The article contains a detailed analysis of the current literature on the matter, the practice of international investment tribunals, and the main trends of international investment regulation.
A number of modern trends in the settlement of international investment disputes of an ecological nature are noted in this article. These include an attempt to reappraise the role of environment protection in the hierarchy of social values, an attempt to establish greater regulation of environmental relations, to expand the list of acts to be applied to international investment disputes with environmental components (by the addition of soft law and non-ratified international treaties), and even an attempt to classify environmental issues as being a public policy matter.
As a result, a number of authors are trying to assign a new responsibility to the investment tribunals – the protection of the environment. At the heart of this growing pressure on the tribunals, in the opinion of the author, is the fact that, despite the enormous relevance of the theme of ecology in the modern world, no universal system of settlement of environmental disputes and solving environmental problems has been established to date at the international level. At the same time, it is very unlikely that this global task complies with the special competence of the investment tribunals to resolve disputes between certain subjects and on certain matters.
The author concludes that only a combination of all markers (legality, fairness, proportionality, the presence of legal procedures, the payment of fair and effective compensation, nondiscrimination, and compliance with reasonable expectations of investors) makes it possible to assess whether there has been a violation of the rights of investors in the investment dispute with environmental elements.
Добросовестность в частном праве почти всесильна, ее отсутствие может разрушить сделку, привести к серьезным убыткам, отказу в защите права и т.п.
При этом понятие «добросовестность» не имеет универсального законодательного определения, и практически нигде законодательным образом не определяется. Напротив, добросовестность остается в числе общих положений частного права. Чаще всего определением критериев добросовестного поведения занимается суд или арбитраж. Поэтому критерии добросовестности выводятся путем всех доступных способов толкования закона.
В настоящей работе я попробую выделить основные критерии добросовестности для того, чтобы задать общий алгоритм судебного анализа поведения на предмет добросовестности.
