AWARD

[1] This is a complaint of non-compliance pursuant to Form S filed under s. 56 (1) of

the Industrial Relations Act 1967 & Rule 24 A of the Industrial Court Rules 1967 on 27

June 2019 in the matter of Industrial Court Case No. 21/4-312/16 (Award No. 1898

of 2018 dated 9 August 2018) between Murad Bin Yahya v. Avenue Cafe Sdn.

Bhd.

[2] A complaint is hereby lodged by the Complainant that the provisions of the

abovementioned Award have not been complied with in respect of paragraph 19 where

the Court orders the Company to pay to the Claimant through the Claimant's solicitors

Messrs Aziatul & Associates the sum of RM63,840.00 (less statutory deductions if

any) within 30 days from 9 August 2018.

[3] The Complainant contends that the Complainant or his solicitors did not receive
any payment of the award sum or any part thereof from the Respondent. The
Complainant claims against the Respondent for the payment of the awarded sum of
RM63,840.00 and that the said awarded sum is to be paid forthwith.

Decision:

[4] The order of compliance is hereby allowed. The Court unanimously orders the

Respondent to pay the Complainant the sum of RM63,840.00 (less statutory

deductions) forthwith.
