politically sensitive research within the militarized Turkish law enforcement context and reflect on the meaning of ‘discretionary use of force’ associated with national police services. This contribution advocates the need for police violence and human rights violations to be discussed within the debates of police sovereignty and the rule of law.
The chapter problematizes extralegal actions of police forces within the framework of Agamben’s concept of sovereign police. For Agamben, the police operate within the state of exception and exercise the power of sovereignty.60 Following this premise, the authors aim to theorize the sovereign police on three premises: the criminalization of enemy, the militarization of police and, finally, the discretionary use of force. Within this outline, they determine that in Turkey the police have been transformed into paramilitary units against certain internal enemies with the increasing use of discretionary power and stress that in accordance with the EU harmonization process in the 2000s, some judicial amendments in the police duties and anti-terror laws have only diffused the role of the police rather than restricting its sovereign character.
