Qureshi's statement comes at a time when Pakistan is blatantly threatening to approach the
ICJ against India over Kashmir after India abrogated Article 370, which gave special status to Jammu and Kashmir.
'Consular access for Indian spy Commander Kulbhushan Jadhav, a serving Indian naval officer and RAW (Research and Analysis Wing) operative, is being provided on Monday (September 2, 2019), in line with Vienna Convention on Consular relations,
ICJ judgement and the laws of Pakistan,' tweets the FO spokesman.
Barrister Qureshi explained the
ICJ, upholding the sentence awarded to Jadhav, had turned down India's plea for his release and repatriation.
However, bringing the matter before the International Court of Justice (
ICJ) may not be the best decision.
He went on to say that the decision of reaching out to
ICJ was taken after considering all legal aspects.
The Indian media quoted external affairs ministry sources as saying that 'Pakistan has been asked to provide unimpeded consular access to Kulbhushan Jadhav, in an environment free from fear of intimidation and reprisal, in the light of the orders of the
ICJ.'
If Pakistan had registered the law with the UN the involvement of the
ICJ would not have been possible.
In May 2017, India approached the International Court of Justice (
ICJ), asserting that Pakistani authorities were denying India its right of consular access to Jadhav in violation of Vienna Convention on Consular Relations 1963 also pleading for the court to quash the sentence, secure Jhadav's release and repatriation to India.
