THE WATER CODE OF THE PHILIPPINES

Underlying Principles
All waters belong to the State
All waters that belong to the State can not be the subject
of acquisitive prescription
The State may allow the use or development of waters by
administrative concession
The utilization, exploitation, development, conservation
and protection of water resources shall be subject to the
control and regulation of the government through the
National Water Resources Council (NWRC) now
National Water Resources Board (NWRB)
Preference in the use and development of waters shall
consider current usages and be responsive to the
changing needs of the country

FROM NWRB
Proof of Land Ownership of, legal title to, or right to use, the
property on which the water source is situated
Certificate of Registration from relevant agencies
Vicinity Map/Location Plan showing the exact diversion point
Well Drilling Data (In case of existing well)
Actual discharge of the spring
Certificate of Potability; Manifestation to treat the water if not
potable
ECC/Certificate of Non-Coverage

Non-Use
Art. 80- The Board may deputize any official or agency of the
government to perform any of its functions or activities.
Art. 88- The Board shall have original jurisdiction over all disputes
relating to appropriation, utilization, exploitation, development,
control, conservation and protection of waters within the meaning
and context of the provisions of this Code
