People VS Abano

G.R. No. L-57184-85 November 14, 1986

FACTS:
Eugenia Tolero Abano and Agripino Abano were married in 1948. The two were separated three
years before the commission of the crimes dated February 1980. Eugenia stayed in their
conjugal home while Agripino live with another woman named Bienvenida Cumad 400 meters
away from the conjugal home. Behind the conjugal home there was a pig pen occupied by
Rodolfo Abano, son of Eugenia and Agripino, together with his family.

One night, Concordia saw her mother in law with Eliseo Cabana and Teofilo Cabana partaking
their supper at her mother in law’s house. At the same night, Concordia awakened by someone
pulling her hair. It was Eliseo with his son Teofilo. The former ordered her to bring them to her
father in law’s house, they instructed her to tell Agripino that his son Rodolfo need to see a
doctor because the latter was suffering from stomachache. Agripino went downstairs and
hacked to death by Cabanas. The paramour also went down to check her partner but also
hacked. Both died.

Rodolfo narrated that his mother revealed to him that she hired Cabanas to kill Agripino and his
common-law wife. Also, the Cabanas revealed that it was Eugenia who hired them.
