CONTRACT AGREEMENT
THIS CONTRACT AGREEMENT, made this 3rd day March 2016 between the
Municipality of Tanauan, Leyte, herein after called the “ENTITY” and ESPG BUILDERS
Tacloban City herein after called the “CONTRACTOR.
WHEREAS, the ENTITY is desirous in the completion of the work under Contract ID
No. 001 – 2015CW REHABILITATION OF TANAUAN PUBLIC MARKET herein after
called the “Work” and the same has accepted the Lowest Calculated and Responsive Bid
for the execution and completion of the said Work Calculated in the unit price shown in
the attached Bill of Quantities for a total bid price of Twenty Four Million Three Hundred
Eighty Nine Thousand Seventy Seven pesos (P 24,389,077.00) only.
NOW THE CONTRACT AGREEMENT WITNESSTH AS FOLLOWS:
1. In the CONTRACT AGREEMENT, the words and expressions shall have the
same meaning as are respectively assigned to them in the Conditions of
Contract herein after referred to.
2. The following documents shall be attached, deemed to form and be read and
constructed as part of this Contract Agreement.

Specifications
Invitation to Bidders
Instruction to Bidders
Bid Data Sheet
General and Special Conditions of the Contract
Supplemental Bid Bulletin (if any)
Contractor’s Calculated Bid in the Form of Bid including its technical and
Financial Proposal
Notice of Award and the Contractor’s “conforme”
Corresponding Securities (Bidders Bond and Performance Security
PERT/CPM Diagram
3. In consideration of the Payments to be made by the “Entity” to the

“Contractor” as herein after mentioned, the “Contractor” hereby covenants
with the “Entity” to execute and complete the “Works” and remedy any
defects therein in conformity with the previsions of this Contract Agreement
in all respects
4. The “Entity” herby covenants to Pay the “Contractor” in consideration of the

execution and completion of the “works”, the unit prices in the Contractor’s
Calculator Bid as applied to the actual quantities accomplished as Certified by
the Procuring Entity under the provisions f this Contract Agreement at the
times and in the manner prescribed by this Contract Agreement.
IN WITNESS hereof the parties hereto have caused this Contract Agreement
to be executed this 3rd day of March 2016

upgrading of PNP 8 Infirmary Hospital Camp (Camp kangleon) under IB No. 2011-10,
as per BAC Resolution NO. 2011-45, your proposal was found to be the Lowest
Calculated & Responsive Bid with a Total Contract Price of Five Million Two Hundred
Fifty Five thousand Nine Hundred Ninety Two Pesos & 33/100 (Php5, 255,992.23)
You are hereby requested to post your Performance Security equivalent to the
percentage of the total contract price of the acceptable forms as listed below within ten
days from receipt of the notice od award. A pre-construction meeting shall be requested
with the LGU and DOH – HFEP Representative for the implementation of the project.
