    JOINT AFFIDAVIT OF DESISTANCE

    We, the Heirs of ENRIQUE N. MADDELA, Heirs of RICHARD M. CORTEZ, JOEL L.


    PARAISO, and CAROL M. LACBAYAN, all Filipino citizens, of legal ages, and residents of
    Solano, Nueva Vizcaya, after having been duly sworn to in accordance with law depose and
    state:
    1. That we are the private complainants in Criminal Case No. 6883 for Reckless
    Imprudence Resulting in Multiple Homicide, Serious Physical Injuries, and Damage
    to Property entitled: “People of the Philippines vs. Virgilio Fuerte y Cabaccan” and
    which is pending with the Municipal Trial Court of Bambang, Nueva Vizcaya;

    2. That after our sober and soul-searching assessment and analysis of the case and its
    surrounding circumstances, we realized that to obtain closure from the painful
    experience we had involving our love ones, we considered the incident as the will of
    the Creator, and to blame no one for the accident;

    3. That we have decided to collectively and permanently withdraw our complaint


    against Virgilio Fuerte y Cabaccan, and we clear him of any responsibility or liability
    to us;

    4. That we hereby inform the Office of the Provincial Prosecutor that we are
    withdrawing our complaint filed at the Municipal Trial Court of Bambang, Nueva
    Vizcaya, and we further affirm that we are desisting in prosecuting the case, the civil
    aspect of the case, having been resolved amicably with the accused;

    5. That we fully understand the legal consequences of this Affidavit of Desistance;

    6. That we are executing this Affidavit to attest to the truth of the foregoing statements
    and respectfully pray that the aforementioned case against Virgilio Fuerte y Cabaccan
    be dismissed.
