ALCALA, of legal age, single, residing at 55 Blue Creek Place, The Woodlands, Texas, 77382, U.S.A. acknowledge: 1. That I am one of the heirs of CIPRIANO A. ALCALA JR. and CARMENIA RONDAIN ALCALA, both of whom died in Bacolod City on 30 March 2011 and 26 December 1987 respectively, leaving no will; 2. That both parents are survived by their children, all surnamed Alcala y Rondain, from the eldest to the youngest, as follows: 1) Carmelo @ Macho, (2) myself @ Chatty, (3) Caleb Lawrence @ Larry, (4) Carlo Martin @ Tinto, and (5) Calvin; 3. That at the time of their parents death, they each left their respective one-half share in a certain conjugal real property, situated in Galaxy cor. Jupiter Sts., Puentebella Subd., Taculing, Bacolod City, and particularly described as follows:
A parcel of land (Lot 9, Blk. 16 of the cons. subd. plan Pcs-2710, being a portion of the cons. of Lots 919 and 924 of the Cadastral Survey of Bacolod, G.L.R.O. Cad. Rec. No. 55), situated in the City of Bacolod, Island of Negros. Bounded on the NE by Street Lot 4 of hte cons. subd. plan; on the SE, by Lot 10, Blk. 16 of the cons. subd. plan; on the SW, by Lot 24, Blk. 16 of the cons. subd. plan; and on the NE, by Alley of the cons. subd. plan. Beginning ata point marked "1" on plan, being N. 6 deg. 46'W, 1197.59 m. from BBM No. 25, Bacolod Cad; thence N. 45 deg. 12'W, 25.00 m to point 2; thence N. 44 deg. 48'E., 40.00 m. to point 3, thence S 45 deg. 12'E, 25.00 m. to point 4; thence S. 44 deg. 48'W, 40.00 m, to the point of the beginning; containing an area of ONE THOUSAND (1,000) SQUARE METERS, more or less. All points referred to are indicated on the plan and are marked on the ground by PLS Cyl, Conc. Mons. bearings true; dec. 1 deg. 25'E, date of the orig. survey, March 1913 - March 1914 and that of the cons. subd. survey, Sept. 1 - Nov. 30, 1948 and Feb. 1 - July 31, 1949.
which real property, prior to Carmenias death, was transferred with no consideration by her and her husband Cipriano in my name, and is now covered by Transfer Certificate of Title No. T-151410 of the Register of Deeds of Bacolod City; 4. That about ten years after Carmenias demise, her surviving husband Cipriano remarried without previously liquidating the shares of the children in the parcel of land and improvements; 5. That Cipriano upon his demise left no issue with his second wife, Ester Lee Alcala; 6. That to the best of my knowledge and information both parents left no debts;
7. NOW THEREFORE, as a measure of magnanimity and leaving a legacy of fair-dealing to our descendants, I HEREBY RECONVEY the title held in trust by me in favor of the children of the late Cipriano and Carmenia, in pro indiviso share, under the following terms and conditions: a) Any one of the five heirs above-mentioned may opt a.1. out of the co-ownership by buying-out the other/s; or a.2. to sell his share exclusively to the other/s; Provided, that no such sale shall occur between any of the heirs and a stranger. For all intents and purposes, a stranger shall mean any person who is not a relative by consanguinity within the fourth civil degree of the five heirs; Provided further, that any sale to a stranger shall nevertheless be valid if concurred in by all of the five heirs, or in lieu of any of them should s/he die or become incapacitated, by his/her descendant/s. b) All of the five heirs above-mentioned shall, in proportion to their income, be equally liable for necessary and useful expenses of the property as well as its improvements. c) The immediately shall
