Neurocriminology

Neuroscience has identified brain structures and functions that correlate with psychopathic tendencies. Since psychopathic traits can be traced back to physical neural attributes, it has been argued that psychopaths are not truly responsible for their actions and therefore should not be blamed for their psychopathic behaviors. This experimental research aims to evaluate what effect communicating this theory of psychopathy has on the moral behavior of lay people. If psychopathy is blamed on the brain, people may feel less morally responsible for their own psychopathic tendencies and therefore may be more likely to display those tendencies. An online study will provide participants with false feedback about their psychopathic traits supposedly based on their digital footprint (i.e., Facebook likes), thus classifying them as having either above-average or below-average psychopathic traits and describing psychopathy in cognitive or neurobiological terms. De preventie van criminaliteit staat hoog op de maatschappelijke en politieke agenda.
Naast een juridisch speelt hierbij ook een psychiatrisch kader een belangrijke rol. De
laatste jaren gaat veel aandacht uit naar de neurofysiologie, neurobiologie en genetica.
Sommigen hopen dat op inzichten uit deze vakgebieden gebaseerde detectie-, interventie-
en beoordelingspraktijken beter en effectiever zouden zijn. Het is echter nodig om
tijdig te reflecteren op de mogelijkheden en beperkingen van een dergelijke aanpak en
ook op de ethische en maatschappelijke implicaties ervan. Dit artikel bespreekt implicaties
van achtereenvolgens de vroege detectie van risicokinderen en preventie van antisociaal
gedrag en beoordelingsprocedures pro Justitia van verdachten van een ernstig
vergrijp.

Social conditions, personal environment and biological threats should be studied together to understand and explain crime. However, this raises challenging questions and emerging concerns. Critics are concerned that there is a come-back of genetic determinism, Lombrosian and eugenetic ideas. According to Rose [1], however, this is not new eugenics but 'a control strategy that aims to identify, treat and control individuals predisposed to impulsive or aggressive conduct'. Although biosocial theorising is still often considered a dangerous approach within traditional criminology it is gaining momentum and is already being applied and piloted in some criminal justice settings in for example the United States and the Netherlands. Instead of ignoring or marginalising these practices, can we discuss and reflect on them? Can we talk about biosocial criminology?"

NEUROCRIMINOLOGÍA: DISCIPLINA EMERGENTE El discurso criminológico data desde el siglo XVIII época caracterizada por la deshumanización de las penas y los castigos ejemplares-crueles e inusitados. Como cuestión de hecho fueron evidentes los ejercicios de tortura y de pena de muerte existentes en el siglo anteriormente mencionado. El castigo asumió un rol estridente, inminentemente represivo y contumaz. Es decir de otro modo el imperativo categórico enunciado o defendido por Emmanuel Kant desde el contexto filosófico, ayuda en tanto a comprender o demandar conductas más edificantes para que a su vez se eviten castigos más ejemplares. El rol asumido debe destinarse desde el principio de preceptos normativos, reglas que tienen que ser observados desde la perspectiva moral institucional con fines curativos no selectivos. Dentro de la exclusividad ya señalada debe regirse el discurso científico en todas sus dimensiones, no obstante me interesa con carácter exclusivo el desarrollo y la dirección moderna de las neurociencias ligadas y en auxilio de otras disciplinas encargadas de los procederes conductuales. La neurocriminología es la ciencia que pretende aplicar la metodología y las técnicas al estudio de las neurociencias para comprender, predecir y tratar de prevenir la delincuencia y la criminalidad. Es decir, a grandes rasgos, se ocupa de explicar qué ocurre en el cerebro violento y qué alteraciones biológicas pueden producirse en el organismo, para que una persona pueda comportarse en forma violenta. El término fue introducido por James Hilborn y asentado por Adrian Raine, uno de los primeros científicos que desarrollaron estudios en neuroimagen con ofensores violentos. Los rigores criminológicos tradicionales tales como la ley, la reclusión, el castigo como único remedio curativo del crimen bajo ningún este concepto debe ser el modelo de intervención utilizado para tratar a los ofensores. La rehabilitación como precepto constitucional (art.VI, sección 19). No pueden ser impuestos bajo prácticas o ecuaciones antiguas, se requiere de toda una reformulación de nuevas políticas interventoras en las cuales se ausculten todos los escenarios posibles. Eso no quiere decir que olvidemos el principio, pero considerémoslo solo como el referente inicial la vida y las sociedades evolucionan (Darwin). Por tanto, debemos considerar todas las posibles circunstancias o causales para explicar una conducta antijurídica especifica. Los aspectos psicosociales y ambientales fueron desde en un principio el ''iceberg'' de la criminología y las llamadas ciencias del comportamiento. En un mundo extremo-globalizado-tecnócrata, requiere innovación, nuevos enfoques a problemas antiguos para la solución a las nuevas formas de delinquir. Soy fiel defensor de la utilización de nuevas corrientes y nuevos enfoques para tratar nuevos y viejos asuntos poco definidos que solo apuntar el teorema o la especulación. Asumo un rol distinto de estudio clínico científico-neurocientífico capaz de propiciar la mayor prognosis del porqué de determinada conducta y por tanto el porqué de tal modelo de intervención y tratamiento hasta ahora existente. Antonio Damasio experto en el tema de las emociones indica que más de la mayoría de los ofensores detenidos o intervenidos no son tan culpables de sus delitos, sino que existe un correlación significativa entre su delito y un posible defecto a nivel cerebral. Pero la justicia y la propia clínica no han sido capaz de auscultar con mayor preocupación dicho mal, entonces la justicia no puede quedar solo al amparo del derecho penal, necesitamos más que una regla 240 de procedimiento criminal, o circunscrita a la ley habilitadora de salud mental (408).

The main corpus of the present volume is offers case studies of institutions established or flourishing in the second half of the XIXth century, in the heydays of anthropology and ethnography, or within the context of a seemingly radical critique of their funding presuppositions, as it is the case with the relatively recent ethnographic museum of Suita, Osaka (1974). In spite of the variety and global coverage of the institutions selected (two in Italy, one in Argentina, one in Mexico and one in Japan), some common trends emerge: the far from linear history of the institutions concerned; the relation to the history of the countries where these institutions thrived more or less successfully; the question of the attitudes of living representatives of the ethnic groups on display; the thorny issue of the reclamation of human remains; and the questioning of the very existence of such institutions, as it is the case with the attempts to close down the Lombroso Museum in Turin. My comments will not necessarily follow the order of pagination of the various contribution, and will vary in length, for lack of competence on many of the issues covered in this volume, especially the ones concerning the Latin American and Japanese Museums.

The vision of legendary criminologist Cesare Lombroso to use scientific theories of individual causes of crime as a basis for screening and prevention programmes targeting forensic risk-individuals has resurfaced, following advances in genetics, neuroscience and psychiatric epidemiology. This article analyses this idea and maps its ethical implications from a public health ethical standpoint. Twenty-seven variants of the new Lombrosian vision of forensic screening and prevention are distinguished, and some scientific and technical limitations are noted. Some lures, biases and structural factors, making the application of the Lombrosian idea likely in spite of weak evidence are pointed out and noted as a specific type of ethical aspect. Many classic and complex ethical challenges for health screening programmes are shown to apply to the identified variants and the choice between them, albeit with peculiar and often provoking variations. These variations are shown to actualise an underlying theoretical conundrum in need of further study, pertaining to the relationship between public health ethics and the ethics and values of criminal law policy.

This article claims that neither indeterminism nor the so-called neuro-determinism provides an adequate response to the problem of criminal responsibility, highlighting the non-apprehensibility of the problem of freedom and the non-dehumanized image of man. At the same time this contribution proposes a solution from the point of view of humanist compatibilism based on some key assumptions and methodological anchors, such us the rejection of retributivism and the search for unified scientific responses.

Evaluating dangerousness in the age of neuroscience: how to measure risk without stigmatizing the individual? (translated from French)

L'évaluation de la dangerosité à l'ère des neurosciences. Comment mesurer le risque sans stigmatiser l'homme ?

The central question of this dissertation is the following: "What are the ethical dead ends and the societal drifts of the application of neuroscience in the field of social sciences in the age of risk, in particular, the evaluation dangerousness? ".

The objective of this dissertation is to shed original light on the theoretical and ethical issues of the articulation of neuroscience and social sciences, by focusing on the criminal justice system. Further, to identify avenues for reflection in order to better understand the context in which these issues arise.
From a methodological point of view, this dissertation consists of a literature review. On the one hand, it presents the correlation between neurobiological factors and antisocial and violent behaviour. On the other hand, it introduces how neurobiological factors explain the appearance of antisocial behaviour and the impact that this knowledge has caused on the assessment of an individual's dangerousness.
These findings have led us to question the place of neuroscience in the assessment of dangerousness or rather in predicting the risk that an individual may represent for society in a context where risk management faces a public opinion always demanding more security and proactivity in fighting crime.

Since the beginning of the twenty-first century we have seen an increase in the study of neurosciences, developing relations between that branch of the exact sciences and the study of the individual determinations toward crime: a return, under a new bias, to etiological explanatory theories centered in the individual. In this article we have the intention of pointing out the dangers of an unlimited acceptance of the new neurocriminological studies by the criminal sciences, namely the possibility of creating
a new label of “born dangerous” even before the subject practices or even consider the practice of a crime previously foreseen by an incriminating norm. We intend to explain the weaknesses of the most radical neurodeterminism, as well as to demonstrate that this thought – with the prevention of danger anchored in ideas of social defense – leads to the neutralization of preferential targets and generates inequality in criminal justice, based on abstract ideas (and not necessarily verifiable in concrete), with a backdrop of mere behavioral prognosis judgments and failure diagnostic techniques that are ineffective in their purpose: they do not prevent recidivism.

El sugerente libro que tengo el honor de prologar nace de la pluma de una investigadora muy cualificada, la Dra. Marta Mª Aguilar Cárceles, a quien tuve oportunidad de conocer con motivo de una estancia en el Instituto de Criminología de la Universidad de Cambridge en el año 2012. Dado que su campo de especialización calza a la perfección con el espectro de temas que hemos abordado en el proyecto “Derecho penal y comportamiento humano” (RTI2018-097838-B-100, financiado por MCIN/ AEI /10.13039/501100011033/ y por FEDER), ella aceptó amablemente integrarse en el equipo de investigación, de modo que la presente monografía, que a buen seguro no pasará inadvertida en la literatura especializada, aparece como uno de sus resultados. Como el lector podrá comprobar, la materia queda sistematizada en cuatro capítulos, dotando a la obra de una estructura sencilla al objeto de ir desde lo más general («Culpabilidad y transversalidad en la práctica jurídico-penal»), hasta lo más específico («Adicciones sin sustancia y control de los impulsos»), para, a partir de ahí, entrar en aspectos de enorme relevancia en el contexto actual marcado, como es sabido, por los avances en la investigación sobre el cerebro («Modus Operandi cerebral: Aportaciones desde la Neurociencia» y «Nuevas adicciones comportamentales e implicaciones para el Derecho penal»).

Recent research has detailed the use of neuroscience in several jurisdictions, but Australia remains a notable omission. To fill this substantial void we performed a systematic review of neuroscience in Australian criminal cases. The first section of this article reports the results of our review by detailing the purposes for which neuroscience is admitted into Australian criminal courts. We found that neuroscience is being admitted pre-trial (as evidence of fitness to stand trial), at trial (to support the defence of insanity and substantial impairment of the mind), and during sentencing. In the second section, we evaluate these applications. We generally found that courts admit neuroscience cautiously, and to supplement more well-established forms of evidence. Still, we found some instances in which the court seemed to misunderstand the neuroscience. These cases ranged from interpreting neuroscience as “objective” evidence to admitting neuroscience when the same non-neuroscientific psychiatric evidence would be inadmissible for being common sense. Furthermore, in some cases, neuroscientific evidence presents a double-edged sword; it may serve to either aggravate or mitigate a sentence. Thus, the decision about whether or not to tender this evidence is risky.
