Sections 447 (a)(5) (xvi), 458 (a)(5)(xvi), and 468 (a)(4) (viii) of Republic Act
(RA) No. 7160, otherwise known as the "Local Government Code of 1991" or
LGC,provided as part of the powers, duties, and functions of the Sangguniang Bayan,
Sangguniang Panglungsod and Sangguniang Panlalawigan respectively, the approval of
the ordinances that shall ensure the establishment of a local council whose purpose is
the promotion of culture and the arts, coordinate with government agencies and non-
governmental organization and appropriate funds for the support and development of
said council, subject to availability thereof.

Consistent with the above-stated purpose is the protection, preservation, and


promotion of cultural heritage and the ethnicity of local communities. In line with this,
the DILG-OSECspecial provisions under Republic Act No. i0924 or the General
Appropriations Act of 2017 mandated DILGto ensure the establishment of the local
council. To strengthen the LGU as a cultural institution, its obligations prescribed in the
National Cultural Heritage Act of 1009 are hereby rationalized as one of the functions of
the Local Culture and Arts Council.

2.0. Purpose

The purpose of this Memorandum Circular is to enjoin all provinces, cities and
municipalities to legislate for the establishment of a Local Culture and the Arts Council,
implement related projects and/or strengthen existing ones thereafter.

3.0. Legal Compliance

3.1. DILGMemorandum Circular No. 2002-81 dated May 17, 2002;


3.2. DILGMemorandum Circular No. 2013-98 dated September 10, 2013i;
3.3. DILGMemorandum Circular No. 2017-53 dated March 22, 2017ii;
3.4. Section 34 and Special Provision NO.6 for DILG-OSECof Republic Act No.
10924 or the General Appropriations Act of2017
3.5. Sections 447 (a) (5)(xvi), 458 (a) (5) (xvi), and 468 (a)(4) (viii) of the LGC;
3.6. Section 12 (7) of Republic Act (RA) No. 7356, otherwise known as the Law
Creating the National Commission for Culture and the Arts

The aforementioned provision provides that the National Commission for


Culture and Arts (NCCA),in cooperation with various agencies such as the
DILG, is mandated to undertake a systematic collection of statistical and other
data which reflects the state of cultural conditions in the country, to serve as
essential quantitative and qualitative basis for formulating cultural policies.

3.7. Sections 2(a) and (b), 5, 12(c), 14, 14(b), 15, 16, 18(a) and 33 of Republic Act
No. 10066 or the National Cultural Heritage Act of2009;
3.8. Sections 1, 6 of Republic Act No. 7355 or Gawad ng Manlilikha ng Bayan
3.9. Chapter 7 a/the Philippine Development Plan 2017-2022

4.0. Scope/Coverage

All Provincial Governors, City, and Municipal Mayors, DILG Regional


Directors, the Regional Governor of the Autonomous Region in Muslim Mindanao
(ARMM),and all others concerned are covered by this Memorandum Circular.

5.0. Policy Content and Guidelines

The composition and functions of the Local Culture and the Arts Council are as
follows:

Composition

Members: Chairperson, Sangguniang Committee on Culture and the Arts

Local Cultural Officer or equivalent


Local Planning and Development Officer
Local Information Officer
Local Budget Officer
Local Tourism Officer
Representative, Department of Education (DepEd Division)
Representative, Commission on Higher Education (CHED)
Representative, Technical Education and Skills Development
Authority (TESDA)
Representative, Philippine Information Agency (PIA)
Representative, Local Tourism Council
Representative, Local Historical/Heritage Society or any
sectarian organization, if any
Representative, Local Museums
Representative, Local Artists Groups
Representative, Business Sector or Chamber of Commerce
Representative, Professional Sector Representative, Academe

Representative, Youth Sector


Representative, each from Indigenous Peoples and Cultural
Communities present in the area Representative, NCCA

Functions

As per DILG Memorandum Circular No. 2002-81 or The Creation of Local


Culture and the Arts Council:

a. Prepare an annual plan on culture, arts, and cultural heritage consonant with
the Philippine Development Plan for Culture and the Arts, to be integrated in
the local development plan and considered in the annual appropriation
ordinances;
b. Formulate programs and recommendations to develop and sustain local
cultural and artistic talents, cultural industries, traditional and contemporary
arts and crafts, and their processes;
c. Coordinate with the appropriate affiliated cultural agencies of the National
Commission for Culture and the Arts (NCCA) for the conservation and
monitoring of national cultural properties found in the LGU;

d. Conduct cultural events such as cultural festivals, competition, lectures,


seminars and symposia;
e. Identify such other programs and activities for the promotion of local
cultural heritage and arts;

As per Republic Act No. 10066 or The National Cultural Heritaoe Act of 2009:

f. Ensure the protection, preservation, conservation and promotion of the local


cultural and historical heritage;
g. Declare and maintain Local Heritage Zones;
h. Establish a Local Registry of Cultural Property;

As per Republic Act No. 7355 or The Gawad no Manlilikha no Bavan Act:

i. Acknowledge the importance of traditional folk artist as singular conduit


between skills of the past and the future;
j. Revitalize a community's artistic tradition thereby protecting a valuable fact
of Philippine culture;
k. Provide mechanisms for identification and assistance for qualified
traditional folk artists to transfer their skills to the community; and,
l. Create opportunities for popularizing their works locally.

6.0. Penal Provisions

Any violation of this prOVISIOn shall be dealt with accordingly in accordance


with applicable Civil Service Rules and Regulations, Administrative Code and other
pertinent laws.

7.0. Responsibilities ofthe DILGBureau of Local Government Development

7.1. Develop a monitoring scheme to ensure LGUcompliance to this Circular.

7.2. Consolidate all submitted quarterly reports for its submission to the Office of the
Secretary.

7.3. Assume the role of the focal Bureau, for any queries and future amendments
relative to this Circular.

8.0. Responsibilities of the Regional Directors and the ARMM Regional


Governor, through the DILG-ARMMSecretary

8.1. Cause the immediate and widest dissemination, compliance and monitoring of
this Memorandum Circular within their regional jurisdictions;

8.2. Ensure that this issuance is effectively communicated to concerned legal


authorities; and,

8.3. Exercise administrative oversight pursuant to Memorandum Circular dated April


1, 2008, entitled, the Exercise of General Supervision over Local Government
Units.

8.4. Coordinate with BLGD in the monitoring of LGU compliance to this Circular
and submit quarterly reports of said compliance to the Office of the Secretary
through the BLGD.

9.0. Reportorial Clause

The concerned Local Government Units shall furnish the DILGand NCCAa
copy of their resolution creating the Local Culture and Arts Council within 15
days thereafter and Quarterly Reports on its compliance on the first week of the
succeeding quarter.

10.0. Repealing Clause

All DILG Memorandum Circulars, directives, orders, or other related issuances


inconsistent herewith in part or in full are hereby revoked or repealed accordingly.

11.0. Effectivity

This Memorandum Circular shall take effect immediately.
