Part 1 entitled Palestine’s disputed rights under the Rome Statute, provides a historical review of Palestine’s attempts to accede to the Geneva Convention since 1982 and to assert its rights under the Rome Statute since 2014. This part covers preliminary examination of the Situation in the OTP by ICC Prosecutor Fatou Bensouda based on Palestine’s Article 14 referral, the pre-trial Chamber’s legal ruling on territorial jurisdiction over the OTP under Article 18(3); right up to the application for arrest warrants under Article 58 of the Rome Statute by Prosecutor Karim Khan in 2024.
Part 2 entitled Prosecutor’s Investigation of the Situation in the OTP provides observations on Prosecutor Ben Souda’s investigations of the situation in the Palestine under Article 15 and application for legal ruling under Article 18; a critique of Prosecutor, Karim Khan’s exclusion of war crimes committed by Israel before 2023 from his application for arrest warrant under Article 58 in 2024; analyzes shortcomings of the Prosecutor’s Panel of Expert Report in May 2024 and discusses implications of the Prosecutor’s investigations of Hamas under Article 56 of the Rome Statute.
Part 3 entitled ICC Proceedings on Article 58 Application for Arrest Warrants provides an overview of observations submitted by various States and organizations concerning the effect of the Oslo Agreement on the Court’s jurisdiction over the Situation in the OTP and the Prosecutor’s response to the observations under Rule 103. This is followed by a brief discussion on expected challenges from Israel and Palestine concerning jurisdiction and admissibility of the case under Article 19(2) of the Rome Statute.
