Divortium
Divortium est dissolutio matrimonii vel unionis maritalis, atque abolitio et/aut denuo constitutio officiorum et curarum legitimarum matrimonii, ergo vincula matrimonii maritorum sub lege eorum civitatis dissolvens. Leges de divortio late variant, sed in plurimis civitatibus divortium approbationem requirit iudicii vel alius auctoritatis per rationem legitimam effectam, quae res implicare potest alimoniae (subsidii coniugalis), custodiae liberorum, visitationis liberorum, temporis parentalis, subsidii liberorum, distributionis bonorum, et aeris alieni. In plurimis civitatibus, leges monogamiam poscunt, qua pro causa divortium sinit ut aliquis particeps se cum alio homine consociet; ubi autem polygynia legitima sed polyandria non est, divortium sinit ut mulier novo marito nubeat.
Divortium non confundendum est cum abrogatione, quae matrimonium cessavisse declarat; nec cum separatione legitima vel separatione de iure (ratione legitima ubi mariti separationem de facto rite agnoscere possunt cum iam legitime mariti), vel cum separatione de facto (ratione praeter leges ubi mariti cohabitare private desinunt). Causae divortii variant, ab incompatibilitate sexuali vel inopia libertatis unius vel amboum maritorum propter concursum personalitatum.[1]
Solae civitates quae divortium prohibent sunt Philippinae et Civitas Vaticana, respublica ecclesiastica, cui adeo non est ratio divortii. Civitates quae nuper sanxerunt ut homines divortium faciant sunt Italia (1970), Portugallia (1975), Brasilia (1977), Hispania (1981), Argentina (1987),[2] Paraguaia (1991),[3] Columbia (1991[4]),[3] Andorra (1995),[5] Hibernia (1996), Tsilia (2004),[6] Malta (2011).
