STAMP DUTY: HOW TO DO IT FROM THE COMFORT OF YOUR HOME

Every legal relationship starts with the existence of a contract or agreement executed between two or
more persons, whether natural or juridical. An agreement thus becomes the source of all powers
conferred and the duties imposed on the persons choosing to enter into such relationship, much like
what the Constitution does to the citizens in the nation. An Agreement constitutes to be one of the most
important pieces of evidence when a dispute arises.

NEED FOR PAYING STAMP DUTY:


For an Agreement to be considered as a material piece of evidence, a certain pre-requisite comes into
picture: the Stamp duty. As per the Section 3 of the Indian Stamp Act, 1899, every instrument
mentioned under the Schedule 1 to the Act needs to be adequately stamped. Many of these entries in
the Schedule are our day-to-day Agreements like an Agreement to Lease, an Affidavit, an Adoption deed
and so on and so forth. The law requires us to pay stamp duty to the central or state government when
certain transactions take place, such as buying, selling or leasing property, business agreements, making
deeds, etc., that has a financial aspect to it.
This payment is done through the purchase of stamp paper and is proof that the government has been
paid its share, for future reference.

Though various types of instruments are executed by millions of Indians in different states every day,
much of them go unregistered and unstamped. A huge part for this is the lack of awareness about the
need for stamp duty and registration to legalise the documents. Ignorance and laziness being other
factors.

Stamp duty paid on Agreements and Contracts contributes to a phenomenal chunk of the revenue
earned by the States. According to an article published by The Economic Times1, Revenue from stamp
duty collection in Maharashtra fell by Rs 1000 Crore in the year 2017 as compared to that in 2016.

DIFFERENT WAYS OF PAYING STAMP DUTY:


Stamp duty can be paid in three ways:

i. Using the e-stamping facility;


ii. Using papers bearing impressed stamps (non-judicial stamp paper); and
iii. Using a franking machine.
One has to note that not all three forms of paying stamp duty are applicable to every state. However, if
one state allows all the three alternatives, it is upon the individual to opt for the form most suited to
them for payment of Stamp duty.

E-STAMPING
This Article is focused on the initiative taken up by the Government of India in collaboration with the
Stock Holding Corporation of India Limited (SHCIL) to tackle counterfeiting and to facilitate an easy
route for purchasing and paying stamp duty in the way Indians love to do almost every other thing:
Online.

The Central government has appointed the Stock Holding Corporation of India Limited (SHCIL) as the
Central Record Keeping Agency (CRA) for all e-stamps used in the country.

Currently, SHCIL is responsible for everything-from user registration to administration, all e-stamping
applications and maintenance of records. SHCIL has also designated authorised collection centres, or
ACCs-scheduled banks-that will issue certificates to users.

THE PROCEDURE
The process of paying stamp duty online through SHCIL is quite as simple as it could get. It has to be
noted that this facility is currently available only in select states including Delhi, Gujarat and Jharkhand.

The detailed procedure is as given below:

i. VISITING THE WEBSITE OF SHCIL:

 One can visit the website of SHCIL for paying e-stamp duty at the web-address:
https://www.shcilestamp.com
 If already registered with the website, user can login using the secure login option. For first
time users, select Online Payment.

 On selecting the “Online Payment” option, the website prompts a pop-up which lists the states
that currently offer e-stamping option. Click “OK” to move to the sign in page.

ii. SIGN-IN PAGE:


 The next step is to sign-in to the website of SHCIL. For registered users, the Sign-in section is
provided. One has to enter their User ID and password, followed by the case-sensitive Captcha
to log in to their account.
 For first time users, the option to register appears next to the sign-in section.

iii. REGISTRATION FOR FIRST TIME USERS:


 On selecting the “Register Now” option, the web page takes you to a form which requires to be
filled with personal details like preferred User ID, Password, Security Question, Name, etc.
 On filling the details and submitting the same, the website will send a verification email to the
email ID provided by the user.
 User needs to verify the email provided by clicking the link in the email sent.
 On successfully verifying the email ID, the user will need to log in to the account created on the
website.

iv. LOG-IN TO ACCOUNT CREATED:


 Log in to the Account by inputting the User ID and password created in Step iii.

v. STAMP DUTY REQUESTS:

 Once logged into the account, the user can start the process of paying stamp duty by “creating a
stamp duty submission”.
 This option for creating a submission appears on the left side of the page.

 The page then displays then requires an input on the state in which the stamp duty is to be paid.
 Once the state is selected, user has to select from two options: registerable stamp duty or non-
registerable stamp duty.
 Select the instrument from the available options and proceed to the next step.
vi. DETAILS:
 The next page requires information with respect to the purchaser of the stamp paper and the
instrument against which stamp duty is being paid.
 Fill in all the requisite details.

vii. PAYMENT:
 The next step is payment of Stamp duty.
 This page informs the user of the applicable charges and the available options to make the payment
online, including use of debit card and net banking facility.

 Once the payment option is selected and the payment is processed, the user will be redirected to the
page of acknowledgement where the receipt of payment of stamp duty can be printed.

viii. This receipt can then be used to collect the e-stamp paper from the nearest branch of the stockholding.
THE RESULT
Online transactions have made it possible to sit in the comfort of one’s own home and carry out
functions that otherwise took a lot of manual labour. Things that required hours of efforts now take a
few clicks and an internet connection.

In the era of online transactions becoming a part of people’s everyday life, the initiative to enable paying
of stamp duty online, might just be the smartest move from the Government. Not only does this help in
promoting stamp duty without actually being present in the registrar’s office, but would also be an aid in
not only maintaining an accurate database of the revenue generated through payment of stamp duty,
but also in curbing counterfeit stamp papers and important instruments going unregistered.
