    PETITION
    COMES NOW THE PETITIONER, through the undersigned counsel and
    unto this Honorable Court, most respectfully avers:

    1. That the Petitioner is of legal age, married, a Filipino citizen and a


    resident of Parola, Brgy. Taft, Surigao City, Surigao del Norte,
    Philippines. A copy of his residence certificate issued by the aforesaid
    barangay is hereto attached as Annex “A”;

    2. That on January 1, 2021, Petitioner executed a Holographic Will in his


    own handwriting in English, a language known and understood by the
    Petitioner. A copy of said holographic will is hereto attached as Annex
    “B”;

    3. That Petitioner is leaving several properties indicated in the said Will to


    persons specifically named therein exclusively, namely: MARIA DELA
    CRUZ - the wife, and to his children - AIDA DELA CRUZ-RIZAL,
    LORNA DELA CRUZ and FE DELA CRUZ, Filipinos, of legal ages and
    residents of Kaskag, Brgy. Washinton, Surigao City, Province of Surigao.

    4. That the said holographic will was executed, dated and written by the
    Petitioner himself freely and voluntarily, and without any undue
    influence from anybody whatsoever;

    5. That the Petitioner has no known debts, and he co-owns several


    properties registered under the name of his wife MARIA DELA CRUZ;

    6. That Petitioner hereby appoints the undersigned counsel as the


    administrator for all his properties, in aftermath of eventual demise.

    PRAYER
    WHEREFORE, premises considered, it is respectfully beseeched upon this
    Honorable Court that the judgment be rendered declaring that after due notice and
    publication, to fix the date for the probate of the Holographic Will, and that such
    other reliefs be granted as may be deemed just and equitable under the
    circumstances.

    1. I am the Petitioner in the above-captioned case;

    2. I cause the preparation of the instant Petition for the Probate of my


    Holographic Will;

    3. I fully understood its contents based on my knowledge and as to the


    records that I am aware of;

    4. There is no pending Petition involving the same or similar issued before


    the Court of Appeals, the Supreme Court, or any tribunal or agency;

    5. Should I learn thereafter of any such pending Petition, I undertake to


    inform this Honorable Court within five (5) days from knowledge
    therefrom.
