ECOLOGICAL SOLID

WASTE MANAGEMENT RA 9003

ACT
Declaration of Policy

It is the policy of the State to ensure a balanced and


healthful ecology that the environment is conserved and
protected as an inter-generational responsibility for the
future occupants of this land
RATIONALE OF THE LAW:
Garbage disposal is one of the emerging issues that every city and
municipality are confronted with.
In our country specially in public areas, unsegregated garbage and
even human or animal waste became offensive to the public eye as
well as the public health
The government by virtue of this Act, the government already took the
first step in order to afford its citizens a clean and conducive
environment by minimizing our waste through segregation composing
and recycling
Proper waste management is an essential movement in ensuring that
the progress of a developing city is materialized
One can tell just by one’s perception that a city has improved
when they see that it is clean, and there are proper designated
places for the disposal of their waste
In Naga City for example, we can notice specially in public
areas that there are designated garbage boxes, one for
biodegradable, one for non-biodagreadable and one for
recyclable materials
By virtue of this act we can minimize the waste incurred by a
city through segregation, composting, reusing and recycling
STAKEHOLDERS
The stakeholders under this Act are firs the Stat through
the local government units, second the private juridical
entities and lastly the citizens
ROLE OF THE STAKEHOLDERS
The State through its local government units is responsible for the
following:

-To ensure that the law is properly implemented by providing garbage


boxes in every public place
-To hire metro aides who shall be in charge in maintaining the
cleanliness of the city or municipality
-To hire garbage collectors who shall collect the accumulated garbage in
every residential, commercial or public areas
-To provide for a dumping site wherein the collected garbage shall be
stocked and if possible, eliminated
The private juridical entities are responsible for the
following:

-To follow the practice implemented by the local government


-To provide trash bins within the premises of their respective
establishments
-To promote measures for reusing recyclable products
-To promote the reduction of the use of plastic bags and other
similar materials in the course of the operation of their
business
The citizens are responsible for the following:

-To abide with the mandate of the law and obey the measures
implemented by the local government and the private entities
-To religiously dispose their waste materials to its proper
designate place
-To make a compost wherein the biodegradable waste shall
be put in
-To recycle non-perishable materials in order to reduce the
consumption and abuse to the environment
THE PROCESS INVOLVED IN THE CONDUCT OF DENR
ADMINISTRATIVE ADJUDICATION PROCEEDINGS FOR
CONFISCATED FOREST PRODUCTS

The DENR Administrative Adjudication Board


shall subpoena the confiscated forest products and
the person responsible for the offense
The Board shall decide based upon the evidence presented and the
testimony of the witnesses if such forest products were indeed
obtained illegally

The Board, upon finding that such forest products


were indeed illegally obtained , it shall rbe turned
over to its respective LGU and in case of living
animals, the same shall be released with the
assistance of the corresponding LGU
