EO 191 Fact Sheet
It is an executive order directing all eighty-six (86) barangays in Butuan City through the Punong
Barangays and their Councils to strictly implement Waste Segregation and Reduction at Source, and the
establishment and operationalization of the barangay Materials Recovery Facility (MRF) in accordance to
RA 9003 and for other purposes. This shall apply to all residential houses, Institutional, Commercial and
Industrial establishments within the City of Butuan.
The City Government of Butuan has recognized that the solid waste management problem or
garbage problem has grown to an alarming proportion that threatens the health, sanitation and even
safety of constituents. Thus, EO No. 191 Series of 2016 is created to implement RA 9003 or The
Ecological Solid Waste Management Act of 2000 and SP Ordinance No. 2380 - 2002 to insure the
protection of republic health and sustain the cleanliness of the environment and promoting the practice
of 3 Rs (Reduce, Reuse and Recycle) principles thereby, ensuring the protection of the environment and
ensuring sustainable development.
The City Mayor, Eng. Lagnada, has also enjoined all barangays to follow the order as provided
for under Republic Act (RA) No. 10121 or An Act strengthening the Philippine disaster Risk Reduction
and Management System, Providing for the National Disaster Risk Reduction and Management
Framework and Institutionalizing the National Disaster Risk Reduction and Management Plan,
Appropriating Funds Therefor and for Other Purposes," and RA 7160 or An Act Providing For a Local
Government Code of 1991" in implementing this executive order.
It is signed and effective on the 27th day of July 2016 by Eng. Ronnie Vicente C. Lagnada, the City
Mayor of Butuan City.
2. How are the solid wastes of Butuan City managed according to the EO No. 191 Series of 2016?
The following are the summary the flow of solid waste management of Butuan City:
1st. The Barangay Constituents/ Residents/ Members shall dispose their waste according to
the barangays platform and mechanism of disposing waste as communicated through the
barangays household or stakeholder based orientation on proper waste segreation and
waste management.
2nd. The Barangay shall collect the solid wastes and be brought to the Materials Recovery
Facility (MRF) for segregation. The biodegradable and compostable waste shall be dealt and
subjected to the barangays mechanism of composting. The residual and special waste shall
be separated and shall be available for pick-up by the city government.
3rd. The City Government through the CENRO shall manage the collection of the residual
wastes from the Barangay MRF for disposal in the Sanitary Landfill Facility (SLF). The City
Environment and Natural Resources Office-Ecological Solid Waste Management Division will
be responsible in transporting and dumping the residual or segregated waste at its final
destination at the Dumalagan Sanitary landfill.
3. What is a Materials Recovery Facility (MRF)?
Section 32, Article IV of RA 9003 and Section 24 of SP Ordinance No. 2380 2002 mandates that
there shall be established a Materials Recovery Facility (MRF) in every barangay or cluster of barangays
for finals sorting, segregation at source.
Materials Recovery Facility (MRF) is where the waste segregation and waste reduction programs are
implemented in the barangay level where the Punong Barangay is primarily responsible. It is also called
the Barangay Pick-up Points where the city government shall limit the collection to residual and
special wastes. For the biodegradable and compostable wastes, the Punong Barangay shall be
responsible to establish the platform and mechanism for the composting such wastes in the barangay
level.
4. Who are the key persons and stakeholders for the implementation of EO No. 191 Series of 2016?
5. What are the responsibilities of the Industrial, Commercial and Business Establishments under
this order?
According to Section 11 of EO No. 191 Series of 2016, industrial and commercial establishments
operating in the City must comply with the necessary standards set forth by the government regulatory
agencies including the setting up, if possible, water treatment facilities. There must me an institutional
ecological solid waste management plan which will be revisited and updated yearly to form part of the
requirements in the issuance of business permit by the City Mayor. The institutional ecological waste
management plan will be monitored by the City Government through the CENRO.
6. What are the responsibilities of the LGU for Barangay in the implementation of this order?
According to the Section 4(a) of the Executive Order No. 191 Series of 2016, the Barangay shall:
i. Be the primary responsible for the compliance of waste segregation and waste reduction at
source, particularly at the household, institutional, commercial or business establishment
levels; conduct household or stakeholder based orientation on proper waste segregation
and waste reduction.
ii. Apprehend violators and cause the necessary filing of cases in accordance to existing laws.
iii. Ensure that a Barangay Material Recovery Facility (MRF) is established and operational with
a sustained mechanism of regular collection of segregated wastes from the source.
iv. Establish platform and mechanism for the composting of biodegradable waste in the
barangay level, if not from the source; ensuring that only residual wastes are left.
v. Designate a Focal Person to closely monitor and evaluate the efficiency and effectiveness of
the implementation of the solid waste management at source and in the barangay level.
vi. Establish and engaged the Barangay Ecological and Solid Waste Management Committee
(BESWMC) which will comprise all stakeholders including, but not limited to, the
representatives of homeowners association, Non-government Organizations, business
establishments and other stakeholders.
vii. Promote environmental entrepreneurship and assist in the establishment of Multi-Purpose
Environment Cooperatives or Association as provided in Section 13 of RA 9003 in
coordination with the City Cooperative Development Office.
viii. Mobilize the stakeholders in the barangay through the Peoples Council to provide volunteer
works and assist the barangays in keeping it clean and green.
ix. Regularly render report to the Office of the Mayor, through the City Environment and
Natural Resources Offices (CENRO) with the following content:
1) Status of garbage problem in the barangay.
2) Initiatives undertaken by the barangay to enhance the implementation of solid
waste management in its jurisdiction.
3) The identities of apprehended violators of RA 9003 and related ordinances and
issuances on this effect.
4) Persistent problems/ issues that need to be address with the help of the City
Government and NGAs.
5) Recommended actions that should be undertaken to improve the enforcement of
RA 9003 and other related laws and issuances.
7. What are the responsibilities of the City Government through the CENRO and other enforcing
agencies in the implementation of this order?
According to the Section 4(a) of the Executive Order No. 191 Series of 2016, the CENRO shall:
i. Manage the collection of residual wastes from the Barangay MRF for disposal in the Sanitary
Landfill Facility (SLF).
ii. The Green Ground, Zero Waste Program of the CENRO shall ensure continuing capacity and
capability building including the needed information, education and communication (IEC)
components to ensure the proper management and handling of ecological solid wastes.
iii. Provide technical assistance in maintaining established MRF and in constantly improving the
MRF facilities of the Barangays through the City Engineering Office.
iv. Augment the needed resources of the different Barangays to ensure the efficacy of the
implementation of RA 9003 and other related laws and issuances.
v. Exact accountability and institute disciplinary actions, administrative or criminal, for
Barangay Captains and other Barangay Officials who will fail, by virtue of omission or
commission, to manage the ecological solid waste from the source.
The Barangay Bantay Kahinlo Brigades Volunteers (BBKBV) is created through Executive Order No.
191 Series of 2016 which shall be headed by the Chairperson of the Barangay Committee on
Environment or Clean and Green Committee and shall be organized in the different barangays on the
City by the Punong Barangay.
i. Assist the Punong Barangay, CENRO, the PNP in the enforcement of RA 9003 to keep and
maintain a clean barangay.
ii. They may apprehend violators and report their identities to the BBKBV Chairperson in the
Barangay who in turn will report to the Punong Barangay or PNP to do the necessary
investigation and determination of the corresponding penalty under existing laws,
ordinances and issuances.
9. What is the Incentives and Reward System in the EO No. 191 Series of 2016?
In order to motivate the respective barangays and the City ENRO, in consultation with the EMB and
other stakeholders of ecological solid waste will prepare an incentive and reward system with the
corresponding mechanics for the approval of the City Mayor. The categories of the incentive and reward
system can be, but not limited to:
10. What are the Administrative Sanctions provided under EO No. 191 Series of 2016?
Barangay officials of the barangay who will not implement the applicable provisions under RA 9003 may
be subjected to disciplinary actions through administrative proceedings. The City Mayor, by exercising
his power for administrative supervision over the Barangays provided for by RA 7160, may reprimand,
warn or suspend the Punong Bangay of barangays who are found to be not compliant to the mandate of
RA 9003.
