PEOPLE VS CAYAGO Y REYES (GR No 128827; August 18, 1999)
However, when the accused was about to undergo a polygraph test the next day, he requested
permission to go to the church near Camp Crame. Thereafter, he confessed to the police accompanying
him that he killed his wife and was willing to give his statement relative to the said killing. He also
admitted that he attempted to confuse the authorities as to the true cause of his wife’s death by
removing all her clothing and making it appear that she was raped.
During the trial, the accused denied the intentional killing of his wife. The accused claimed that he
embraced his wife so that but did not notice she had stopped breathing due to the tightness of the
embrace. However, for killing his own wife through strangulation and with evident premeditation,
accused was convicted for parricide.
Thereafter discovering the victim’s body, Zinampan requested the accused to identify and verify the
body. The accused verified the body of the victim as his wife through the shoes worn by the deceased.
While at the crime scene, Zinampan questioned the accused regarding the identity of the latter’s wife
killer. The statement of the accused was also taken thereafter at the police headquarters wherein
several inconsistencies were noted by the interrogating group. Thus, it was then advised that a
polygraph test should be conducted to the accused at Camp Crame the next day.
However, the the accused was apprehended and convicted due to his voluntary confession and
surrender as to the crime committed. The accused was then convicted for parricide. The caused of death
was strangulation which was corroborated by the accused’s own confession and the medical findings
and the attempt to make it appear that she was raped through the lacerations in the vaginal opening
and uterus.
