1. BASIC REQUIREMENTS AND PROCEDURES


1.1 PRE-CONSTRUCTION

1.1.1 TURN OVER OF LEASED PREMISES


The LESSOR shall inform the LESSEE of the schedule of actual turn-over of the leased premises. During the
turn-over, LESSOR shall identify the condition and existing utilities present inside the leased area to be
specified in the turnover form that will be handed over to the LESSEE for conformity and acceptance. Once
the leased area is turned over to the LESSEE, its contractors and authorized representatives can start
conducting detailed ocular inspections, actual measurements of the area and verification of existing utilities to
be used for preparation of fit-out or construction plans.

1.1.2 PRE-CONSTRUCTION MEETING/TECHNICAL BRIEFING


LESSEE is required to have their contractors and authorized representatives to attend Pre-fit out meeting or
technical briefing with our technical group for clarifications and implementation of guidelines. During the
meeting, the LESSOR’s technical group shall thoroughly discuss the Fit out Guidelines to the LESSEE, to which
the LESSEE shall strictly comply with and implement within the leased area and LESSOR’s premises. Other
technical details concerning the construction plans of the LESSEE maybe discussed as well.

1.1.3 SUBMISSION OF LESSEE’S WORKING DRAWINGS OR PLANS


LESSEE is required to submit the following for comments and approval:

a. Two (2) sets of colored perspective showing the store front of the stall in A3
sized paper.
b. Two (2) sets of scaled floor plan and signage details within the band in A3
sized paper.

Once approved, the tenant may proceed with the detailed working drawings on the standard plan size of
20”x30” for construction and building permits. (IF APPLICABLE)

1.1.4 CONSTRUCTION BOND


Upon approval of the submitted working drawings, LESSEE shall pay a refundable Construction Bond, which
amount is indicated in the Contract of Lease or Award Notice. Construction Bond is required to cover
deductions for any related liabilities and deficiencies by the LESSEE regarding the fit-out or construction of its
leased premises. Release or refund of the Construction Bond net of deductions shall be made after
completing all documentary requirements.

2.2.3 ELECTRICAL

on allotted load by LESSOR

e. Complete materials and technical specifications
f. General Notes, Legend, Vicinity and Key Plan.
g. All works shall be in accordance with the Phil. ElectricalCode 2009 and other applicable local
Government regulations.
h. Other relevant drawing

Note: All electrical plans must be signed and sealed by a registered electrical engineer (IF APPLICABLE)

2.2.4 MECHANICAL (IF APPLICABLE)


a. Ventilation system – showing Exhaust and Fresh Air tapping connection to existing
Systems
b. Technical Specifications of Range Hood
c. Other relevant drawings

2.2.5 FIRE PROTECTION (IF APPLICABLE)


a. Location of fire extinguisher.
b. Specifications

2.2.6 SIGNAGE

2. LESSOR’S PROVISIONS
After the Award Notice is signed, the LESSEE may inspect the premises being leased before actual
turnover. Any discrepancies or obstructions to the existing facilities discovered in the leased premise
during fit out shall be referred in writing to the LESSOR for proper action.

2.1 UTILITIES/FACILITIES PROVISION

a. Electrical Provision-30amps, 230volts, 1-phase/ 60hzpowersupply/3 wires (2-5.5mm² + 1-


3.5mm²) with neutral andground in nema1 enclosure with KWHRmeter(100% Emergency supply)
b. Common Wash Area

3. DESIGN STANDARDS
3.1 ARCHITECTURAL DESIGN CRITERIA

3.1.1 KIOSK STRUCTURE

a. Tenants are encouraged to be creative on their design to enhance their identity


provided that the standard concept or look will be complied.
b. Kiosk dimension should 2.0 meters width by 2.0 meters depth. No portion of the
Kiosk shall extend past the designated leased area.
c. Access door is required. Access door should be at the LEFT side facing the kiosk.
d. Counter height should be 0.9 meters. No counter shall be lower or higher than 0.9
meters.
e. Counter top width should be 0.60 meters only.
f. Counter top should be solid surface only such as granite, stainless steel or ceramic
tiles. Plywood and Laminated surface is strictly prohibited.
g. Caster/Cart wheels may be allowed as long as it is not visible in front.
j. Signage should be illuminated and 3-dimensional.
k. Signage wordings should ONLY be limited to store’s approved trade name. Any
deviation shall be subject to LESSOR’S approval.

l. No signs, advertisements, notices or any other lettering shall be exhibited, inscribed,
painted or affixed to any part of the signage unless it has been specifically approved
by the LESSOR.
m. Neon lighted signs, plastic, acrylic or any painted design concepts are not allowed.
n. Use only NON-COMBUSTIBLE type of materials for the signage box or
band.
o. Submit shop drawing for Lessor’s approval prior to fabrication.
p. See sample layout attached for your reference.

3.1.2 MENU BOARD

a. Menu list and prices should be displayed properly and printed clearly. No standard
size for the menu as long as it is readable and presentable.
b. HAND WRITTEN menu list and prices are NOT allowed.
c. Menu board should be located at the left side of the counter, facing the kiosk, as seen on
the sample layout attached.

3.1.3 WALLS

a. Chipping and boring on walls and floors are not ALLOWED.


b. Back wall is required for cover. Dimension should be 1.2 meters Height by 2.0 meters Width
by 0.10 meters Depth.

3.2 ELECTRICAL DESIGN

Electrical Power System Voltage:

KIOSK: 30amps, 230volts, 1-phase/60hz power supply/ 3wires( 2-5.5mm² +1-3.5mm²)with


neutral and ground in nema 1 enclosure with KWHR meter (100%Emergency supply)

a. All electrical installation shall be provided with tagging and/or color coded insulated wires
(verify on site). LESSEE is required to provide equipment rating based on voltage rating
specified above, NO equipment other than the voltage rating stated is allowed.
b. The LESSOR already provided the electrical provision in the area located at the left side of the area.
Seek assistance when ready to tap.
c. The LESSEE shall pay the necessary electrical and meter deposit prior to the start of the construction.

3.2.1 Electrical drawings must include the following:

a. Power Riser Diagram/ Single line diagram.


b. Load Schedule and Computation.
c. Power and Lighting Layout.

3.2.2 All wiring should be inside conduits, EMT, RSC, and IMC. PVC pipes and open wirings are NOT allowed.
Chipping and coring on floors are NOT allowed.
3.2.3 For lighting and power wiring requirements, the minimum size of wire allowed is 3.5mm2
THHN/THWN (stranded). Use of “Flat cord” is NOT allowed.
3.2.4 Use “Flexible Metallic Conduit” for the termination of wires to the lighting fixtures,
convenience outlet and equipments. Limit installation termination maximum of 1meter
length. Use of “Mica Tube” is NOT allowed.
3.2.5 For External Exhaust (Range Hood within area) termination, use “ Weather tight flexible
metal conduits”.

3.2.6 All junction boxes and pull boxes shall be provided with cover for protection or physical damage.
Use Gauge 16 and galvanized materials for all boxes.
3.2.7 The use of LED Light is required. “Fluorescent fixtures”, use rapid start with high power factor
(HPF) ballast. INCANDESCENT BULBS are NOT allowed.
3.2.8 For “Circuit Breakers”, all breakers shall have a minimum of 14kAIC rating. Use bolt-on type
circuit breakers (CB) only on branches and Industrial type CB’s for the Main Circuit breaker
(MCB) for the panel board requirements. The maximum capacity of the electrical load must
not exceed 80% of the circuit breaker capacity. (IF APPLICABLE)
3.2.9 All equipment and installation must be provided with grounding. Provide “Tagging and/or
Color- coded wires for identification.
3.2.10. Conduct standard electrical testing such as Ground test, Megger (insulation) test, Continuity
test, Load and Balancing test, Voltage test, etc. and it must be attested and witnessed by
building maintenance prior to energizing of permanent electrical power supply.

Electrical design shall be done in accordance with the latest edition of the Philippine Electrical
Code and the Laws and Ordinances of the Local Code of the enforcing authority.

3.3 MECHANICAL DESIGN

Mechanical Plans must include the following:

a. Exhaust System layout (IF APPLICABLE)


b. Equipment layout, technical details and schedule.

3.3.1 EXHAUST SYSTEM (IF APPLICABLE)

3.3.1 LESSOR provided the Exhaust System tapping point. LESSEE shall submit exhaust connection
detail for approval by Admin.
3.3.2 All odor and moisture producing areas and high heat producing equipment and appliances
must be connected to mechanical ventilation system (exhaust/fresh air).
3.3.3 Location and routing of ductworks for exhaust shall be designated and/or approved by
LESSOR.
3.3.4 LESSEE with cooking equipment should be provided with exhaust hood.
3.3.5 Exhaust hood duct should be Black Iron (B.I.) Gauge 16 metal sheet a n d should be
provided with grease filters and oil collector.

3.4 FIRE PROTECTION

3.4.1 Provide at least 2units- 10lbs. ABC Dry Type Fire Extinguisher. (The type and number of Fire
extinguisher may vary in accordance to Fire Safety Permit requirement)
3.4.2 Any accidental damages during ingress, Tenants contractor should inform the Admin immediately.

4. DURING CONSTRUCTION

4.1 APPROVALS (IF APPLICABLE)

4.1.1 LESSEE shall submit THREE (3) sets of complete plans to Metro Pointe Center Admin.
Incomplete plans shall not be considered for review.
One (1) set of approved (with COMMENTS) plan SHOULD always be available at the site.
4.1.2 Any addition or change on approved construction plans, the LESSEE is required to submit
revised plans for approval by the LESSOR prior to any implementation. No construction or
renovation works must commence without any approval.
4.1.3 LESSOR and/or his duly authorized representative have the right to inspect construction work
at any time to ensure that works conform to the approved plans.
4.1.4 Any deviation from submitted approved plans or works implemented without LESSOR’S
approval, the LESSOR and/or his representative shall have the authority to stop or ceased
works until request for change /alterations have been approved.
4.1.5 In case of material workmanship defects or actual work does not conform to the approved
plans or work being done that may impair safety, the LESSOR shall require LESSEE to redo the
work.

4.2 PERMITS (IF APPLICABLE)

4.2.1 Upon approval of construction/renovation plans, the LESSEE shall apply and secure all
necessary government permits and work permits required BEFORE and AFTER construction.
4.2.2 Welding, fabrication, demolition and/or other critical activities necessary for the
construction, LESSEE’S CONTRACTOR is required to provide a letter of request for Admin
approval.
4.2.3 After the final Contractor’s briefing, the Tenant shall secure work permit from the Building Admin.

4.3 CONSTRUCTION INSURANCES (IF APPLICABLE)

4.3.1 LESSEE shall secure a CONTRACTOR’S ALL RISK INSURANCE (CARI) COVERAGE, from insurance
company acceptable to the LESSOR with a combined single liability of range as stated in first
part of Construction Guidelines. The Lessee shall submit to Leasing Office copy of the policy
and corresponding official receipt (OR).
4.3.2 The LESSEE and its contractor shall submit lists of name of workers and corresponding
authorized representative, Engineer In-charge to work in the leased premise, to the Admin
Office.

4.4 TAPPING POINTS

4.4.1 Tapping points and stub-outs for electrical were already in-place.

4.5 PUBLIC SAFETY (IF APPLICABLE)

4.5.1 The LESSEE shall provide a 10lb.dry chemical ABCUL/FM approved fire extinguisher for every leased
space. However, in no case shall the LESSEE provide less than two (2) units.
4.5.2 LESSEE shall confine the construction work within the leased premise.
4.5.3 Work shall be conducted in an orderly manner at all times.
4.5.4 Construction debris and trash are to be taken out of the construction site and from the
leased premise on a daily basis.The site will not provide any temporary debris area.
4.5.5 PENALTY CHARGE of PhP2,000.00 will be imposed to any of LESSEE’S Contractor for ALL
violations incurred.
4.5.6 No work, construction materials or equipment shall obstruct the hallway or sidewalks of the site.
4.5.7 LESSOR shall not be held liable for any damage or injuries sustained by the workers and third
parties and any losses during the span of construction.

4.6 CONSTRUCTION WORKINGHOURS/MOVEMENTS/DELIVERY

4.6.1 If building is operational:

a. Work shall be restricted to between 8:00pm to 2:00am (time varies). In cases where
there is need to expedite construction, the LESSEE or it’s Contractor may request for
overnight works, indicating the activities to be undertaken and the proposed time
allocation. All works to be scheduled beyond the store hours is subject for approval by
the Building Administration Office. Should the contractor fail to conduct the said
overnight works as scheduled, an additional charge of TWO THOUSAND PESOS
(Php2,000.00) per day of overnight work representing security expenses shall be
charged against the contractor.

4.6.2 If building is not yet operational:

a. Work schedule is not limited; however, LESSEE should inform LESSOR its work scope.
Kindly coordinate with the Building Admin.
4.6.3 Delivery/Unloading of various construction materials and supplies should be directly
delivered into the Lessee’s leased area.
4.6.4 The LESSEE and its contractor shall be responsible and/or liable to any repair/damages that might
occur during the period of construction. (i.e. Common areas, hallway, corridors, and/or
public areas), and shall be charged accordingly depending on the extent of the damaged
made.

4.7 WORKERS’ DISCIPLINE AND PROHIBITIONS

4.7.1 Contractors are required to be in uniform at all times while inside the building’s premises.
4.7.2 Contractors’ workers are required to follow and abide the buildings’ rules and regulations.
4.7.3 The LESSEE shall be fully responsible for performance and behavior of contractors’ workers
while inside the site and/or vicinity premises.
4.7.4 Contractors shall strictly follow rules and regulations of the site and/or building especially
regarding hygiene and sanitation.
4.7.5 Workers are strictly prohibited from staying in, bathing, washing clothes, bringing of pets
or game animals, carrying deadly weapons, holding pot/drug sessions, creating public
disturbances, fighting, gambling, indecent exposures, littering, loitering, smoking and
vending.
4.7.6 Observe security and safety measures.
4.7.7 Penalties for workers not complying with the above shall be:
a. First Offense: Written and Verbal Reprimand
b. Second Offense: A fine of Php1,000.00 will be implemented and be deducted from the
construction bond (PAYMENT TO BE MADE BEFORE issuance of Notice to Operate).
c. Succeeding Offenses: A fine of Php 5,000.00 per Violation.
4.7.8 An additional of Php1,000.00 penalty (per incident per inspection) for the non-compliance of Good
Housekeeping within the job site for the entire construction period.
4.7.9 LESSEE or their contractor will be required to pay all the penalties before the issuance of Notice to
Operate.

4.8 FINAL INSPECTION OF THE PREMISE

4.8.1 The LESSEE shall request in writing to Admin Office for the final inspection of leased area at
least seven (7) days prior to any projected store opening.
4.8.2 The LESSOR’S representative and LESSEE’S representative will conduct the Joint Final
Inspection.
4.8.3 The LESSOR will prepare joint PUNCHLIST REPORT based on conducted inspection.
4.8.4 The LESSEE shall have at least three (3) days to prepare all necessary rectification needed
within for LESSOR to approve and make the final evaluation on the readiness of the area.
4.8.5 The LESSOR reserves the right not to let LESSEE operate due to non compliance of the
above guidelines.

5. POST CONSTRUCTION /PRE-OPERATIONPERIOD


Prior to store opening, the LESSEE is required to submit at least TWO (2) sets each of the following
documents to the Leasing Department. However, if documents are not immediately available, the
LESSEE should comply within THIRTY (30) days, all documents after the store opening of thefollowing:

5.1 Mayor’s Permit / Business Permit to Operate.


5.2 BIR POS Permit. POS should be registered with Bureau of Internal Revenue (BIR) and should
have BIR POS Permit.
5.3 Final Inspection Checklist

5.4 Certificate of Occupancy and Fire Safety Insurance Certificate (FSIC).


5.5 Comprehensive General Liability Insurance (CGLI) (Coverage for BODILY INJURY and PROPERTY
DAMAGE to third parties) and Fire Insurance Coverage. Submit copy of the policy and official
receipt.
5.6 Complete as-built plan/ drawing of all trade/disciplines for records purposes.
5.7 Electronic File (AutoCaddFile) and PDF version of As-Built Plans of all trade/disciplines, saved as
AutoCadd LT /2010 version.

6. Waiver

6.1 The LESSOR reserves the right to waive any rule in this document for the benefit of any particular
LESSEE. Such waiver shall only be done in order to expedite completion of the project. It is done with
the agreement that the LESSOR is not liable for any and all damages that may result from such waiver.

6.2 The LESSOR reserves the right to add, cancel and/or revise any and all provisions contained in
this document. The LESSOR shall duly inform the LESSEE in writing of such changes within a
reasonable period of time.
ACKNOWLEDGMENT

I hereby acknowledge receipt of any copy of the Construction Guideline and Renovation Rules of Metro
Pointe Center and agree to abide by the same.
