    Sir,
    As per reference no.02,second EOT proposal from contractor is received by mail
    containing five(05) pages only.He has submitted the copy to Hon.Chief Engineer/Superintending
    Engineer/Executive Engineer also.
    About the proposal given by contractor reference no.02:-
    1. The contractor mention the reason for delay are false. Which can confirm by
    Authority as per record please.
    2. The first Extension of Time 309 days i.e till 31.05.2020 was signed and agreed
    by contractor. Original record can prove it and which is approved by
    competent Authority.

    4. The contractor is habituated to capitalized the minor things also.So the


    change of scope proposals which are submitted already as per directives of
    Authority are to be get sanction at an earlier.
    5. About force majeure this office has already submitted the detail say as per
    reference no.05.

    About the approval received under reference no.03


    The approval is accorded subject to (iv) a,b,c conditions which are yet to
    execute by contractor.
    Comments of Authority Engineer:-
    The total length of project is 48.60km.As per record of Authority only 4.75km length is
    to be handover and pending for Land Acquisition.Which delay is due to Revenue
    Department.So it clearly means that the length of 43.85km road part is available to
    contractor and expected to complete the work in that at least.
    The Original time limit was upto date 26.07.2019.Then first EOT is sanctioned upto
    31.05.2020 as the above said 4.75km were not handed over and due to delay by
    contractor. Today also 4.75km are yet to handedover by Authority.In other way it was
    expected to complete the work in 43.85km which are with contractor.But still the works
    are not completed.For which it is essential to penalize the contractor from
    date26.07.2019 though extension is given to him.

    At present lockdown is going on from 22.03.2020 to 03.05.2020 due to Covid-19.i.e


    43 days.The works in 4.75km require 60days time period to complete.
    It clearly means that due to Authority and Government extra time period of 103 days
    or 04 months is to be given to contractor with all benifits.But except these 120days the
    contractor should be penalize as per articleno.10.3.2 and 10.3.3 from
    date27.09.2019.Also with consideration of some minor hinderances it is recommended
    to approve the time extension up to 31st Dec.2020.
