HANJIN Shipping has posted a document on its website stating that five of its containerships are being held off
Chinese ports as of September 26. Three of these ships are categorised as "arrested", as the vessels were detained
under court orders, Hanjin told Lloyd's List. They are the 4,253-TEU Hanjin Dusseldorf, the 9,000-TEU Hanjin
Sooho at the port of Ningbo, and the 6,100-TEU Hanjin Rotterdam at the port of Yantian. Another two ships are
categorised as "vessel departure/arrival not available", referring to vessels held by ports or terminal operators without
court orders, the spokesperson added. These two are 4,300-TEU Hanjin Kingston at Ningbo and the 3,560-TEU
Hanjin Turkey at Xingang. A further two ships - then 13,092-TEU Hanjin Green Earth and 2,900-TEU Hanjin
Piraeus - were 'under way' to Shanghai. The Hanjin Green Earth was scheduled to arrive in Shanghai at 1000 hrs
on Tuesday, but Lloyd's List Intelligence data showed the ship did not enter the port but was anchored offshore near
Shanghai. Hanjin Piraeus, currently sailing in the India Ocean, is due to call at Shanghai on October 3. Hanjin said
the company is trying to arrange for the two vessels to return to Busan - one of its designated "safe haven ports" - as
they cannot obtain China's approval for the injunction against attachment of assets obtained in its native South Korea
earlier this month. So far, Hanjin has secured nine 'safe haven' ports outside of Korea - Singapore, Hamburg, Long
Beach, Algeciras, Valencia, Oakland, New York, Seattle and Manzanillo - where its ships can safely unload their cargoes
without fear of arrest by creditors. But China remains an 'unfriendly' location, as the jurisdiction does not support
automatic recognition of overseas insolvency proceedings; neither does it provide other avenues like in the US, where
foreign companies such as Hanjin can apply for Chapter 15, according to Sloma & Co partner Zhou Qi. source:

Cases of vessel and crew abandonment are increasingly in the headlines, as freight rates sink to levels that can fail to
cover shipowners operating expenses.Traditionally, the mortgage bank would come to the crews relief, paying
outstanding wages and arranging repatriation. This was not so much altruism as recognition that the crew wages claim
already had priority over the mortgage, and the fact that a sale of the vessel would not proceed with a striking crew
on board who refused to deliver up possession. However, this solution to crew abandonment depended on there being
a mortgagee willing to take swift action and a local legal system with the rule of law which enabled enforcement of the

Norwegian Cruise Line is celebrating 50 years of operation this year. On December 19, 1966, the M/S Sunward made
her first voyage from Miami to the Caribbean signifying the birth of Norwegian Caribbean Lines. Now, as Norwegian
Cruise Line, the group is a global cruise brand with 14 purpose-built ships sailing to more than 300 destinations
worldwide. The cruise line was founded by Knut Kloster and Ted Arison, with just one 8,666-ton, 140m cruise ship/car
ferry, Sunward. Arison soon left to form Carnival Cruise Lines, while Kloster acquired additional ships for service in
the Caribbean. Norwegian pioneered many firsts in the cruise industry including the first combined air-sea program
(marketed as "Cloud 9 Cruises") which combined low cost air fares with the cruise. It was also the first cruise line to
develop new ports in the Caribbean, including Ocho Rios in Jamaica. Like the original Sunward of 1966, Norwegians'
second ship, the Starward had the capability to carry cars. Later, this area was turned into cabins and public spaces.
Norwegian made headlines with the acquisition of the France in 1979, rebuilding the liner as a cruise ship and
renaming her Norway. The conversion cost more than $100 million. At the time, the Norway was significantly larger
than any existing cruise ship, and exploited the extra space available by adding a greater than usual variety of onboard
entertainment. Her success paved the way for a new era of giant cruise ships. Norwegian has expanded to other parts
of the world, including Alaska, Europe, Bermuda, and Hawaii. Between 1997 and 2001 the company also operated
cruises out of Australia under the name
Norwegian Capricorn Line.Its subsidiary

On 14 September 2016, the Hong Kong Competition Commission published its first proposed block exemption order
(BEO) for certain liner shipping agreements, accompanied with a statement of preliminary views setting out reasons
for its proposed decision. This follows the BEO application made by the Hong Kong Liner Shipping Association (HKLSA)
on 17 December 2015. The Commission invites interested parties to submit representations about the proposed BEO
as well as the Commissions provisional position on the BEO application.
What is a BEO?
Under section 15 of the Competition Ordinance (Cap. 619) (the Ordinance), the Commission may issue a BEO for a
category of agreement (which has potential to harm competition) where it is satisfied that such category of agreement
enhances overall economic efficiency. Agreements that fall within the scope of a BEO will be exempted from the
application of the first conduct rule (click here for our Hong Kong Competition Law Investigation Series to learn more
about BEO).
What does the proposed BEO cover?
The Commission intends to issue a BEO for vessel sharing agreements (VSAs), but not for voluntary discussion
agreements (VDAs), which were both sought to be exempted. VSAs are agreements between shipping lines on certain
operational arrangements (i.e., joint operation of liner shipping services, capacity adjustments and joint operation or
use of port terminals and related services), and are often compared to code-sharing or alliance agreements of airlines.
VSAs in the simplest form may provide for the transfer or reciprocal exchange of container slots, while more
sophisticated VSAs may include coordination of the parties respective sailing schedules and the operation of joint
services. On the other hand, VDAs are agreements between carriers for other commercial issues relating to particular
shipping routes. They provide for the exchange and review of market information, supply and demand forecasts and
business trends, and may also involve the issuance of pricing recommendations. The Commission considers VSAs
generate sufficient economic efficiencies to justify exclusion from the application of the first conduct rule, in that they
result in, among other things, increased quality of service (through broader service coverage and higher service
frequency), costs efficiencies and decreased costs of entry and expansion. In contrast, it was not considered that rate
stability, service stability and rate and surcharge transparency as claimed to be benefits arising from VDAs justify the
grant of an exemption. Under the proposed BEO, activities undertaken pursuant to VSAs will be exempted if (1) the

With ship finance from the traditional lending base more difficult for many to access since the global financial crisis,
Asian finance has increased in prominence globally. Within this wider trend, one recent development has been Chinese
leasing companies providing finance under not only traditional financial leasing structures, but also under an operating
lease model.
An Emerging Source
In the main, activity by Chinese leasing companies in the shipping sector has been undertaken through financial lease
arrangements, under which the lessee typically manages the unit, takes ownership at the end of the lease, and
generally is regarded as the primary owner of the unit. However, there has also been a trend towards Chinese leasing
company activity under an operating lease model. Here, the leasing company retains ownership of the vessels at the
end of the charter period, with the assets remaining on the lessors balance sheet. Since the start of 2013, Chinese
financial leasing companies have accounted for orders of around 12.2m GT under operating lease models, about a
quarter of tonnage ordered by Chinese owners.

NSW's second major cruise ship terminal will be built in the Port of Newcastle. The $12.7 million multi-purpose
terminal will be 3000 square metres and similar in scale to Sydney's White Bay Terminal. The Hunter region will be
able to grab a bigger slice of the growing cruise ship industry once the facility is built, Premier Mike Baird said on
Tuesday."This project secures the future of cruise shipping in Newcastle and gives the city and the region the
opportunity to compete for the growing east coast tourism trade," he said. Local tourism officials have been lobbying
the state government foryears for a permanent facility to be built to replace the temporary marquee. The Queen
Elizabeth liner had to rotate almost 360 degrees so it could reverse into a berth at the port earlier this year. "The
new terminal will not only attract new cruise ships to the annual cruise season but could also be used as a home port
for cruises, which means for the first time passengers could start and end their journeys in Newcastle," Planning
Minister Rob Stokes said. The terminal's construction and associated flow-on economic activity is expected to generate

The Transocean Winner grounded on the Isle of Lewis during a storm last month.
An oil rig which ran aground in the Western Isles will be moved onto the back of a huge ship this week before being
taken to Turkey and dismantled. The 16,000-tonne TRANSOCEN WINNER grounded near Carloway on Lewis during
a storm on August 8. It was towed to safety two weeks later and taken to Broad Bay on the far side of the island. The
colossal OHT HAWK, which arrived in the islands last week, will sink below the surface of the bay and the Transocean
Winner will be towed into position above it. The 60,000-tonne vessel will then rise slowly back to the surface, lifting
the rig onto its back. Work to remove the eight anchors weighing the Transocean Winner down in Broad Bay gas
already begun, a process which will take around 24 hours. The operation was expected to be completed on Friday but
could continue until yesterday Saturday. Salvage expert Hugh Shaw, who is overseeing the move, said: "Our
intention all the way along has been to get this operation under way without endangering life or the environment
around. "All the preparation work has been done in anticipation of this moment so that we could be ready when the
time comes as it now has." Coastguard aircraft will survey the area for pollution during the operation. Two of the
Transocean Winner's four fuel tanks ruptured in the collision and spilled about 53,000 litres of diesel into the sea. Most

What's believed to be the world's first masters degree in decommissioning has been launched by the University of
Aberdeen in partnership with Robert Gordon University. Both universities said today that they are developing a suite of
joint masters degrees focusing on key aspects associated with safely dismantling old oil rigs and platforms such as
engineering, project management, business, law and health. It comes ahead of a wave of decommissioning across the
UK North Sea which experts estimate will be worth between 30bn to 60bn. The recent oil price rout has led to some
of these platforms being retired sooner-than-anticipated. Unions urged the government to ensure the UK is able to
benefit from the North Sea's multi-billion pound break-up, after a decommissioning contract for an oil platform in the
UK North Sea went to a Norwegian firm earlier this year. Professor Ekaterina Pavlovskaia from the university of
Aberdeens school of engineering said: "The climate is right for us to launch this innovative Masters degree in

third ship of TSHD 1000 design, on 5 October 2016, says the shipbuilding company First two ships of TSHD 1000

Krasnoye Sormovo shipyard was signed in April 2014 with the assistance of MNP Group The TSHD 1000 was designed

GLASGOW's Ballast Water Containers (BWC), a Malin Group company, has recently begun trials with its Seaforth
containerised ballast water treatment system.Designed for the heavy lift, logistics and barge owners, the Seaforth
Ballast Water Treatment is portable being held in a 20-foot shipping container.The Seaforth system is designed to
complement existing barge ballasting operations. It does this through the treatment of the sea-going ballast intake or
discharge using a mobile deck mounted solution."This ensures that existing barge equipment, such as portable deck
mounted ballast pumps and load out/in operations, remain largely unchanged," said the company statement. Said
Malin managing director John MacSween: "The IMO Ballast Water Management Convention, will enter into force in
September 2017 leaving many barge owners with a real headache around compliance. "In the current depressed
freight market, the cost for outfitting every barge with a complaint, on board system is, in many cases, prohibitive, and
in some, impossible."Our system offers an alternative means of compliance and allows owners to buy time and either
defer or remove significant portions of CAPEX altogether,?said Mr MacSween. Each system can treat up to 500 cubic
metres of ballast water per hour which provides more than enough capacity for typical heavy lift sea-going ballasting
operations, which usually have a pumping requirement of 200-300 cubic metres per hour. The system also has the inbuilt capability of treating multiple ballast tanks at once via auto flow balancing technology."To minimise the risk of

Freight rates for very large crude carriers (VLCCs) are set to rise further next week, fuelled by a raft of cargoes from
West Africa and the Middle East amid tight tonnage supply, ship brokers said on Friday. VLCC freight rates hit a multimonth high on Thursday. The optimism among owners is punchy - I think the market has legs on it and could easily
increase by another 10 points (on the Worldscale measure)," a European supertanker broker said on Friday. That
would be a rise of around $10,000 per day in earnings for a VLCC from the Middle East to Asia, freight rate data on the
Reuters Eikon terminal showed. "Rates have come from $10,000 per day and owners have been able to whack it up to
$20,000 day. They have doubled earnings in a week - this momentum is not something you can easily curb," the
broker said. The momentum picked up after the number of supertanker cargoes from West Africa climbed by around
25 percent since on Shell lifted force majeure on Bonny light crude exports from Nigeria on September 6, 2016 "West
Africa is the big change with 10 extra cargoes compared with a normal month," a second European supertanker broker
said.The number of cargoes from West Africa is expected to rise next month with eight cargoes of Qua Iboe crude oil
from Nigeria, under force majeure since a pipeline issue in July, scheduled to be shipped, according to loading plans
shown to Reuters. Exports of Qua Iboe crude could rise further in November with 285,000 barrels per day (bpd)
provisionally forecast, according to an initial loading programme "There are still cargoes to be done from West Africa
with three or four for October loading. There have been 40 plus cargoes so far from the Middle East in the 10 days to
October 20," the second tanker broker said. There could be a similar number of fixtures for the final 10 days of
October."October will be a big month. A lot of ships dispersed from the Middle East to West Africa which has thinned

Brazil may let state-led oil company Petrobras sell stakes in offshore oil blocks, known as transfer of rights areas, to
help finance their development, a move that will require a change in the law, an energy ministry official said on Friday.
Developing the 5 billion barrels of oil and equivalent gas rights that Petrobras purchased in 2010 in the areas, also
known as the Cessao Onerosa, would be far easier and put less strain on Petrobras if it was done with partners, Oil
