LEGAL BASES
• 1987 Constitution, Art. 13 Sec. 18 (4)
• Sec. 11, IRR, R.A. No. 9745: The CHR shall exercise its
visitorial powers at any time over jails, prisons and detention
facilities, have unrestricted access to any detention facilities
inside military camps, police lock-up cells, jails, prisons,
youth homes, or any detention, rehabilitation, confinement
and other similar facility.
• Sec. 13, R.A. No. 10353: The CHR or its duly authorized
representatives are hereby mandated and authorized to
conduct regular, independent, unannounced and unrestricted
visits to or inspection of all places of detention and
confinement.
