTHER CLASSROOM TEACHERS

All

other classroom teachers:


State/Regents assessment(s) must be used as the evidence for the SLO where they exist.4
For other grades/subjects where no State assessment or Regents exam currently exists, SLOs
based on district-determined assessments

assessments administered outside of an educators

Teacher observation category

least one observation by building principal or other trained administrator:

Evaluators may select a limited number of observable rubric subcomponents for


focus within a particular observation so long as all observable Teaching
Standards/domains of the selected practice rubric

At least one observation by impartial independent trained evaluator

If a district is granted an annual Independent Evaluator Hardship Waiver by the


Department, the second observation(s) shall be conducted by one or more
evaluators selected and trained by the district, who are different than the
evaluator(s) who conducted the observation(s) required to be performed by the
principal/supervisor or other trained administrator.
