In 1919, India was part of the British Empire - any copyright to the British-issued passport would fall under "Crown Copyright". British Indian Passport

The normal term of "Crown Copyright" and Copyright Made Easier strongly implies that the work (as it is not otherwise a "work of art" etc.) would be for 50 years from date of "publication". In the case at hand, I would argue that the Crown Copyright expired no later than in 1990, as 1940 is the presumed "year of publication."

IANAL, but in working for a major ISP, I was required to know a bit about how to deal with copyrights. I had to convince folks there that where a company sent an image for publicity purposes, they gave consent for use of the image for publicity purposes, as long as the copyright was acknowledged. This seemed to puzzle "corporate lawyers" who had never had to deal with companies seeking to have images published on-line before.

  • Interesting factoid - and not surprised: I suspect that the vast majority of people either don't know or don't care about how broad copyright protection goes. The passport itself certainly falls under Crown Copyright as it is produced and designed by the government, but the ID photo may be made by someone not connected to the government and merely used in the passport, so I would not by default assume that CrCo applies to a passport photo.   • Absent any identification otherwise, I understand that passport photos are not covered as "creative art" at all, so the copyright of any photographer (positing that it was remotely possible to identify the photographer) would be intrinsically weak.
For a photograph in general to have a strong copyright, some slight piece of originality is required. Passport photos, on the other hand, share all the originality of mugshots <g>.
And if the photographer in 1919 were known by name, the expiration of any claim on his part (which would require proof that he was, indeed, the photographer) would almost certainly have been on or before 1990. (As he did not object to it being published in 1940, the "clock" would quite certainly have started then and he would have had to raise the issue before 1990).
At this point, I suggest the "Crown Copyright" argument is compelling and sufficient. Collect (talk) 18:01, 29 June 2016 (UTC)
For the first point, File:Christoph Meili 1997-nonfree.jpg is PD in Switzerland because that kind of photo is too generic to meet Switzerland's copyrightability standard, as ruled by the Swiss Federal Court. For a British publication, the clock starts at the year of publication and expires 70 years plus the time to 1 January if the author is not credited and writes as a "work for hire" as part of a company. So a 1945 John Bartholomew & Sons cycling map is now out of copyright. However, if the author is explicitly named, the clock starts on the year the last author died, which means that a 1945 London A-Z Street Atlas, with copyright explicitly acknowledged as belonging to Phyllis Pearsall, is not going to expire until 1 January 2067 thanks to Mrs Pearsall living to a ripe old age. Now, Crown Copyright (ie: works produced for hire for a government body) only lasts for 50 years + time to 1 January, which means that a 1964 Ordnance Survey road map is out of copyright and can be freely shared, like here. While IANAL, I have spoken to staff in the British Library who agree with this understanding. Ritchie333 (talk) (cont) 10:37, 30 June 2016 (UTC)
In the hypothetical example - the passport is a "work for hire" possessing no modicum of artistry salient to a separate copyright and bearing no identification at all of the photographer, thus the Crown Copyright under current standards applies as of the date the 50 year limit was established? That copyright either expired in 1988 (counting the Crown's usage of the photo as "publication") at the earliest, and 1990 (50 years after general publication) at the latest?   4. Use the block ability sparingly. Enjoy the insults you receive when you do block, because really, what else is there to live for?

Hello and thank you for letting me know that several of the tree photos I've posted have been nominated for deletion. I saw the comment from user Fastily on each file, which says "Unused personal image, no encyclopedic use." I'm not sure what that means. I uploaded the images for use on various Wikipedia pages about tree species and about the cities/towns or historic places where the trees are located. Is the problem that there's a person in the photos along with the trees? I do that to better show the size of the tree, but I can use photos without people in them if that's an issue. Also, at the time that I uploaded these images, I think I hadn't started uploading to Wikimedia Commons yet - so if the problem is that I should have uploaded them to Commons instead, I can do that. I'm not so concerned about these being taken down; I'm more concerned about doing things correctly in the future. Thanks. --Msact (talk) 01:58, 8 July 2016 (UTC)

I'd say the chances of an innocent new user choosing a name so similar to a new admin's (congrats) unusual name, then editing AfD and archiving sockpuppet cases, are around zero. Deletion Mark OLoughlin page - I have made an error

Hi

I created the wiki page https://en.wikipedia.org/wiki/Mark_OLoughlin and realised an error. I had not included the apostrophe in my name. I had requested the above page to be deleted.

I then created a new wiki page under https://en.wikipedia.org/wiki/Mark_O%27Loughlin - the difference is the "O%27" in the url which represents the apostrophe in my name. I want to keep this page as it is the correct spelling.

Can you delete - https://en.wikipedia.org/wiki/Mark_OLoughlin

@Imahesh3847: Wikipedia aims at being an encyclopedia whose content can be freely reused, including commercially and derived images. Generally, copyright law works so that any right not explicitly granted is reserved, so without explicit permission for either we cannot assume the image is free enough for our policy.Jo-Jo Eumerus (talk, contributions) 20:20, 15 July 2016 (UTC)

Quick question

Hi, just thought I'd run this by an admin before boldly taking off with this idea - the latest Tech News title was bungled when the mass-message sender sent it out. I've got a semi-automatic (as in, I'm having to verify and click "Save" after every found occurrence) AWB task set up which will fix these.
