This article analyses the origin of ius cogens rules through its evolutionary process in the Inte... more This article analyses the origin of ius cogens rules through its evolutionary process in the International Law Commission. In particular, the article includes the work of special rapporteurs dealing with the law of treaties project, in which the concept of imperative rules and ius cogens was studied. Some differences between these rules and humanitarian law have also been included.
According to Article 53 of the Vienna Convention on the Law of Treaties, a peremptory norm “is a norm accepted and recognized by the international community of States as a whole as a norm from which no derogation is permitted and which can be modified only by a subsequent norm of general international law having the same character”.

This article relates to “simplified agreements”, which are a special class of international agree... more This article relates to “simplified agreements”, which are a special class of international agreement that clarify treaty frameworks, that is to say, main treaties. Many simplified agreements occur outside the control of the Congress or the Constitutional Court. Theoretically, they should contain no state obligations other than those contained in the main treaty. However, the President of the Republic has executed a number of “simplified agreements” that are not, and which in fact contain new obligations for the Colombian state. These have been entered into without any control. The thesis of this article is to look at the procedures by which the President has managed a mechanism to elude and evade constitutional controls and have affected the fundamentals that ought to underlie the Constitutional Democratic State of Colombia.
This paper presents the historic evolution of peaceful dispute settlement in the American hemisph... more This paper presents the historic evolution of peaceful dispute settlement in the American hemisphere, and of the American Treaty on Pacific Settlement, also known as Pact of Bogotá, which is regulates the subject.
In the beginning, it describes the evolution of the theme from the wars of independence. Then it discusses the various meetings that were held during the first half of the twentieth century until the “Pact of Bogotá” was signed in 1948 and we present suggested amendments that, according to the Inter-American Juridical Committee, ought to be made to the Pact of Bogotá in order to improve its efficiency and to accomplish its objects and purposes.
The treaty is analyzed from the perspective of jurisdiction of the International Court of Justice, accordingly only articles related to this tribunal, and cases brought before it are analyzed in this article.

Queda claro que para los Estados “pequeños” que el mejor mecanismo de defensa de un Estado “chico” frente a uno “grande” es el Derecho.
