OWNER/OPERATOR DRIVER AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This Agreement made and entered into by and between:
_____________, of legal age, Filipino, (single / married), and a resident of

_____________, Philippines, (hereinafter referred to as the
"OWNER/OPERATOR");
- and
_____________, of legal age, Filipino, (single / married), and a resident of

_____________, Philippines, (hereinafter referred to as the "DRIVER");
WITNESSETH; That
WHEREAS, the OWNER/ OPERATOR is the owner of VEHICLE (description of

the vehicle);
WHEREAS, the OWNER/OPERATOR agrees to operate the said vehicle and

the DRIVER is willing to drive the same;
NOW THEREFORE, for and in consideration of the foregoing premises, the

OWNER/OPERATOR let out unto the DRIVER and the DRIVER hereby accepts
from the OWNER/OPERATOR the let out vehicle, subject to the following:
TERMS AND CONDITIONS
1. PURPOSES: That vehicle hereby driven shall be used exclusively by

the DRIVER for commercial purposes only and shall not be diverted to
other uses. It is hereby expressly agreed that if at any time the vehicle are
used for other purposes, the OWNER/OPERATOR shall have the right to
rescind this agreement without prejudice to its other rights under the law.
2. TERM: This agreement is for ONE (1) YEAR from (Date) to (Date)
inclusive. Upon its expiration, this agreement may be renewed under such
terms and conditions as my be mutually agreed upon by both parties,
written notice of intention to renew the agreement shall be served to the
OWNER/OPERATOR not later than seven (7) days prior to the expiry date
of the period herein agreed upon.
3. COMPENSATION: The monthly compensation for the Driver shall be
Fifty percent (50%) of the Net Income of the Vehicle assigned to him.
4. CHANGEOVER: The DRIVER shall not directly or indirectly sublet,

allow or permit the vehicle to be driven by any person, neither shall the
DRIVER assign its rights hereunder to any other person or entity and no
right of interest thereto or therein shall be conferred on or vested in
anyone by the DRIVER without the OWNER/OPERATORs written approval.
5. ACCOUNTABILITY: In the event when violation/s or reckless

imprudence resulting to damage of property is committed, the DRIVER
shall bear all the damages. If proven otherwise, the Owner/Operator shall
bear the fifty percent (50%) of the amount of damages and the other fifty
percent will be shouldered by the Driver.
6. FORCE MAJEURE: If whole or any part of the leased premises shall

be destroyed or damaged by fire, flood, lightning, typhoon, earthquake,
storm, riot or any other unforeseen disabling cause of acts of God, then
this agreement may be terminated without compensation by the DRIVER.
7. OPERATOR'S RIGHT TO USE: The OWNER/OPERATOR or its

authorized agent shall after giving due notice to the DRIVER shall have the
right to use the vehicle in the hands of the DRIVER or its representative at
any reasonable hour to examine the same or make repairs therein or for
the operation and maintenance of the vehicle or to exhibit the same to
prospective DRIVER, or for any other lawful purposes which it may deem
necessary.
8. JUDICIAL RELIEF: Should any one of the parties herein be

compelled to seek judicial relief against the other, the losing party shall pay
an amount of One Hundred (100) % of the amount claimed in
the complaint as attorney's fees which shall in no case be less than
P50,000.00 pesos in addition to other cost and damages which the said
party may be entitled to under the law.
9. This AGREEMENT shall be valid and binding between the parties, their
successors-in-interest and assigns.
