    VERIFICATION AND CERTIFICATION

    OF NON- FORUM SHOPPING

    I, MARCELO C. TAMBIS, of legal age, Filipino, married and with


    address at Simbuco, Kolambugan, Lanao del Norte, Philippines, after
    having been duly sworn to in accordance with law do hereby depose and
    say:

    1. That I am one of the defendants in the above entitled case and


    have caused the preparation of the foregoing Answer-in-
    Intervention;

    2. That the allegations therein are true and correct of my own


    personal knowledge and based on authentic records;

    3. That the said Answer-in-Intervention is not filed to harass, cause


    unnecessary delay, or needlessly increase the cause of litigation;

    4. That the factual allegations therein have evidentiary support or will


    likewise have evidentiary support after a reasonable opportunity
    for discovery;

    5. Further, I hereby certify that I have not commenced any other


    action or proceeding involving the same issues with the Supreme
    Court, Court of Appeals, or any other judicial or quasi-judicial
    body or agency and that to the best of my knowledge, no similar
    action is pending thereat involving the same parties, causes of
    action or issues, and should I learn of the pendency of any other
    such action, I undertake to report such fact to this Honorable
    Court within five (5) days from notice thereof.
