Pag sinabing payment na mode of extinguishing an obligation it may refer to delivery of money or

performance in any other manner of an obligation.

So pwede yung layman’s term na alam natin

Pero under the civil code pag sinabing payment it may also refer to performance kaya sinabing
payment or performance.

Kapag sinabing performance it may consist giving of a thing or doing or not doing an act.

So tandaan natin technically speaking pag payment obligation --- to give.

Pero kapag performance obligations ----- to do.

The creditor is not bound to accept payment or performance by a third person who has no interest
in the fulfillment of the obligation, unless there is a stipulation to the contrary.

Whoever pays for another may demand from the debtor what he has paid, except that if he paid
without the knowledge or against the will of the debtor, he can recover only insofar as the payment
has been beneficial to the debtor.

Unahin natin yung first paragraph. Pag binasa mo tong article 1236

You will see that creditor has the right to refuse payment by a third person.

And sabi diyan the creditor is not bound to accept payment or performance by a third person.

So you can conclude that the creditor has the right to refuse payment by a third person.

Except in two instances.
