CHAPTER 2

REVIEW OF RELATED LITERATURE

Law is an imperfect profession in which success can rarely be achieved without some
sacrifice of principle. Thus all practicing lawyers -- and most others in the profession -- will
necessarily be imperfect, especially in the eyes of young idealists. There is no perfect justice,
just as there is no absolute in ethics. But there is perfect injustice, and we know it when we see

Law degrees have always been among the most sought-after and widely respected
courses to study at university. For many, a law degree is the first step along the path to a
career in the legal sector, often followed by the further study and training needed to become a
practicing solicitor or barrister. However, this is certainly not the only reason to study law at
university. Law degrees are notoriously challenging, and for many students, the attraction lies
in the unique combination of human interest and intellectual stimulation provided.

the ability to argue from a basis of evidence in a way which can be hard for others to do; this
actively cultivates advanced communication skills, keen problem-solving abilities and the
capacity for independent thinking. As a result, law graduates adapt very well in various
situations or career transitions. With such compelling benefits, it comes to reason that
obtaining a law degree is not easy. The standards are high and outstanding academic
performance is expected. Studying law is demanding and a truly intellectual challenge. If you

What to expect from law degrees? Like most academic degrees, law programs start
with compulsory core courses, and more opportunities to choose law topics tailored to a
particular career path later on. Teaching is through a combination of lectures, seminars, group
work, presentations, class debates and ‘mooting sessions’ – practical law training in a
courtroom setting to help students master important legal skills such as research and analysis,

to spend a year studying abroad, particularly if they are combining law with a foreign language.
Some may also provide students with the chance to work pro bono (voluntarily) with real-life

Legal education, while subject to police power, is not totally powerless against the
latter’s intrusions because of the academic freedom that educational institutions enjoy under
the Constitution. (Brion,2019) Ideally, this freedom grants educational institutions the right to
determine their admission policies, the qualification of teachers, the courses for study, and
teaching methodologies, without interference from administrative officials or from the State.
(Brion,2019) When police power and academic freedom intersect, as they inevitably must in
legal education, lessons from the Constitution hold that the State has the upper hand, but only
to the extent necessary to serve the demands of public interest. In this calibrated manner,
academic freedom is meaningfully preserved. (Brion,2019) Among others, the law schools’
average Bar passing rate of 25% per year falls way below the reasonable expectation of
everyone – of the State whose interests in justice are endangered by the potential paucity of
lawyers and specter of future erosion of legal service; and of the students whose hopes are
anchored on a fruitful future as lawyers. In the Philippine experience, the academic freedom of
law schools, however, has a very high bar to hurdle in light particularly of the undisputed failure
of many law schools to deliver their expected results. (Brion,2019)

The degree emphasizes an understanding of law in context. Aim to encourage a broad


outlook on legal issues, an understanding of the functions of law and of the legal system, and
an appreciation of the place of rules of law in the construction of politics and society. Students
learn that law is not a body of knowledge stored in libraries, but a presence all around us,
constantly evident in our social, civil and business interactions. To study law with us is not to
amass large quantities of stored information, but to explore key issues of fundamental

The study of law involves the acquisition of a variety of intellectual skills. In addition to
being a preparation for the legal profession, the creative and imaginative powers of reasoning
that the study of law develops are valued by many employers. So whilst this is a qualifying
degree, meaning you can go straight from graduating to taking the LPC (Legal Practice
Course), many students enjoy the intellectual challenge of a law degree before embarking on a

The Bachelor of Laws (LL.B.) is a four-year course offered in the College of Laws, aims
for excellence and aspire for superiority in providing legal education that meets national
standards to qualified students in order to develop trustworthy lawyers and patriotic national

course equips them with skills for the courtroom and beyond, providing greater scope and
options for a rewarding career in the legal, corporate, commercial and social justice fields.

If you are eyeing for a law career in the future, there are a number of steps that you
need to take -from having an undergraduate degree, passing the PHILSAT, and making your
way to your dream law school. To practice law in the Philippines, you need to have a Juris
Doctor (JD) or Bachelor of Laws (LL.B.) degree. Every institution in the country that offers law
education is monitored by the Legal Education Board (LEB) under the Republic Act 7662. In
Mindanao there are lots of universities and colleges offering the said program. In the province
of Bukidnon only one university is offering the program. To accommodate all aspiring lawyers
Central Mindanao University will be offering the program. The researcher found out in her
study that offering this course is feasible because based on the data gathered there is only one
school in the province of Bukidnon offering this course.

In research conducted in offering a Bachelor of Arts in Performing Arts in Camarines


Sur Polytechnic Colleges, it was also found out that the course is feasible since in accordance
on the data gathered and analyzed, there was no other school in the region offering the
degree. (Raneses, 2006) The result of the research study in offering Bachelor of Arts in
Applied Philosophy at Bicol University was also feasible. One of the cited reasons by group
respondents is that there is no similar program offered in the Bicol Region and students who
wish to enroll in this program no longer need to go to Manila to enroll in this course. (De Leon,
no date stated) A research study focusing on offering a new program at the Bicol University
entitled “Bachelor of Arts in Broadcasting: A Research – based industry Demand Analysis.”
The result of this is feasible since the university has enough human resources, technology and
other needed resources. The marketability of the proposed curriculum was analyzed from
three perspectives: 1) Target Enrollees; 2) Broadcast Media Managers; 3) other employment
firms for the employability of the graduates. (Nepomuceno, 2005)

In view of the mentioned literature and studies, the researcher believe that this
feasibility study is also feasible since the college has enough human resources, technology
and other needed resources. Moreover, there is only one institute in the province that is
offering the said course. The researchers believe that the college can offer, sustain, and
maintain the proposed program.

Countless opportunities are just around the corner, but it takes an ingenious mind to
break the grounds. A lawyer with a constant quest for the fresh and the interest that stimulates
change, do it. Study the said degree and enhance your employability within the legal industry
and learn all the areas of law required to satisfy professional accreditation through the Legal
Practitioners Admissions Board with the Bachelor of Laws.
